7-13-2233. Qualifications of directors. (1) To be eligible for election or appointment to a board of directors, a person must be:

- board of directors: means the board of directors of the district elected or appointed as provided in 7-13-2231. See Montana Code 7-13-2201
- District: means a district formed under the provisions of this part and part 23. See Montana Code 7-13-2201
- Ex officio: Literally, by virtue of one's office.
- Municipality: means a municipality or a consolidated city and county, city, or town and includes all corporations organized for municipal purposes within a district. See Montana Code 7-13-2201
- Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
- Property: means real and personal property. See Montana Code 1-1-205
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
- United States: includes the District of Columbia and the territories. See Montana Code 1-1-201
(a)registered to vote as required by law;
(b)18 years of age or older;
(c)a citizen of the United States; and
(d)a resident of the district or an owner of real property in the district who is a resident of the state of Montana.
(2)A person appointed to a board of directors as a nonvoting ex officio member as provided in 7-13-2230 must meet the requirements of this section except that the person may reside outside the boundaries of the district and is not required to own property in the district.
(3)A person appointed by a municipality to a board of directors pursuant to 7-13-2232(4) must have knowledge of the municipal water system.
