§ 15-0311. Eminent domain.
Terms Used In N.Y. Environmental Conservation Law 15-0311
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
The department may, in those situations which are specifically enumerated in this article and subject to whatever restrictions and limitations this article may impose, acquire real property pursuant to this article under an exercise of the right of eminent domain.
