Terms Used In New Hampshire Revised Statutes 524:4

  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • real estate: shall include lands, tenements, and hereditaments, and all rights thereto and interests therein. See New Hampshire Revised Statutes 21:21
  • Verdict: The decision of a petit jury or a judge.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
If a judgment is rendered for the plaintiff, it shall be conditional upon the plaintiff’s payment of the amount of the increased value of the real estate. The payment shall be made within one year of the verdict to the clerk of court for the use of the defendant. If the condition is met, a writ of possession shall be issued to the plaintiff. If the condition is not met, the plaintiff’s right to the real estate is barred.
