Terms Used In Montana Code 70-30-312

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

(2)An appeal does not stay any further proceedings under this chapter, except that the district court on motion or ex parte may grant a stay for a period of time and under conditions that the court considers proper.
