Terms Used In North Dakota Code 29-30.3-03

  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Person: means an individual, organization, government, political subdivision, or government agency or instrumentality. See North Dakota Code 1-01-49
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See North Dakota Code 1-01-49
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

1.    Try a demanded or requested person for a crime committed within this state; 2.    Take custody of a demanded or requested person by extradition or rendition proceedings for the purpose of trial, sentence, or punishment for a crime committed within this state; 3.    Take custody of a person under other provisions of law, including interstate agreements; or

4.    Release a person from custody upon any valid conditions.
