Terms Used In New Hampshire Revised Statutes 417:11

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
Any party to the proceedings aggrieved by any order or decision of the insurance commissioner pursuant to N.H. Rev. Stat. § 417:10 shall be entitled to an appeal to the supreme court in accordance with the provisions of RSA 541, except that in the case of a fine imposed by any order or decision, the party aggrieved shall be entitled to an appeal to the superior court in the county in which the party resides, if a resident, or, if a nonresident, in the Merrimack county superior court and a trial de novo in said court.
