Terms Used In New Hampshire Revised Statutes 512:23

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Trustee: A person or institution holding and administering property in trust.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
If it appears that a third person has a claim of right to a note or instrument provided for in N.H. Rev. Stat. § 512:22, or if it is not practicable to procure the deposition of the defendant as provided for in N.H. Rev. Stat. § 512:22, the court may order notice to be given to him personally, if practicable, and by publication or otherwise, to appear and show that the note or instrument was transferred to him in good faith and for a valuable consideration before the service of the writ upon the trustee, or to be forever barred from such claim.
