Nothing in this Article shall be construed to:

(1)        Grant to the Commission any jurisdiction or authority with respect to air contamination existing solely within commercial and industrial plants, works or shops;

(2)        Affect the relations between employers and employees with respect or arising out of conditions of air contamination or air pollution;

(3)        Supersede or limit the applicability of any law, rules and regulations or ordinances relating to industrial health or safety. (1967, c. 892, s. 1; 1973, c. 1262, s. 23; 1987, c. 827, s. 154.)

Terms Used In North Carolina General Statutes 143-215.9

  • air contamination: means the presence in the outdoor atmosphere of one or more air contaminants which contribute to a condition of air pollution. See North Carolina General Statutes 143-213
  • air pollution: shall mean the presence in the outdoor atmosphere of one or more air contaminants in such quantities and duration as is or tends to be injurious to human health or welfare, to animal or plant life or to property or that interferes with the enjoyment of life or property. See North Carolina General Statutes 143-213
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
