Terms Used In North Carolina General Statutes 7A-410.1

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

When a justice, judge, or district attorney has been disbarred or suspended from the practice of law under N.C. Gen. Stat. § 84-28 but the office has not been declared vacant under N.C. Gen. Stat. § 7A-410, the salary of the justice, judge, or district attorney is suspended immediately. If the order of disbarment or suspension is reversed on appeal, the salary shall be paid retroactively from the date the salary was suspended. (2007-104, s. 1.)
