As used in this chapter, unless the context otherwise requires:

Terms Used In Nevada Revised Statutes 318A.030

  • Clerk: means :

    (a) If a district is created or proposed to be created by a county, the county clerk. See Nevada Revised Statutes 318A.030

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • county: includes Carson City. See Nevada Revised Statutes 0.033
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Governing body: means the governing body of a county or city that proposes to create or creates a district pursuant to this chapter. See Nevada Revised Statutes 318A.030
  • Mail: means a single mailing first class or its equivalent, postage prepaid, by deposit in the United States mail, at least 15 days before the designated time or event. See Nevada Revised Statutes 318A.030
  • project: includes , without limitation, any structure, undertaking or system which a district is authorized to acquire, improve, equip, maintain or operate. See Nevada Revised Statutes 318A.030
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Special district: means any water district, sanitation district, water and sanitation district, municipal power district, mosquito abatement district, public cemetery district, swimming pool district, television maintenance district, weed control district, general improvement district or any other quasi-municipal corporation organized under the local improvement and service district laws of this State as enumerated in this title. See Nevada Revised Statutes 318A.030

1.  ’Board of trustees’ and ‘board’ alone each means the board of trustees of a district.

2.  ’Clerk’ means:

(a) If a district is created or proposed to be created by a county, the county clerk.

(b) If a district is created or proposed to be created by a city, the city clerk.

3.  ’Facility,’ ‘improvement’ and ‘project’ includes, without limitation, any structure, undertaking or system which a district is authorized to acquire, improve, equip, maintain or operate. A project may consist of all kinds of personal and real property, including, without limitation, land, elements, improvements and fixtures thereon, property of any nature appurtenant thereto or used in connection therewith, and every estate, interest and right therein, legal or equitable, including terms for years, or any combination thereof.

4.  ’Governing body’ means the governing body of a county or city that proposes to create or creates a district pursuant to this chapter.

5.  ’Interested party’ includes, without limitation, a member of the public, an owner of property within a proposed district or a district and each county, city, town and special district with territory proposed to be located or located within the boundaries of a proposed district or district.

6.  ’Mail’ means a single mailing first class or its equivalent, postage prepaid, by deposit in the United States mail, at least 15 days before the designated time or event.

7.  ’Parks, trails and open space district’ and ‘district’ each means any parks, trails and open space district organized or, in the case of organizational provisions, proposed to be organized pursuant to this chapter.

8.  ’Special district’ means any water district, sanitation district, water and sanitation district, municipal power district, mosquito abatement district, public cemetery district, swimming pool district, television maintenance district, weed control district, general improvement district or any other quasi-municipal corporation organized under the local improvement and service district laws of this State as enumerated in this title. The term does not include a housing authority.

9.  ’Trustee’ means a member of a board of trustees.
