Whenever a referendum petition bearing signatures equal in number to at least fifteen percent of the qualified electors of a municipality has been filed with the city clerk and verified pursuant to section 18-2518, it shall be the duty of the governing body of the municipality to reconsider the measure or portion of such measure which is the object of the referendum. If the governing body fails to repeal or amend the measure or portion thereof in the manner proposed by the referendum, including an override of any veto, if necessary, within thirty days from the date the governing body receives notification pursuant to section 18-2518, the city clerk shall cause the measure to be submitted to a vote of the people at the next regularly scheduled primary or general election held within the municipality. If the governing body desires to submit the measure to a vote of the people at a special election prior to the next regularly scheduled primary or general election held within the municipality, the governing body shall, by resolution, direct the city clerk to cause the measure to be submitted at a special election. Such resolution shall not be subject to referendum or limited referendum.

Terms Used In Nebraska Statutes 18-2529

  • City clerk: means the city clerk, village clerk, or other municipal official in charge of elections. See Nebraska Statutes 18-2504
  • Governing body: means the city council or village board of trustees of any municipality subject to the Municipal Initiative and Referendum Act. See Nebraska Statutes 18-2505
  • Measure: means an ordinance, charter provision, or resolution which is within the legislative authority of the governing body of a municipality to pass and which is not excluded from the operation of referendum by the exceptions in section 18-2528. See Nebraska Statutes 18-2506
  • Municipality: means all cities and villages, not operating under home rule charters, including those functioning under the commission and city manager plans of government. See Nebraska Statutes 18-2507
  • Petition: shall mean a document authorized for circulation pursuant to section 18-2512, or any copy of such document. See Nebraska Statutes 18-2508
  • Qualified electors: shall mean all persons registered to vote, at the time the prospective petition is filed, in the jurisdiction governed or to be governed by any measure sought to be enacted by initiative, or altered or repealed by referendum. See Nebraska Statutes 18-2510
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
