The determination of the amount of compensation shall reflect the value of the property immediately prior to the filing of the petition under N.C. Gen. Stat. § 40A-20 or the complaint under N.C. Gen. Stat. § 40A-41 and except as provided in the following sections shall not reflect an increase or decrease due to the condemnation. The day of the filing of a petition or complaint shall be the date of valuation of the interest taken. (1981, c. 919, s. 1.)

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Condemnation: means the procedure prescribed by law for exercising the power of eminent domain. See North Carolina General Statutes 40A-2
  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
  • Property: means any right, title, or interest in land, including leases and options to buy or sell. See North Carolina General Statutes 40A-2
