§ 135-c. Home conservation plans; eligibility; approval by the commission. 1. After hearing upon reasonable notice, the commission shall establish home conservation plans for each utility in accordance with the provisions of this article. Such plans shall be open to participation by all eligible customers meeting the criteria set forth in this article. Such eligibility shall cease June first, nineteen hundred ninety-six.

  • Commission: means the public service commission of the state of New York. See N.Y. Public Service Law 135-B
  • Utility: means an investor-owned gas or electrical corporation regulated by the commission whose gross revenues for the preceding calendar year exceeded three hundred fifty million dollars. See N.Y. Public Service Law 135-B

2. Participation shall be open to all eligible customers, regardless of type of fuel or energy used for space or water heating or cooling.

3. Participation shall be limited to individual projects wherein the amount to be financed is in excess of two hundred dollars. In addition, the estimated cost of such projects must be recovered within seven years from the savings generated by reduced energy consumption resulting from such projects; provided however, in the case of heat pumps, solar and wind systems, the estimated cost of such projects must be recovered within fifteen years.
