Terms Used In New Jersey Statutes 17:49A-3

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State.   • State: extends to and includes any State, territory or possession of the United States, the District of Columbia and the Canal Zone. See New Jersey Statutes 1:1-2
3. As used in this act:

a. “Board” means the board of trustees or the group of persons vested with management of the business and affairs of a nonprofit corporation regardless of the name by which the group or persons are designated.

b. “Keys amendment facility” means a medical or non-medical residential setting designated by the State as a facility that meets the requirements of the “Social Security Act,” Pub.L. 93-233 (42 U.S.C. § 1382e) as implemented by 45 CFR 1397.1 et seq.

c. “Nonprofit corporation” means any corporation organized under the “New Jersey Nonprofit Corporation Act,” N.J.S. 15A:1-1 et seq., any corporation as defined by N.J.S. 15A:1-2e or any corporation organized pursuant to Title 16 of the Revised Statutes.

d. “Owner” means the person or group vested with ownership and management of a Keys amendment facility regardless of the name by which the person or group is designated.
