Terms Used In North Carolina General Statutes > Chapter 131D > Article 1 - Adult Care Homes

  • Abuse: The willful or grossly negligent infliction of physical pain, injury, or mental anguish, unreasonable confinement, or the willful or grossly negligent deprivation by the administrator or staff of an adult care home of services which are necessary to maintain mental and physical health. See North Carolina General Statutes 131D-2.1
  • Administrator: A person approved by the Department of Health and Human Services as an assisted living administrator under N. See North Carolina General Statutes 131D-2.1
  • Adult care home: An assisted living residence in which the housing management provides 24-hour scheduled and unscheduled personal care services to two or more residents, either directly or for scheduled needs, through formal written agreement with licensed home care or hospice agencies. See North Carolina General Statutes 131D-2.1
  • Adult care home resident discharge team: A team consisting of one member from the department of social services and one member from the local management entity responsible for assisting in finding an appropriate placement for discharged residents, as established by the county department of social services in every county which contains an adult care home licensed under this Chapter. See North Carolina General Statutes 131D-2.1
  • Amenities: Services such as meals, housekeeping, transportation, and grocery shopping that do not involve hands-on personal care. See North Carolina General Statutes 131D-2.1
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Assisted living residence: Any group housing and services program for two or more unrelated adults, by whatever name it is called, that makes available, at a minimum, one meal a day and housekeeping services and provides personal care services directly or through a formal written agreement with one or more licensed home care or hospice agencies. See North Carolina General Statutes 131D-2.1
  • Compensatory agent: A spouse, relative, or other caretaker who lives with a resident and provides care to a resident. See North Carolina General Statutes 131D-2.1
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: The Department of Health and Human Services unless some other meaning is clearly indicated from the context. See North Carolina General Statutes 131D-2.1
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Exploitation: The illegal or improper use of an aged or disabled resident or the aged or disabled resident's resources for another's profit or advantage. See North Carolina General Statutes 131D-2.1
  • Family care home: An adult care home having two to six residents. See North Carolina General Statutes 131D-2.1
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
  • Hearing Unit: The chief hearing officer within the Division of Health Benefits designated to preside over hearings regarding the transfer and discharge of adult care home residents, and the chief hearing officer's staff. See North Carolina General Statutes 131D-2.1
  • in writing: may be construed to include printing, engraving, lithographing, and any other mode of representing words and letters: Provided, that in all cases where a written signature is required by law, the same shall be in a proper handwriting, or in a proper mark. See North Carolina General Statutes 12-3
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • month: shall be construed to mean a calendar month, unless otherwise expressed; and the word "year" a calendar year, unless otherwise expressed; and the word "year" alone shall be equivalent to the expression "year of our Lord. See North Carolina General Statutes 12-3
  • Multiunit assisted housing with services: An assisted living residence in which hands-on personal care services and nursing services which are arranged by housing management are provided by a licensed home care or hospice agency through an individualized written care plan. See North Carolina General Statutes 131D-2.1
  • Neglect: The failure to provide the services necessary to maintain a resident's physical or mental health. See North Carolina General Statutes 131D-2.1
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Personal care services: Any hands-on services allowed to be performed by In-Home Aides II or III as outlined in Department rules. See North Carolina General Statutes 131D-2.1
  • Registration: The submission by a multiunit assisted housing with services provider of a disclosure statement containing all the information as outlined in subdivision (10) of this section. See North Carolina General Statutes 131D-2.1
  • Resident: A person living in an assisted living residence for the purpose of obtaining access to housing and services provided or made available by housing management. See North Carolina General Statutes 131D-2.1
  • Secretary: The Secretary of Health and Human Services unless some other meaning is clearly indicated from the context. See North Carolina General Statutes 131D-2.1
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies.
