- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State. The Director of the Division of Workmen’s Compensation shall be a person qualified by training and experience to direct the work of such division. He shall be appointed by the Governor, with the advice and consent of the Senate, and shall serve during the term of office of the Governor appointing him and until the director’s successor is appointed and has qualified. He shall receive such salary as shall be provided by law.
The Director of the Division of Workmen’s Compensation shall, subject to the supervision and direction of the Commissioner of Labor and Industry:
(a) Be the administrative head of the division;
(b) Prescribe the organization of the division, and the duties of his subordinates and assistants, except as may otherwise be provided by law;
(c) Direct and supervise the activities of all members of the division;
(d) Make an annual report to the Commissioner of Labor and Industry of the work of the division, which report shall be published annually for general distribution at such reasonable charge, not exceeding cost, as the commissioner shall determine;
(e) Perform such other functions of the department as the commissioner may prescribe.
The Director of the Division of Workmen’s Compensation shall also serve as secretary of such division, and may perform the duties of a judge of compensation.
