Terms Used In North Carolina General Statutes 143-300.9

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies. In an action to which this Article applies, the State shall pay the excess amount of a judgment or settlement under N.C. Gen. Stat. § 143-300.6 for damages against a State employee for collecting or administering a tax that is held unconstitutional.  The excess amount is the amount of the judgment or settlement over (i) the limit provided in N.C. Gen. Stat. § 143-300.6(a) and (ii) any coverage under N.C. Gen. Stat. § 58-32-15.  This section does not waive the sovereign immunity of the State with respect to any claim. (1991, c. 674, s. 1.)
