Terms Used In Nevada Revised Statutes > Chapter 20 - Bonds and Undertakings; Deposits in Lieu Thereof

  • Administrator: means the Administrator of the Office. See Nevada Revised Statutes 383.011
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Board: means the Nevada Gaming Control Board. See Nevada Revised Statutes 463A.020
  • Board: means the Board of Museums and History. See Nevada Revised Statutes 381.001
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Charter school: means a public school that is formed pursuant to the provisions of chapter 388A of NRS. See Nevada Revised Statutes 385.007
  • Commission: means the Nevada Gaming Commission. See Nevada Revised Statutes 463A.020
  • Contemplation of death: The expectation of death that provides the primary motive to make a gift.
  • counselor: means a person who holds a license issued pursuant to chapter 391 of NRS and an endorsement to serve as a school counselor issued pursuant to regulations adopted by the Commission on Professional Standards in Education or who is otherwise authorized by the Superintendent of Public Instruction to serve as a school counselor. See Nevada Revised Statutes 385.007
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Cultural affiliation: has the meaning ascribed to it in NRS 381. See Nevada Revised Statutes 383.011
  • culturally affiliated: means that there is a relationship of shared group identity that may be reasonably traced historically or prehistorically between a present-day Indian tribe and an identifiable earlier group which is associated with a particular artifact or site. See Nevada Revised Statutes 381.001
  • Decedent: A deceased person.
  • Department: means the Department of Tourism and Cultural Affairs. See Nevada Revised Statutes 381.001
  • Department: means the Department of Taxation. See Nevada Revised Statutes 360.001
  • Department: means the Department of Education. See Nevada Revised Statutes 385.007
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Director: means the Director of the Department. See Nevada Revised Statutes 381.001
  • Division: means the Division of Museums and History of the Department. See Nevada Revised Statutes 381.001
  • Donor: The person who makes a gift.
  • English learner: has the meaning ascribed to it in 20 U. See Nevada Revised Statutes 385.007
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Executive Director: means the Executive Director of the Department of Taxation. See Nevada Revised Statutes 360.001
  • Fraud: Intentional deception resulting in injury to another.
  • Funerary object: means an object that, as a part of the death rite or ceremony of an Indian tribe is reasonably believed to have been placed with individual prehistoric native Indian human remains either at the time of death or later. See Nevada Revised Statutes 381.001
  • Gaming casino employee: means any person employed directly or indirectly in the operation of a gaming establishment under a nonrestricted license, including:

    (a) All personnel involved in the operation of a casino gaming pit, such as dealers, shills, clerks, hosts, junket representatives and the supervisors of such persons;

    (b) All personnel involved in handling money, such as cashiers, change persons, count teams, coin wrappers and the supervisors of such persons;

    (c) All personnel involved in the operation of games, such as bingo and keno;

    (d) All personnel involved in operating and maintaining slot machines, such as mechanics, floorpersons, change and payoff persons and the supervisors of such persons;

    (e) All personnel involved in security, such as guards, games observers and the supervisors of such persons;

    (f) All personnel involved in the operation of a race or sports book, such as writers, boardpersons, cashiers and the supervisors of such persons;

    (g) All personnel involved in the operation of a pari-mutuel operation licensed under chapter 464 of NRS and any sporting event on which such pari-mutuel wagering is conducted; and

    (h) Such other persons whose duties are similar to the classifications set forth in paragraphs (a) to (g), inclusive, as the Commission may from time to time designate by regulation, but does not include personnel whose duties are related solely to such nongaming activities as entertainment, hotel operation, maintenance and the preparation and serving of food and beverages.   • Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
  • Gross revenue: means the amount of the commission received by a licensee that is deducted from off-track pari-mutuel wagering, plus breakage and the face amount of unpaid winning tickets that remain unpaid for a period specified by the Nevada Gaming Commission. See Nevada Revised Statutes 464.005
  • Hearsay: Statements by a witness who did not see or hear the incident in question but heard about it from someone else. Hearsay is usually not admissible as evidence in court.
  • Historic: has the meaning ascribed to it in NRS 381. See Nevada Revised Statutes 381.001
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indian tribe: has the meaning ascribed to it in NRS 383. See Nevada Revised Statutes 381.001
  • Indian tribe: means any tribe, band, nation or other organized group or community of Indians which is recognized as eligible for the special programs and services provided by the United States to native Indians because of their status as native Indians. See Nevada Revised Statutes 383.011
  • Institution: means an institution of the Division established pursuant to NRS 381. See Nevada Revised Statutes 381.001
  • Intestate: Dying without leaving a will.
  • Labor organization: means an organization of any kind, or any agency or employee representation committee or plan, which exists for the purpose, in whole or in part, of dealing or seeking to deal with employers of gaming casino employees concerning grievances, labor disputes, wages, rates of pay, hours of employment or conditions of work of gaming casino employees. See Nevada Revised Statutes 463A.020
  • Museum director: means the executive director of an institution of the Division appointed by the Administrator pursuant to NRS 381. See Nevada Revised Statutes 381.001
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Off-track pari-mutuel system: means a computerized system, or component of such a system, that is used with regard to a pari-mutuel pool to transmit information such as amounts wagered, odds and payoffs on races, sporting events or other events. See Nevada Revised Statutes 464.005
  • Off-track pari-mutuel wagering: means any pari-mutuel system of wagering approved by the Nevada Gaming Commission for the acceptance of wagers on:

    (a) Horse or dog races which take place outside of this state;

    (b) Sporting events; or

    (c) Other events. See Nevada Revised Statutes 464.005

  • Office: means the Office of Historic Preservation of the Department. See Nevada Revised Statutes 383.011
  • Operator of a system: means a person engaged in providing an off-track pari-mutuel system. See Nevada Revised Statutes 464.005
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Pari-mutuel system of wagering: means any system whereby wagers with respect to the outcome of a race, sporting event or other event are placed in a wagering pool conducted by a person licensed or otherwise permitted to do so under state law, and in which the participants are wagering with each other and not against that person. See Nevada Revised Statutes 464.005
  • Prehistoric: has the meaning ascribed to it in NRS 381. See Nevada Revised Statutes 381.001
  • Prehistoric: has the meaning ascribed to it in NRS 381. See Nevada Revised Statutes 383.011
  • Probate: Proving a will
  • Public schools: means all kindergartens and elementary schools, junior high schools and middle schools, high schools, charter schools and any other schools, classes and educational programs which receive their support through public taxation and, except for charter schools, whose textbooks and courses of study are under the control of the State Board. See Nevada Revised Statutes 385.007
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • State Board: means the State Board of Education. See Nevada Revised Statutes 385.007
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Testate: To die leaving a will.
  • University school for profoundly gifted pupils: has the meaning ascribed to it in NRS 388C. See Nevada Revised Statutes 385.007
