Terms Used In New Hampshire Revised Statutes 512:50

  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Trustee: A person or institution holding and administering property in trust.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
In a case under N.H. Rev. Stat. § 512:49, the plaintiff shall file with the municipal court a bond to the trustee, in a sum and with sureties to the acceptance of the court, conditioned to pay the costs which the trustee may recover, and a memorandum of the filing of such bond shall be made and signed by the justice or clerk of the municipal court, on the writ, before service thereof on the trustee.
