Terms Used In New Jersey Statutes 18A:40-12.15

  • District: means a school district. See New Jersey Statutes 18A:1-1
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State. 5. Upon the written request of the parent or guardian and as provided in a student’s individualized health care plan, a school district shall allow the student to attend to the management and care of the student’s diabetes as needed in the classroom, in any area of the school or school grounds, or at any school-related activity if the student has been evaluated and determined to be capable of doing so as reflected in the student’s individualized health care plan. The student’s management and care of his diabetes shall include the following:

a. performing blood glucose level checks;

b. administering insulin through the insulin delivery system the student uses;

c. treating hypoglycemia and hyperglycemia;

d. possessing on the student’s person at any time the supplies or equipment necessary to monitor and care for the student’s diabetes;

e. compliance with required procedures for medical waste disposal in accordance with district policies and as set forth in the individualized health care plan; and

f. otherwise attending to the management and care of the student’s diabetes.
