Terms Used In Ohio Code > Chapter 5 - State Insignia; Seals; Holidays

  • Acceptor: means a drawee who has accepted a draft. See Ohio Code 1303.01
  • Accession: means goods that are physically united with other goods in such a manner that the identity of the original goods is not lost. See Ohio Code 1309.102
  • Accident: means an occurrence during the operation of an amusement ride that results in death or injury requiring immediate hospital admission. See Ohio Code 993.01
  • Accommodated party: means the party to an instrument for the benefit of which the instrument is issued for value. See Ohio Code 1303.59
  • Accommodation party: means a party to an instrument other than the accommodated party. See Ohio Code 1303.59
  • Account: includes health-care insurance receivables. See Ohio Code 1309.102
  • Account debtor: means a person who is obligated on an account, chattel paper, or general intangible. See Ohio Code 1309.102
  • accounting for: means a record:

    (a) Authenticated by a secured party;

    (b) Indicating the aggregate unpaid secured obligations as of a date not more than thirty-five days earlier or thirty-five days later than the date of the record; and

    (c) Identifying the components of the obligations in reasonable detail. See Ohio Code 1309.102

  • Accredited veterinarian: means a veterinarian accredited by the United States department of agriculture. See Ohio Code 956.01
  • Acquiree mutual bank: means any state bank, savings association, or savings bank that meets both of the following conditions:

    (1) It is acquired by a mutual holding company as part of, and concurrently with, a mutual holding company reorganization. See Ohio Code 1116.01

  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Active ingredient: means any ingredient that will prevent, destroy, kill, repel, control, or mitigate any pest, or that will act as a plant regulator, defoliant, or desiccant. See Ohio Code 921.01
  • Actuary: means an individual who satisfies all of the following requirements:

    (1) Is a member of the American academy of actuaries;

    (2) Is an associate or fellow of the society of actuaries;

    (3) Has a minimum of five years' experience in providing actuarial services to public retirement plans. See Ohio Code 742.01

  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Adult dog: means a dog that is twelve months of age or older. See Ohio Code 956.01
  • Advertisement: means any written, visual, or oral communication made to a lessee or prospective lessee by means of personal representation, newspaper, magazine, circular, billboard, direct mailing, sign, radio, television, telephone, or other means of communication, that aids, promotes, or assists, directly or indirectly, a lease-purchase agreement. See Ohio Code 1351.01
  • Advertising: means a commercial message in any medium that promotes, either directly or indirectly, a residential mortgage lending transaction. See Ohio Code 1322.01
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Adviser: means a person who, at the request of the issuer, a confirmer, or another adviser, notifies or requests another adviser to notify the beneficiary that a letter of credit has been issued, confirmed, or amended. See Ohio Code 1305.01
  • Advisory council: means the advisory council on amusement ride safety created by section 993. See Ohio Code 993.01
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affiliate: means any individual or entity controlling, controlled by, or under common control with a family trust company. See Ohio Code 1112.01
  • Affiliate: means a person that directly, or indirectly through one or more intermediaries, controls, is controlled by, is under common control with, or acts in concert with, a specified person. See Ohio Code 1704.01
  • Affiliate: means any of the following:

    (1) A person who directly or indirectly owns, controls, or holds with power to vote, twenty per cent or more of the outstanding voting securities of the debtor, other than a person who holds the securities in either of the following manners:

    (a) As a fiduciary or agent without sole discretionary power to vote the securities;

    (b) Solely to secure a debt, if the person has not exercised the power to vote. See Ohio Code 1336.01

  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agent: means any person, other than a producer, who delivers an agricultural commodity to a licensed handler, either for sale or for storage, for the account of the producer. See Ohio Code 926.01
  • Agricultural commodity: means corn, soybeans, wheat, or any other agricultural crop that the director of agriculture may designate by rule. See Ohio Code 926.01
  • Agricultural cooperative: means a cooperative to which all of the following apply:

    (1) The cooperative engages in any activity in connection with the propagation, raising, producing, harvesting, storing, drying, handling, processing, or marketing of agricultural products; procuring equipment and supplies or providing services for producers and others; bargaining; and any activity related to the foregoing. See Ohio Code 1729.01

  • agricultural cooperative association: means any agricultural cooperative organized under Chapter 1729 of the Revised Code and qualified to do business in this state if the director of agriculture finds the association has, in good faith, its entire activities under the control of its members and has been and is exercising full authority in the sale of milk or cream for its members. See Ohio Code 917.01
  • Agricultural lien: means an interest, other than a security interest, in farm products:

    (a) That secures payment or performance of an obligation for:

    (i) Goods or services furnished in connection with a debtor's farming operation; or

    (ii) Rent on real property leased by a debtor in connection with its farming operation. See Ohio Code 1309.102

  • Agricultural pollution: means failure to use management or conservation practices in farming operations to abate wind or water erosion of the soil or to abate the degradation of the waters of the state by residual farm products, manure, or soil sediment, including attached substances. See Ohio Code 939.01
  • Agricultural pollution: means failure to use management or conservation practices in farming or silvicultural operations to abate wind or water erosion of the soil or to abate the degradation of the waters of the state by residual farm products, manure, or soil sediment, including substances attached thereto. See Ohio Code 940.01
  • Agricultural production: includes conservation practices, provided that the tracts, lots, or parcels of land or portions thereof that are used for conservation practices comprise not more than twenty-five per cent of tracts, lots, or parcels of land that are otherwise devoted exclusively to agricultural use and for which an application is filed under section 929. See Ohio Code 929.01
  • Agricultural products: includes aquacultural, horticultural, viticultural, forestry, dairy, livestock, poultry, bee, and farm products, and the produce or byproducts of any of such products. See Ohio Code 1729.01
  • agriculture: includes farming; ranching; aquaculture; algaculture meaning the farming of algae; apiculture and related apicultural activities, production of honey, beeswax, honeycomb, and other related products; horticulture; viticulture, winemaking, and related activities; animal husbandry, including, but not limited to, the care and raising of livestock, equine, and fur-bearing animals; poultry husbandry and the production of poultry and poultry products; dairy production; the production of field crops, tobacco, fruits, vegetables, nursery stock, ornamental shrubs, ornamental trees, flowers, sod, or mushrooms; timber; pasturage; any combination of the foregoing; the processing, drying, storage, and marketing of agricultural products when those activities are conducted in conjunction with, but are secondary to, such husbandry or production; and any additions or modifications to the foregoing made by the director of agriculture by rule adopted in accordance with Chapter 119 of the Revised Code. See Ohio Code 1.61
  • Aircraft: means any device used or designed for navigation or flight in the air, except a parachute or other device used primarily as safety equipment. See Ohio Code 921.01
  • Allegation: something that someone says happened.
  • alliance health care program: means a program sponsored by a small employer health care alliance that assists small employer members of such small employer health care alliance or any other small employer health care alliance to obtain coverage for their employees under one or more health benefit plans, and that includes at least one agreement between a small employer health care alliance and an insurer that contains the insurer's agreement to offer and sell one or more health benefit plans to such small employers and contains all of the other features required under section 1731. See Ohio Code 1731.01
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amortization: Paying off a loan by regular installments.
  • Amphibians: includes eastern hellbender (Crytpobranchus alleganiensis alleganiensis), mudpuppy (Necturus maculosus maculosus), red-spotted newt (Notophthalmus viridescens viridescens), Jefferson salamander (Ambystoma jeffersonianum), spotted salamander (Ambystoma maculatum), blue-spotted salamander (Ambystoma laterale), smallmouth salamander (Ambystoma texanum), streamside salamander (Ambystoma barbouri), marbled salamander (Ambystoma opacum), eastern tiger salamander (Ambystoma tigrinum tigrinum), northern dusky salamander (Desmognathus fuscus fuscus), mountain dusky salamander (Desmognathus ochrophaeus), redback salamander (Plethodon cinereus), ravine salamander (Plethodon richmondi), northern slimy salamander (Plethodon glutinosus), Wehrle's salamander (Plethodon wehrlei), four-toed salamander (Hemidactylium scutatum), Kentucky spring salamander (Gyrinophilus porphyriticus duryi), northern spring salamander (Gyrinophilus porphyriticus porphyriticus), mud salamander (Pseudotriton montanus), northern red salamander (Pseudotriton ruber ruber), green salamander (Aneides aeneus), northern two-lined salamander (Eurycea bislineata), longtail salamander (Eurycea longicauda longicauda), cave salamander (Eurycea lucifuga), southern two-lined salamander (Eurycea cirrigera), Fowler's toad (Bufo woodhousii fowleri), American toad (Bufo americanus), eastern spadefoot (Scaphiopus holbrookii), Blanchard's cricket frog (Acris crepitans blanchardi), northern spring peeper (Pseudacris crucifer crucifer), gray treefrog (Hyla versicolor), Cope's gray treefrog (Hyla chrysoscelis), western chorus frog (Pseudacris triseriata triseriata), mountain chorus frog (Pseudacris brachyphona), bullfrog (Rana catesbeiana), green frog (Rana clamitans melanota), northern leopard frog (Rana pipiens), pickerel frog (Rana palustris), southern leopard frog (Rana utricularia), and wood frog (Rana sylvatica). See Ohio Code 1531.01
  • Amusement ride: includes carnival rides, bungee jumping facilities, and fair rides, but does not include passenger tramways as defined in section 4169. See Ohio Code 993.01
  • Amusement ride operator: means any person causing the amusement ride to go, stop, or perform its function. See Ohio Code 993.01
  • Angling: means fishing with not more than two hand lines, not more than two units of rod and line, or a combination of not more than one hand line and one rod and line, either in hand or under control at any time while fishing. See Ohio Code 1531.01
  • Animal: means all vertebrate and invertebrate species, including, but not limited to, humans and other mammals, birds, fish, and shellfish. See Ohio Code 921.01
  • Animal: means any animal that is a bird, reptile, amphibian, fish, or mammal, other than humans. See Ohio Code 941.01
  • Animal: means any animal, other than a human being, and includes domestic fowl, wild birds, fish, and reptiles, living or dead. See Ohio Code 953.21
  • Animal feeding facility: means a lot, building, or structure where both of the following conditions are met:

    (1) Agricultural animals have been, are, or will be stabled or confined and fed or maintained there for a total of forty-five days or more in any twelve-month period. See Ohio Code 903.01

  • Animal feeding operation: means the production area, as defined in section 903. See Ohio Code 939.01
  • Animal rescue for dogs: includes an individual or organization that offers spayed or neutered dogs for adoption and charges reasonable adoption fees to cover the costs of the individual or organization, including, but not limited to, costs related to spaying or neutering dogs. See Ohio Code 956.01
  • Animal shelter for dogs: means a facility that keeps, houses, and maintains dogs such as a dog pound operated by a municipal corporation, or by a county under Chapter 955 of the Revised Code, or that is operated by a humane society, animal welfare society, society for the prevention of cruelty to animals, or other nonprofit organization that is devoted to the welfare, protection, and humane treatment of dogs and other animals. See Ohio Code 956.01
  • Announcement date: means the date of the first public announcement of a definitive proposal for a Chapter 1704. See Ohio Code 1704.01
  • Annual percentage rate: The cost of credit at a yearly rate. It is calculated in a standard way, taking the average compound interest rate over the term of the loan so borrowers can compare loans. Lenders are required by law to disclose a card account's APR. Source: FDIC
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Annular overpressurization: means the accumulation of fluids within an annulus with sufficient pressure to allow migration of annular fluids into underground sources of drinking water. See Ohio Code 1509.01
  • Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • anything of value: includes :

    (A) Money, bank bills or notes, United States treasury notes, and other bills, bonds, or notes issued by lawful authority and intended to pass and circulate as money;

    (B) Goods and chattels;

    (C) Promissory notes, bills of exchange, orders, drafts, warrants, checks, or bonds given for the payment of money;

    (D) Receipts given for the payment of money or other property;

    (E) Rights in action;

    (F) Things which savor of the realty and are, at the time they are taken, a part of the freehold, whether they are of the substance or produce thereof or affixed thereto, although there may be no interval between the severing and taking away;

    (G) Any interest in realty, including fee simple and partial interests, present and future, contingent or vested interests, beneficial interests, leasehold interests, and any other interest in realty;

    (H) Any promise of future employment;

    (I) Every other thing of value. See Ohio Code 1.03

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Applicable agency: means a department or agency of the state to which both of the following apply:

    (1) It is authorized to regulate certain types of business activity in this state and persons engaged in such business, including the issuance of licenses or other types of authorization. See Ohio Code 1355.01

  • Applicable county recorder: means the county recorder of a county in which a partition fence is, was, or is not required to be constructed and maintained in good repair. See Ohio Code 971.01
  • Applicant: means a person at whose request or for whose account a letter of credit is issued. See Ohio Code 1305.01
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved education course: means any course approved by the nationwide mortgage licensing system and registry. See Ohio Code 1322.01
  • Approved test provider: means any test provider approved by the nationwide mortgage licensing system and registry. See Ohio Code 1322.01
  • Approximate original contour: means that surface configuration achieved by backfilling and grading of a mined area so that the reclaimed area, including any terracing or access roads, closely resembles the general surface configuration of the land prior to mining and blends into and complements the drainage pattern of the surrounding terrain, with all highwalls and spoil piles eliminated; water impoundments may be permitted where the chief of the division of mineral resources management determines that they are in compliance with division (A)(8) of section 1513. See Ohio Code 1513.01
  • Aquifer: means a consolidated or unconsolidated geologic formation or series of formations that are hydraulically interconnected and that have the ability to receive, store, or transmit water. See Ohio Code 1521.01
  • Area of land affected: means the area of land that has been excavated, or upon which a spoil bank exists, or both. See Ohio Code 1514.01
  • Arrest: Taking physical custody of a person by lawful authority.
  • Articles: includes original articles of incorporation, agreements of merger, amended articles, and amendments to any of these. See Ohio Code 1733.01
  • Articles: includes original articles of incorporation, agreements of merger or consolidation if and only to the extent that articles of incorporation are adopted or amended in the agreements, amended articles, and amendments to any of these, and, in the case of a corporation created before September 1, 1851, the special charter and any amendments to it made by special act of the general assembly or pursuant to general law. See Ohio Code 1702.01
  • Articles of organization: means the articles of organization described in section 1706. See Ohio Code 1706.01
  • As-extracted collateral: means :

    (a) Oil, gas, or other minerals that are subject to a security interest that:

    (i) Is created by a debtor having an interest in the minerals before extraction; and

    (ii) Attaches to the minerals as extracted; or

    (b) Accounts arising out of the sale at the wellhead or minehead of oil, gas, or other minerals in which the debtor had an interest before extraction. See Ohio Code 1309.102

  • Assessment: means a written finding by the tax administrator that a person has underpaid municipal income tax, or owes penalty and interest, or any combination of tax, penalty, or interest, to the municipal corporation that commences the person's time limitation for making an appeal to the local board of tax review pursuant to section 718. See Ohio Code 718.01
  • Asset: means property of a debtor, but does not include any of the following:

    (1) Property to the extent it is encumbered by a valid lien;

    (2) Property to the extent it generally is exempt under nonbankruptcy law, including, but not limited to, section 2329. See Ohio Code 1336.01

  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Assignment: means a transfer, conveyance, deed, bill of sale, lease, mortgage, security interest, encumbrance, gift, or transfer by operation of law. See Ohio Code 1706.01
  • Association: means any corporation organized under this chapter. See Ohio Code 1729.01
  • Association member: means any member of a credit union other than a credit union or an individual member. See Ohio Code 1733.01
  • At retail: means for use or consumption by the purchaser and not for resale. See Ohio Code 919.01
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attachments: means equipment designed to be used on or in conjunction with farm machinery or construction equipment. See Ohio Code 1353.01
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Audit: means the examination of a person or the inspection of the books, records, memoranda, or accounts of a person for the purpose of determining liability for a municipal income tax. See Ohio Code 718.01
  • Authorized communications equipment: means any communications equipment that provides a transmission, including, but not limited to, by telephone, telecopy, or any electronic means, from which it can be determined that the transmission was authorized by, and accurately reflects the intention of, the member or manager involved and, with respect to meetings, allows all persons participating in the meeting to contemporaneously communicate with each other. See Ohio Code 1745.05
  • Authorized communications equipment: means any communications equipment that provides a transmission, including, but not limited to, by telephone, telecopy, or any electronic means, from which it can be determined that the transmission was authorized by, and accurately reflects the intention of, the member or director involved and, with respect to meetings, allows all persons participating in the meeting to contemporaneously communicate with each other. See Ohio Code 1702.01
  • autopsy: means the external and internal examination of the body of a deceased person, including, but not limited to, gross visual inspection and dissection of the body and its internal organs, photographic or narrative documentation of findings, microscopic, radiological, toxicological, chemical, or other laboratory analyses performed in the discretion of the examining individual upon tissues, organs, blood, other bodily fluids, gases, or any other specimens and the retention for diagnostic and documentary purposes of tissues, organs, blood, other bodily fluids, gases, or any other specimens as the examining individual considers necessary to establish and defend against challenges to the cause and manner of death of the deceased person. See Ohio Code 313.123
  • Average annual salary: means the highest average annual salary of a member of the fund during any of the number of years of contributions specified in section 742. See Ohio Code 742.01
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailee: means a person to whom an agricultural commodity is delivered in trust for storage in a warehouse with title remaining in the name of the depositor. See Ohio Code 926.01
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Bailment agreement: means a bailor-bailee agreement between a depositor and a licensed handler as stated in the terms of a receipt that is issued for an agricultural commodity in storage and subject to the requirements of this chapter governing the use of a receipt. See Ohio Code 926.01
  • Bailor: means a person who delivers an agricultural commodity to a bailee in trust for storage in a warehouse with title remaining in the name of the depositor. See Ohio Code 926.01
  • Bank: includes savings banks, savings and loan associations, credit unions, and trust companies. See Ohio Code 1309.102
  • Bank: means any bank, trust company, savings and loan association, savings bank, or credit union that is incorporated or organized under the laws of the United States, any state of the United States, Canada, or any province of Canada and that is subject to regulation or supervision by that country, state, or province. See Ohio Code 1707.01
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Bargaining: means the mutual obligation of a handler and a marketing cooperative to meet at reasonable times and confer and negotiate in good faith. See Ohio Code 1729.01
  • base of operation: means the location where an individual owns or rents an office, storefront, or similar facility to which the individual regularly reports and at which the individual regularly performs personal services for compensation. See Ohio Code 718.01
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Beneficial owner: includes any person who directly or indirectly through any contract, arrangement, understanding, or relationship has or shares, or otherwise has or shares, the power to vote or direct the voting of a security or the power to dispose of, or direct the disposition of, the security. See Ohio Code 1707.01
  • beneficiaries: means those eligible employees, retirees, their dependents, and members of their families who are covered by health benefit plans provided by an insurer to enrolled small employers under an alliance program. See Ohio Code 1731.01
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Beneficiary: means a person who, under the terms of a letter of credit, is entitled to have its complying presentation honored. See Ohio Code 1305.01
  • benefits: includes , but is not limited to, any of the following factors:

    (1) Elimination or reduction of damage from flooding;

    (2) Removal of water conditions that jeopardize public health, safety, or welfare;

    (3) Increased value of land resulting from an improvement;

    (4) Use of water for irrigation, storage, regulation of stream flow, soil conservation, water supply, or any other incidental purpose;

    (5) Providing an outlet for the accelerated runoff from artificial drainage if a stream, watercourse, channel, or ditch that is under improvement is called upon to discharge functions for which it was not designed. See Ohio Code 940.01

  • Bequest: Property gifted by will.
  • Best management practices: means the engagement of agricultural production and management, including practices such as manure handling, tillage, forestry management, and similar practices, in a manner that is generally accepted in the agriculture industry and that is approved by any of the following:

    (1) The United States department of agriculture;

    (2) The natural resources conservation service in the United States department of agriculture;

    (3) The department of agriculture;

    (4) A soil and water conservation district established under Chapter 940 of the Revised Code;

    (5) With respect to organic or sustainable production methods, a conservation professional whom the director of agriculture approves as having expertise in those methods. See Ohio Code 931.01

  • Best management practices: includes structural and nonstructural practices, conservation practices, and operation and maintenance procedures. See Ohio Code 939.01
  • Board: means the board of directors of an association. See Ohio Code 1729.01
  • Board of health: means the board of health of a city or general health district or the authority having the duties of a board of health in any city authorized by section 3709. See Ohio Code 935.01
  • board of township trustees: means only a board of township trustees of a township that adopts a limited home rule government under this chapter. See Ohio Code 504.021
  • Boarding kennel: means an establishment operating for profit that keeps, houses, and maintains dogs solely for the purpose of providing shelter, care, and feeding of the dogs in return for a fee or other consideration. See Ohio Code 956.01
  • Bona fide nonprofit organization: means an organization that meets all of the following:

    (1) Has the status of a tax-exempt organization under section 501(c)(3) of the Internal Revenue Code of 1986, as amended;

    (2) Promotes affordable housing or provides homeownership education or similar services;

    (3) Conducts its activities in a manner that serves public or charitable purposes, rather than commercial purposes;

    (4) Receives funding and revenue and charges fees in a manner that does not incentivize it or its employees to act other than in the best interests of its clients;

    (5) Compensates its employees in a manner that does not incentivize employees to act other than in the best interests of its clients;

    (6) Provides, or identifies for the borrower, residential mortgage loans with terms favorable to the borrower and comparable to mortgage loans and housing assistance provided under government housing assistance programs;

    (7) Has obtained a valid letter of exemption from the superintendent of financial institutions. See Ohio Code 1322.01

  • Bond: includes an undertaking. See Ohio Code 1.02
  • Bond proceedings: means the resolutions, trust agreements, and other agreements, credit enhancement facilities, and amendments and supplements to the foregoing, or any one or more or combination thereof, authorizing, awarding, or providing for the terms and conditions applicable to or providing for the security or liquidity of obligations, and the provisions contained in those obligations. See Ohio Code 1557.01
  • Bond proceedings: means the resolution or ordinance or the trust agreement or indenture of mortgage, or combination thereof, authorizing or providing for the terms and conditions applicable to bonds issued under authority of this chapter. See Ohio Code 902.01
  • Bond service fund: means the fund, and any accounts in that fund, created by former section 1557. See Ohio Code 1557.01
  • Bonds: means bonds, notes, or other forms of evidences of obligation issued in temporary or definitive form, including refunding bonds and notes and bonds and notes issued in anticipation of the issuance of bonds and renewal notes. See Ohio Code 902.01
  • Bonds and notes: means convention facilities authority revenue bonds and convention facilities authority tax anticipation bonds. See Ohio Code 351.01
  • Borrower: means the recipient of a loan or the lessee or purchaser of a project under this chapter and is limited to a sole proprietor, or to a partnership, joint venture, firm, association, or corporation, a majority of whose stockholders, partners, members, or associates are persons or the spouses of persons related to each other within the fourth degree of kinship, according to law, provided that the sole proprietor or at least one of such related persons resides or will reside on or is or will actively operate the project or the farm or agricultural enterprise composed, in whole or in part, of the project, and provided further that the sole proprietor or all of the stockholders, members, partners, or associates are natural persons. See Ohio Code 902.01
  • Borrower: means a person seeking a residential mortgage loan or an obligor on a residential mortgage loan. See Ohio Code 1322.01
  • Boundary: when used in referring to the boundary of a gas storage reservoir, means the boundary of such reservoir as shown on the map or maps thereof on file in the division of oil and gas resources management as required by this chapter. See Ohio Code 1571.01
  • Branch office: means a location at which a licensee conducts business other than a registrant's principal place of business, if at least one of the following applies to the location:

    (1) The address of the location appears on business cards, stationery, or advertising used by the registrant;

    (2) The registrant's name or advertising at the location suggests that mortgage transactions are made at the location;

    (3) The location is held out to the public as a licensee's place of business due to the actions of an employee or independent contractor of the registrant; or

    (4) The location within this state is controlled directly or indirectly by the registrant. See Ohio Code 1322.01

  • Brand: means any word, name, symbol, device, or combination thereof, that serves to distinguish the pesticide manufactured or distributed by one person from that manufactured or distributed by any other person. See Ohio Code 921.01
  • Brand: means a distinctive design, mark of identification, or number that is applied to the hide of livestock by a hot iron or other humane method approved by the director of agriculture and is currently registered under section 947. See Ohio Code 947.01
  • Brine: means all saline geological formation water resulting from, obtained from, or produced in connection with exploration, drilling, well stimulation, production of oil or gas, or plugging of a well. See Ohio Code 1509.01
  • broker: means any person found by the department of agriculture buying, receiving, selling, slaughtering, with the exception of those persons designated by division (B)(1) of section 918. See Ohio Code 943.01
  • Bungee jumping: means a fall or jump from a height by an individual who is attached to an elastic cord that prevents the individual from hitting the ground, water, or other solid, semi-solid, liquid, or elastic surface. See Ohio Code 993.01
  • Business: means any limited liability company, limited liability partnership, corporation, sole proprietorship, association, state institution of higher education as defined in section 3345. See Ohio Code 1354.01
  • Business: means every trade, occupation, or profession. See Ohio Code 1705.01
  • Business corporation: means any entity that is organized pursuant to Chapter 1701 of the Revised Code other than a public benefit entity. See Ohio Code 1702.01
  • Business entity: means a partnership, corporation, limited liability company, or other entity. See Ohio Code 1112.01
  • Buyer: means a person that buys or agrees to buy goods or any legal successor in interest of such person. See Ohio Code 1317.01
  • Buyer: includes an individual whose mortgage loan is serviced by a mortgage servicer. See Ohio Code 1322.01
  • Calendar quarter: means the three-month period ending on the last day of March, June, September, or December. See Ohio Code 718.01
  • Canal lands: includes any part of the bed, berm, bank, or slope of any canal, canal basin, or canal reservoir or of any lock, aqueduct, dam, culvert, tunnel, feeder, or side cut formerly a part of any canal system in this state, whether or not abandoned; the outer slope of any towing path embankment formerly a part of any canal system in this state; and any tract of land that was a part of or intended for the use of any canal system in this state. See Ohio Code 1520.01
  • Canal reservoir: means any artificial lake or impoundment that was constructed to provide water to any canal system in this state. See Ohio Code 1520.01
  • Cannabidiol: means the cannabidiol compound, containing a delta-9 tetrahydrocannabinol concentration of not more than three-tenths per cent, derived from hemp. See Ohio Code 928.01
  • Canoe: means a paddlecraft that is normally an open, narrow vessel of shallow draft, typically pointed at both ends and propelled by its occupants through the use of paddles while kneeling or sitting on a raised seat, including a flat-backed canoe and a racing canoe. See Ohio Code 1546.01
  • Captive deer with certified chronic wasting disease status: means captive white-tailed deer that have been legally acquired or their offspring, are part of a herd that has been monitored and tested for disease in accordance with rules, including tested for chronic wasting disease for at least five consecutive years in accordance with rules, are privately owned primarily for the purposes of agriculture, propagation, or providing deer to a wild animal hunting preserve licensed under section 1533. See Ohio Code 943.01
  • Captive deer with status: means captive white-tailed deer that have been legally acquired or their offspring, are part of a herd that is monitored and tested for disease in accordance with rules, and are privately owned primarily for the purposes of agriculture, propagation, or providing captive deer to a wild animal hunting preserve licensed under section 1533. See Ohio Code 943.01
  • Captive white-tailed deer: means legally acquired deer that are held in private ownership at a facility licensed under section 943. See Ohio Code 1531.01
  • Captive whitetail deer licensee: means a person who has been issued a license under section 943. See Ohio Code 943.01
  • Carcass: means the dressed body of a horse. See Ohio Code 919.01
  • Care coordination: means assisting an individual to access available physical health, behavioral health, social, employment, education, and housing services the individual needs. See Ohio Code 355.01
  • Case law: The law as laid down in cases that have been decided in the decisions of the courts.
  • Cash price: means the price at which a lessor in the ordinary course of business would offer the property that is the subject of a lease-purchase agreement to the lessee for cash on the date of the lease-purchase agreement. See Ohio Code 1351.01
  • Cash price: means the price measured in dollars, agreed upon in good faith by the parties as the price at which the specific goods which are the subject matter of any retail installment sale would be sold if such sale were a sale for cash to be paid upon delivery instead of a retail installment sale. See Ohio Code 1317.01
  • Cash proceeds: means proceeds that are money, checks, deposit accounts, or the like. See Ohio Code 1309.102
  • Casing: means a string or strings of pipe commonly placed in a well. See Ohio Code 1571.01
  • Cattle: includes , but is not limited to, heifers, steers, bulls, and cow and calf pairs. See Ohio Code 903.01
  • Certificate of title: means a certificate of title with respect to which a statute provides for the security interest in question to be indicated on the certificate as a condition or result of the security interest's obtaining priority over the rights of a lien creditor with respect to the collateral. See Ohio Code 1309.102
  • Certified mine foreperson: means the person whom the operator of a surface mining operation places in charge of the conditions and practices at the mine, who is responsible for conducting workplace examinations under 30 C. See Ohio Code 1514.01
  • Certified nurse practitioner: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a certified nurse practitioner in accordance with section 4723. See Ohio Code 1.64
  • Certified nurse-midwife: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a certified nurse-midwife in accordance with section 4723. See Ohio Code 1.64
  • Charitable organization: means either of the following:

    (a) Any person that is determined by the internal revenue service to be a tax exempt organization pursuant to section 501(c)(3) of the Internal Revenue Code;

    (b) Any person that is or holds itself out to be established for any benevolent, philanthropic, patriotic, educational, humane, scientific, public health, environmental conservation, civic, or other eleemosynary purpose or for the benefit of law enforcement personnel, firefighters, or other persons who protect the public safety, or any person who in any manner employs a charitable appeal as the basis of any solicitation or an appeal that suggests that there is a charitable purpose to any solicitation. See Ohio Code 1716.01

  • Charitable purpose: means either of the following:

    (a) Any purpose described in section 501(c)(3) of the Internal Revenue Code;

    (b) Any benevolent, philanthropic, patriotic, educational, humane, scientific, public health, environmental conservation, civic, or other eleemosynary objective or any objective that benefits law enforcement personnel, firefighters, or other persons who protect the public safety. See Ohio Code 1716.01

  • Charitable sales promotion: means any advertising or sale conducted by a person who represents that the purchase or use of goods or services offered by the person will benefit, in whole or in part, any charitable organization or charitable purpose. See Ohio Code 1716.01
  • Charitable trust: means a charitable remainder annuity trust as defined in section 664(d) of the Internal Revenue Code, a charitable remainder unitrust as defined in section 664(d) of the Internal Revenue Code, a charitable lead or other split interest trust subject to the governing instrument requirements of section 508(e) of the Internal Revenue Code, a pooled income fund as defined in section 642(c) of the Internal Revenue Code, a trust that is a private foundation as defined in section 509 of the Internal Revenue Code, or a trust of which each beneficiary is a charity. See Ohio Code 1111.01
  • Charity: means a state university as defined in section 3345. See Ohio Code 1111.01
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Chattel paper: means a record that evidences both a monetary obligation and a security interest in specific goods, a security interest in specific goods and software used in the goods, a security interest in specific goods and license of software used in the goods, a lease of specific goods, or a lease of specific goods and license of software used in the goods. See Ohio Code 1309.102
  • Child: includes child by adoption. See Ohio Code 1.59
  • Church: means a fellowship of believers, congregation, society, corporation, convention, or association that is formed primarily or exclusively for religious purposes and that is not formed for the private profit of any person. See Ohio Code 1710.01
  • Church property: means property that is described as being exempt from taxation under division (A)(2) of section 5709. See Ohio Code 1710.01
  • Circus: means a traveling show to which all of the following apply:

    (1) It is licensed by the United States department of agriculture under the federal animal welfare act. See Ohio Code 935.01

  • Claim: means a right to payment, whether or not the right is reduced to judgment, liquidated, unliquidated, fixed, contingent, matured, unmatured, disputed, undisputed, legal, equitable, secured, or unsecured. See Ohio Code 1336.01
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Clinical nurse specialist: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a clinical nurse specialist in accordance with section 4723. See Ohio Code 1.64
  • Closed season: means that period of time during which the taking of wild animals protected by this chapter and Chapter 1533 of the Revised Code is prohibited. See Ohio Code 1531.01
  • Coal bearing township: means a township designated as such by the chief of the division of mineral resources management under section 1561. See Ohio Code 1509.01
  • Coal bearing township: means a township designated as a coal bearing township by the chief of the division of mineral resources management as required by section 1561. See Ohio Code 1571.01
  • Coal mine: means the underground excavations of a mine that are being used or are usable or are being developed for use in connection with the extraction of coal from its natural deposit in the earth. See Ohio Code 1571.01
  • Coal mining and reclamation operations: means coal mining operations and all activities necessary and incident to the reclamation of such operations. See Ohio Code 1513.01
  • coal mining operation: means :

    (1) Activities conducted on the surface of lands in connection with a coal mine, the removal of coal from coal refuse piles, and surface impacts incident to an underground coal mine. See Ohio Code 1513.01

  • Coal research and development: means inquiry, experimentation, or demonstration to advance basic scientific or technical knowledge, or the application, adaptation, or use of existing or newly discovered scientific or technical knowledge, regarding the beneficiation of Ohio coal before combustion, conversion of Ohio coal to other fuels, the control of emissions of sulfur compounds resulting from the use of Ohio coal through the removal of sulfur compounds and other pollutants before, during, or after combustion, or other inquiry, experimentation, or commercial-scale demonstration, directed toward the utilization of Ohio coal in an environmentally acceptable manner as a fuel or chemical feedstock. See Ohio Code 1555.01
  • Coast guard approved: means bearing an approval number assigned by the United States coast guard. See Ohio Code 1546.01
  • Coastal area: means the waters of Lake Erie, the islands in the lake, and the lands under and adjacent to the lake, including transitional areas, wetlands, and beaches. See Ohio Code 1506.01
  • Coastal erosion area: means any territory included in Lake Erie coastal erosion areas identified by the director under section 1506. See Ohio Code 1506.01
  • Coastal flood hazard area: means any territory within the coastal area that has been identified as a flood hazard area under the "Flood Disaster Protection Act of 1973" 87 Stat. See Ohio Code 1506.01
  • Coastal management program: includes the establishment of objectives, policies, standards, and criteria concerning, without limitation, protection of air, water, wildlife, rare and endangered species, wetlands and natural areas, and other natural resources in the coastal area; management of coastal development and redevelopment; preservation and restoration of historic, cultural, and aesthetic coastal features; and public access to the coastal area for recreation purposes. See Ohio Code 1506.01
  • Coastal management program document: means a comprehensive statement consisting of, without limitation, text, maps, and illustrations that is adopted by the director in accordance with this chapter, describes the objectives, policies, standards, and criteria of the coastal management program for guiding public and private uses of lands and waters in the coastal area, lists the governmental agencies, including, without limitation, state agencies, involved in implementing the coastal management program, describes their applicable policies and programs, and cites the statutes and rules under which they may adopt and implement those policies and programs. See Ohio Code 1506.01
  • Collateral: means the property subject to a security interest or agricultural lien, including:

    (a) Proceeds to which a security interest attaches;

    (b) Accounts, chattel paper, payment intangibles, and promissory notes that have been sold; and

    (c) Goods that are the subject of a consignment. See Ohio Code 1309.102

  • Collective investment fund: means a fund established by a trust company or an affiliate of a trust company for the collective investment of assets held in a fiduciary capacity, either alone or with one or more cofiduciaries, by the establishing trust company and its affiliates. See Ohio Code 1111.01
  • Commercial applicator: means an individual who is licensed under section 921. See Ohio Code 921.01
  • Commercial bird shooting preserve: means an area of land where game birds are released and hunted by shooting as authorized by a commercial bird shooting preserve license obtained under section 1533. See Ohio Code 1531.01
  • Commercial co-venturer: means any person who for profit regularly and primarily is engaged in trade or commerce other than in connection with soliciting for charitable organizations or charitable purposes and who conducts a charitable sales promotion. See Ohio Code 1716.01
  • Commercial fish: means those species of fish permitted to be taken, possessed, bought, or sold unless otherwise restricted by the Revised Code or division rule and are alewife (Alosa pseudoharengus), American eel (Anguilla rostrata), bowfin (Amia calva), burbot (Lota lota), carp (Cyprinus carpio), smallmouth buffalo (Ictiobus bubalus), bigmouth buffalo (Ictiobus cyprinellus), black bullhead (Ictalurus melas), yellow bullhead (Ictalurus natalis), brown bullhead (Ictalurus nebulosus), channel catfish (Ictalurus punctatus), flathead catfish (Pylodictis olivaris), whitefish (Coregonus sp. See Ohio Code 1531.01
  • Commercial tort claim: means a claim arising in tort with respect to which:

    (a) The claimant is an organization; or

    (b) The claimant is an individual, and the claim:

    (i) Arose in the course of the claimant's business or profession; and

    (ii) Does not include damages arising out of personal injury to or the death of an individual. See Ohio Code 1309.102

  • commissioners of the sinking fund: means the board of commissioners of the sinking fund under Section 8 of Article VIII, Ohio Constitution, and section 129. See Ohio Code 1557.01
  • Commodity account: means an account maintained by a commodity intermediary in which a commodity contract is carried for a commodity customer. See Ohio Code 1309.102
  • Commodity contract: means a commodity futures contract, an option on a commodity futures contract, a commodity option, or another contract if the contract or option is:

    (a) Traded on or subject to the rules of a board of trade that has been designated as a contract market for such a contract pursuant to the federal commodities laws; or

    (b) Traded on a foreign commodity board of trade, exchange, or market and is carried on the books of a commodity intermediary for a commodity customer. See Ohio Code 1309.102

  • Commodity customer: means a person for whom a commodity intermediary carries a commodity contract on its books. See Ohio Code 1309.102
  • Commodity intermediary: means a person that:

    (a) Is registered as a futures commission merchant under the federal commodities laws; or

    (b) In the ordinary course of its business provides clearance or settlement services for a board of trade that has been designated as a contract market pursuant to the federal commodities laws. See Ohio Code 1309.102

  • common bond of association: include those persons and their families. See Ohio Code 1733.01
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Communicate: means :

    (a) To send a written or other tangible record;

    (b) To transmit a record by any means agreed upon by the persons sending and receiving the record; or

    (c) In the case of transmission of a record to or by a filing office, to transmit a record by any means prescribed by filing-office rule. See Ohio Code 1309.102

  • Community activities: means cultural, educational, governmental, recreational, residential, industrial, commercial, distribution and research activities, or any combination thereof that includes residential activities. See Ohio Code 349.01
  • Community development charge: means :

    (1) A dollar amount which shall be determined on the basis of the assessed valuation of real property or interests in real property in a new community district, the income of the residents of such property subject to such charge under section 349. See Ohio Code 349.01

  • Community facilities: means all real property, buildings, structures, or other facilities, including related fixtures, equipment, and furnishings, to be owned, operated, financed, constructed, and maintained under this chapter or in furtherance of community activities, whether within or without the new community district, including public, community, village, neighborhood, or town buildings, centers and plazas, auditoriums, day care centers, recreation halls, educational facilities, health care facilities including hospital facilities as defined in section 140. See Ohio Code 349.01
  • Community improvement corporation: means an economic development corporation or a county land reutilization corporation. See Ohio Code 1724.01
  • Compact tractors: means garden and small utility tractors and riding mowers. See Ohio Code 1353.01
  • Competent: means properly qualified as evidenced by passing the general examination and each applicable pesticide-use category examination for the pesticide-use categories in which a person applies pesticides and, in the case of a person who is a commercial applicator, conducts diagnostic inspections and by meeting any other criteria established by rule. See Ohio Code 921.01
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Composite financing arrangement: means the sale of a single issue of bonds to finance two or more projects, including, but not limited to, a single issue of bonds for a group of loans submitted by or through a single lending institution or with credit enhancement from a single lending institution, or the sale by or on behalf of one or more issuers of two or more issues or lots of bonds under or pursuant to a single sale agreement, single marketing arrangement, or single official statement, offering circular, or other marketing document. See Ohio Code 902.01
  • Composting: means the controlled decomposition of organic solid material consisting of dead animals that stabilizes the organic fraction of the material. See Ohio Code 939.01
  • Composting facility: means any premises, including structures and equipment, operating in accordance with rules adopted under section 3734. See Ohio Code 953.21
  • Concentrated animal feeding facility: means an animal feeding facility with a total design capacity equal to or more than the number of animals specified in any of the categories in division (M) of this section. See Ohio Code 903.01
  • Concentrated animal feeding operation: means an animal feeding facility that complies with one of the following:

    (1) Has a total design capacity equal to or more than the number of animals specified in any of the categories in division (M) of this section;

    (2) Satisfies the criteria in division (M), (Q), or (EE) of this section;

    (3) Is designated by the director of agriculture as a medium or small concentrated animal feeding operation pursuant to rules. See Ohio Code 903.01

  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Condensate: means liquid hydrocarbons separated at or near the well pad or along the gas production or gathering system prior to gas processing. See Ohio Code 1509.01
  • Cone of depression: means a depression or low point in the water table or potentiometric surface of a body of ground water that develops around a location from which ground water is being withdrawn. See Ohio Code 1514.01
  • Cone of depression: means a depression or low point in the water table or potentiometric surface of a body of ground water that develops around a location from which ground water is being withdrawn. See Ohio Code 1521.01
  • Confirmer: means a nominated person who undertakes, at the request or with the consent of the issuer, to honor a presentation under a letter of credit issued by another. See Ohio Code 1305.01
  • Conservancy district: means a conservancy district that is established under Chapter 6101 of the Revised Code. See Ohio Code 1506.01
  • Conservancy district: means a conservancy district established under Chapter 6101 of the Revised Code. See Ohio Code 1521.01
  • Conservation: means the wise use and management of natural resources. See Ohio Code 939.01
  • Consignee: means a merchant to whom goods are delivered in a consignment. See Ohio Code 1309.102
  • Consignment: means a transaction, regardless of its form, in which a person delivers goods to a merchant for the purpose of sale and:

    (a) The merchant:

    (i) Deals in goods of that kind under a name other than the name of the person making delivery;

    (ii) Is not an auctioneer; and

    (iii) Is not generally known by its creditors to be substantially engaged in selling the goods of others;

    (b) With respect to each delivery, the aggregate value of the goods is one thousand dollars or more at the time of delivery. See Ohio Code 1309.102

  • Consignor: means a person that delivers goods to a consignee in a consignment. See Ohio Code 1309.102
  • Constituent entity: means an entity that is party to a merger. See Ohio Code 1706.01
  • Constituent limited liability company: means a constituent entity that is a limited liability company. See Ohio Code 1706.01
  • construction: includes providing fixtures, furnishings, and equipment. See Ohio Code 351.01
  • Construction defect: means a deficiency that arises directly or indirectly out of the construction or the substantial rehabilitation of a residential building. See Ohio Code 1312.01
  • Construction equipment: means construction equipment and the attachments, special service tools, or repair parts for such equipment together with mobile, motorized utility maintenance equipment used in construction or road maintenance. See Ohio Code 1353.01
  • Consumer: includes a legal representative of the person. See Ohio Code 1355.01
  • Consumer transaction: includes consumer-goods transactions. See Ohio Code 1309.102
  • Consumer account: means an account established by an individual primarily for personal, family, or household purposes. See Ohio Code 1303.01
  • Consumer goods: means goods that are used or bought for use primarily for personal, family, or household purposes. See Ohio Code 1309.102
  • Consumer obligor: means an obligor who is an individual and who incurred the obligation as part of a transaction entered into primarily for personal, family, or household purposes. See Ohio Code 1309.102
  • Consumer transaction: means a transaction in which an individual incurs an obligation primarily for personal, family, or household purposes. See Ohio Code 1303.01
  • Consumer transaction: means a transaction in which: (a) an individual incurs an obligation primarily for personal, family, or household purposes, (b) a security interest secures the obligation, and (c) the collateral is held or acquired primarily for personal, family, or household purposes. See Ohio Code 1309.102
  • Consumer transaction: means a sale, lease, assignment, or other transfer of an item of goods, or a service, except those transactions between persons, defined in sections 4905. See Ohio Code 1317.01
  • Consumer-goods transaction: means a consumer transaction in which:

    (a) An individual incurs an obligation primarily for personal, family, or household purposes; and

    (b) A security interest in consumer goods secures the obligation. See Ohio Code 1309.102

  • Consummation date: means the date on which consummation of a Chapter 1704. See Ohio Code 1704.01
  • Consumptive use: means a use of water resources, other than a diversion, that results in a loss of that water to the basin from which it is withdrawn and includes, but is not limited to, evaporation, evapotranspiration, and incorporation of water into a product or agricultural crop. See Ohio Code 1521.01
  • Contiguous farmland: means any of the following:

    (1) Geographically contiguous property used for agriculture;

    (2) Noncontiguous property used for agriculture that is owned by one person and connected by a right-of-way that the person controls and to which the public does not have access;

    (3) Two or more pieces of property used for agriculture that would be geographically contiguous but for the fact that the property is separated by a public or private right-of-way or rights-of-way or by rivers, streams, creeks, or other bodies of water. See Ohio Code 931.01

  • Continuance: Putting off of a hearing ot trial until a later time.
  • Continuation statement: means an amendment of a financing statement that:

    (a) Identifies, by its file number, the initial financing statement to which it relates; and

    (b) Indicates that it is a continuation statement for, or that it is filed to continue the effectiveness of, the identified financing statement. See Ohio Code 1309.102

  • Contract: A legal written agreement that becomes binding when signed.
  • Contribution: means the promise, pledge, or grant of any money or property, financial assistance, or any other thing of value in response to a solicitation. See Ohio Code 1716.01
  • Contribution: means anything of value including cash, property, or services rendered, or a promissory note or other binding obligation to contribute cash or property or to perform services, that a person contributes to a limited liability company, or a series thereof, in the person's capacity as a member. See Ohio Code 1706.01
  • Control: means the power to direct or cause the direction of the management and policies of a business entity, whether through ownership of voting securities, by contract, or otherwise. See Ohio Code 1112.01
  • Control: means the power, directly or indirectly, to direct the management or policies of an entity, whether through ownership of securities, by contract, or otherwise. See Ohio Code 1322.01
  • Control bid: means the purchase of or offer to purchase any equity security of a subject company from a resident of this state if either of the following applies:

    (a) After the purchase of that security, the offeror would be directly or indirectly the beneficial owner of more than ten per cent of any class of the issued and outstanding equity securities of the issuer. See Ohio Code 1707.01

  • Convention facilities authority: means a body corporate and politic created pursuant to section 351. See Ohio Code 351.01
  • Converted entity: means the entity into which a converting entity converts pursuant to sections 1706. See Ohio Code 1706.01
  • Converting entity: means an entity that converts into a converted entity pursuant to sections 1706. See Ohio Code 1706.01
  • Converting limited liability company: means a converting entity that is a limited liability company. See Ohio Code 1706.01
  • Conveyance: means a vehicle, trailer, or compartment. See Ohio Code 953.21
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cooperative: means an association or a foreign association. See Ohio Code 1729.01
  • Corporate credit union: means a credit union, eligibility for membership in which is being a credit union qualified to do business in this state. See Ohio Code 1733.01
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Correlative rights: means the reasonable opportunity to every person entitled thereto to recover and receive the oil and gas in and under the person's tract or tracts, or the equivalent thereof, without having to drill unnecessary wells or incur other unnecessary expense. See Ohio Code 1509.01
  • Cost: means the cost of acquisition of all land, rights-of-way, property rights, easements, franchise rights, and interests required for such acquisition; the cost of demolishing or removing any buildings or structures on land so acquired, including the cost of acquiring any lands to which such buildings or structures may be moved; the cost of acquiring or constructing and equipping a principal office of the convention facilities authority; the cost of diverting highways, interchange of highways, access roads to private property, including the cost of land or easements for such access roads; the cost of public utility and common carrier relocation or duplication; the cost of all machinery, furnishings, and equipment; financing charges; interest prior to and during construction and for no more than eighteen months after completion of construction; expenses of research and development with respect to facilities; legal expenses; expenses of obtaining plans, specifications, engineering surveys, studies, and estimates of cost and revenues; working capital; expenses necessary or incident to determining the feasibility or practicability of acquiring or constructing such facility; administrative expense; and such other expenses as may be necessary or incident to the acquisition or construction of the facility, the financing of such acquisition or construction, including the amount authorized in the resolution of the convention facilities authority providing for the issuance of convention facilities authority revenue bonds to be paid into any special funds from the proceeds of such bonds, the cost of issuing the bonds, and the financing of the placing of such facility in operation. See Ohio Code 351.01
  • Costs of projects: means the costs of acquiring, constructing, reconstructing, rehabilitating, remodeling, renovating, enlarging, improving, equipping, or furnishing projects, and the financing thereof, including the cost of clearance and preparation of the site and of any land to be used in connection with projects, the cost of any indemnity and surety bonds and premiums on insurance, all related direct administrative expenses and allocable portions of direct costs of the commissioners and department of natural resources, cost of engineering and architectural services, designs, plans, specifications, surveys, and estimates of cost, legal fees, fees and expenses of trustees, depositories, and paying agents for the obligations, cost of issuance of the obligations and financing charges and fees and expenses of financial advisers and consultants in connection therewith, interest on obligations from the date thereof to the time when interest is to be covered from sources other than proceeds of obligations, amounts necessary to establish reserves as required by the bond proceedings, costs of audits, the reimbursement of all moneys advanced or applied by or borrowed from any governmental agency, whether to or by the commissioners or others, from whatever source provided, for the payment of any item or items of cost of the projects, and all other expenses necessary or incident to planning or determining feasibility or practicability with respect to projects, and such other expenses as may be necessary or incident to the acquisition, construction, reconstruction, rehabilitation, remodeling, renovation, enlargement, improvement, equipment, and furnishing of projects, the financing thereof and the placing of the same in use and operation, including any one, part of, or combination of such classes of costs and expenses. See Ohio Code 1557.01
  • council: means the technical advisory council created in the division of oil and gas resources management under section 1509. See Ohio Code 1510.01
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • County land reutilization corporation: means a corporation organized under section 1724. See Ohio Code 1724.01
  • County sales and use tax: means the tax levied by a county under division (A) of section 5739. See Ohio Code 333.01
  • court: means the court of common pleas of the county in which the principal place of business of a state bank, as set forth in its articles of incorporation, is located or of any other county determined by the superintendent of financial institutions to be appropriate under the circumstances. See Ohio Code 1125.01
  • Covered entity: means a business that accesses, maintains, communicates, or processes personal information or restricted information in or through one or more systems, networks, or services located in or outside this state. See Ohio Code 1354.01
  • Credit enhancement facilities: has the meaning given in division (A) of section 133. See Ohio Code 1557.01
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Credit Score: A number, roughly between 300 and 800, that measures an individual's credit worthiness. The most well-known type of credit score is the FICO score. This score represents the answer from a mathematical formula that assigns numerical values to various pieces of information in your credit report. Source: OCC
  • Credit union: means a corporation organized and qualified as such under this chapter. See Ohio Code 1733.01
  • Creditor: means a person who has a claim. See Ohio Code 1336.01
  • Cultivating: includes possessing or storing a plant or crop on a premises where the plant or crop was cultivated until transported to the first point of sale. See Ohio Code 928.01
  • Current net price: means the price listed in the supplier's price list or catalog in effect at the time the dealer agreement is terminated, less all applicable discounts. See Ohio Code 1353.01
  • Customer-generated energy project: means a wind, biomass, or gasification facility for the production of electricity that meets either of the following requirements:

    (1) The facility is designed to have a generating capacity of two hundred fifty kilowatts of electricity or less. See Ohio Code 1710.01

  • Dairy products: means milk, raw milk for sale to the ultimate consumer, grade A milk products, and manufactured milk products. See Ohio Code 917.01
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dangerous wild animal: means any of the following, including hybrids unless otherwise specified:

    (1) Hyenas;

    (2) Gray wolves, excluding hybrids;

    (3) Lions;

    (4) Tigers;

    (5) Jaguars;

    (6) Leopards, including clouded leopards, Sunda clouded leopards, and snow leopards;

    (7) All of the following, including hybrids with domestic cats unless otherwise specified:

    (a) Cheetahs;

    (b) Lynxes, including Canadian lynxes, Eurasian lynxes, and Iberian lynxes;

    (c) Cougars, also known as pumas or mountain lions;

    (d) Caracals;

    (e) Servals, excluding hybrids with domestic cats commonly known as savannah cats. See Ohio Code 935.01

  • Dangerously contagious or infectious disease: means any disease, including any foreign animal disease, or vector, that the director of agriculture, in the director's sound discretion, determines to be of harmful effect on the animal or poultry industry or the public health and to be capable of transmission by any means from a carrier animal to a human or to another animal. See Ohio Code 941.01
  • Data breach: means unauthorized access to and acquisition of computerized data that compromises the security or confidentiality of personal information or restricted information owned by or licensed to a covered entity and that causes, reasonably is believed to have caused, or reasonably is believed will cause a material risk of identity theft or other fraud to person or property. See Ohio Code 1354.01
  • Day: means calendar day. See Ohio Code 940.01
  • Dealer: means a person engaged in the business of the retail sale of farm machinery or construction equipment under a dealer agreement, which also may include a requirement to purchase data processing hardware. See Ohio Code 1353.01
  • Dealer: except as otherwise provided in this chapter, means every person, other than a salesperson, who engages or professes to engage, in this state, for either all or part of the person's time, directly or indirectly, either in the business of the sale of securities for the person's own account, or in the business of the purchase or sale of securities for the account of others in the reasonable expectation of receiving a commission, fee, or other remuneration as a result of engaging in the purchase and sale of securities. See Ohio Code 1707.01
  • Dealer agreement: means a written or implied contract, sales agreement, or security agreement between a supplier and a dealer that authorizes the dealer to engage in the retail sale and service of farm machinery or construction equipment in accordance with methods and procedures prescribed by the supplier and includes any data processing hardware the supplier requires the dealer to purchase to satisfy the minimum requirements of the dealer agreement. See Ohio Code 1353.01
  • Debt: means liability on a claim. See Ohio Code 1336.01
  • Debt charges: means principal, including any mandatory sinking fund or redemption requirements for retirement of obligations, interest and other accreted amounts, and any redemption premium payable on obligations. See Ohio Code 1557.01
  • Debtor: means :

    (a) A person having an interest, other than a security interest or other lien, in the collateral, whether or not the person is an obligor;

    (b) A seller of accounts, chattel paper, payment intangibles, or promissory notes; or

    (c) A consignee. See Ohio Code 1309.102

  • Debtor: means a person who is liable on a claim. See Ohio Code 1336.01
  • Decedent: A deceased person.
  • Deceptive act or practice: means knowingly misrepresenting any material fact related to the planning, conducting, or executing of any solicitation of contributions for a charitable organization or charitable purpose or to the planning, conducting, or executing of a charitable sales promotion, when the misrepresentation induces any person to make a contribution to a charitable organization, for a charitable purpose, or in response to a charitable sales promotion. See Ohio Code 1716.01
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Deer: means white-tailed deer (Oddocoileus virginianus). See Ohio Code 1531.01
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Deferred payment: means the deferral of payment to a depositor by a licensed handler for an agricultural commodity to which the licensed handler has taken title, for the purpose of deferring income of the depositor from one tax year to another. See Ohio Code 926.01
  • Defoliant: means any substance or mixture of substances intended for causing the leaves or foliage to drop from a plant, with or without causing abscission. See Ohio Code 921.01
  • Degrees: means inclination from the horizontal. See Ohio Code 1513.01
  • Delayed price agreement: means a written executory contract executed by and between a licensed handler and a depositor that covers the sale and transfer of title of an agricultural commodity and states in its written terms the service charges and the method for pricing the commodity at a later date. See Ohio Code 926.01
  • Dependent: A person dependent for support upon another.
  • Deposit account: means a demand, time, savings, passbook, or similar account maintained with a bank but does not include investment property or accounts evidenced by an instrument. See Ohio Code 1309.102
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Depositor: means :

    (1) Any person who delivers an agricultural commodity to a licensed handler for storage, conditioning, shipment, or sale;

    (2) Any owner or legal holder of a ticket or receipt issued for an agricultural commodity who is a creditor of the licensed handler for the value of the agricultural commodity;

    (3) Any licensed handler storing an agricultural commodity that the licensed handler owns solely, jointly, or in common with others in a warehouse owned or controlled by the licensed handler or any other licensed handler. See Ohio Code 926.01

  • Deputy mine inspector: means a person appointed in the division of mineral resources management to inspect mines to see that this chapter and Chapters 1563. See Ohio Code 1561.01
  • Desiccant: means any substance or mixture of substances intended for artificially accelerating the drying of plant tissue. See Ohio Code 921.01
  • designated relative: means the common ancestor of the family, whether living or deceased, who is designated in the application for a license. See Ohio Code 1112.01
  • Developer: includes a lessor that continues to own and control land for purposes of this chapter pursuant to leases with a ninety-nine-year renewable term, so long as all of the following apply:

    (1) The developer's new community district consists of at least five leases described in this section. See Ohio Code 349.01

  • Development: means any artificial change to improved or unimproved real estate, including the construction of buildings and other structures, any substantial improvement of a structure, mining, dredging, filling, grading, paving, excavating, and drilling operations, and storage of equipment or materials. See Ohio Code 1521.01
  • Device: means any instrument or contrivance, other than a firearm, that is intended for trapping, destroying, repelling, or mitigating any pest or any other form of plant or animal life, other than human beings and other than bacteria, virus, or other microorganism on or in living human beings or other living animals. See Ohio Code 921.01
  • Devise: To gift property by will.
  • Dewatering: means the withdrawal of ground water from an aquifer or saturated zone that may result in the lowering of the water level within the aquifer or saturated zone or a decline of the potentiometric surface within that aquifer or saturated zone. See Ohio Code 1514.01
  • Difference of potential: means the difference of electrical pressure existing between any two points of an electrical system, or between any point of such system and the earth, as determined by a voltmeter. See Ohio Code 1561.01
  • Direct supervision: means either of the following, as applicable:

    (1) Unless otherwise prescribed by its labeling, a pesticide is considered to be applied under the direct supervision of a commercial applicator, if it is applied by a trained serviceperson acting under the instructions and control of a commercial applicator. See Ohio Code 921.01

  • Directly supervise: means providing direct supervision under division (Q)(1) or (2) or both of those divisions of this section, as applicable. See Ohio Code 921.01
  • Director: means the director of natural resources or the director's designee. See Ohio Code 1506.01
  • Director: means each director or trustee of a corporation, each trustee of a trust, each general partner of a partnership, except a partnership association, each manager of a partnership association, and any person vested with managerial or directory power over an issuer not having a board of directors or trustees. See Ohio Code 1707.01
  • Directors: means the persons vested with the authority to conduct the affairs of the corporation irrespective of the name, such as trustees, by which they are designated. See Ohio Code 1702.01
  • Discharge: means to add from a point source to waters of the state. See Ohio Code 903.01
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Disease of concern: means any disease, including any foreign animal disease, or vector, that the director determines may have an adverse impact on the animal or poultry industry or to the public health in this state, but that is not a disease that is reportable to the United States department of agriculture. See Ohio Code 941.01
  • Disinterested shares: means voting shares beneficially owned by any person not an interested shareholder or an affiliate or associate of an interested shareholder. See Ohio Code 1704.01
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Disregarded entity: means a single member limited liability company, a qualifying subchapter S subsidiary, or another entity if the company, subsidiary, or entity is a disregarded entity for federal income tax purposes. See Ohio Code 718.01
  • Distribute: means to offer or hold for sale, sell, barter, ship, deliver for shipment, or receive and, having so received, to deliver or offer to deliver, pesticides in this state. See Ohio Code 921.01
  • Distribution: means a transfer of money or other property from a limited liability company, or a series thereof, to another person on account of a membership interest. See Ohio Code 1706.01
  • District health department inspection: means the horse meat inspection service maintained by district health departments. See Ohio Code 919.01
  • Diversion: means a withdrawal of water resources from either the Lake Erie or Ohio river drainage basin and transfer to another basin without return. See Ohio Code 1521.01
  • Docket: A log containing brief entries of court proceedings.
  • Document: means a draft or other demand, document of title, investment security, certificate, invoice, or other record, statement, or representation of fact, law, right, or opinion that is (a) presented in a written or other medium permitted by the letter of credit or, unless prohibited by the letter of credit, by the standard practice referred to in division (E) of section 1305. See Ohio Code 1305.01
  • Document: means a document of title or a receipt of the type described in division (B) of section 1307. See Ohio Code 1309.102
  • Dog broker: means a person who buys, sells, or offers to sell dogs at wholesale for resale to another or who sells or gives one or more dogs to a pet store annually. See Ohio Code 956.01
  • domestic corporation: means a nonprofit corporation formed under the laws of this state, or a business corporation formed under the laws of this state that, by amendment to its articles as provided by law, becomes a nonprofit corporation. See Ohio Code 1702.01
  • Domestic deer: means nonnative deer that have been legally acquired or their offspring and that are held in private ownership for primarily agricultural purposes. See Ohio Code 1531.01
  • Domestic use: means the withdrawal of water from a canal or canal reservoir by an individual for outdoor, nonpotable use on residential property by means of a pump or other device that generally has a discharge line with an outside diameter of not more than one and one-half inches. See Ohio Code 1520.01
  • Donee: The recipient of a gift.
  • Donor: The person who makes a gift.
  • Dower: A widow
  • Drawee: means a person ordered in a draft to make payment. See Ohio Code 1303.01
  • Drawer: means a person who signs or is identified in a draft as a person ordering payment. See Ohio Code 1303.01
  • Drilling unit: means the minimum acreage on which one well may be drilled, but does not apply to a well for injecting gas into or removing gas from a gas storage reservoir. See Ohio Code 1509.01
  • Due notice: means notice published at least twice, stating time and place, with an interval of at least thirteen days between the two publication dates, in a newspaper of general circulation within a soil and water conservation district. See Ohio Code 940.01
  • Dwelling: includes a single condominium unit, cooperative unit, mobile home, and trailer, if it is used as a residence, whether or not that structure is attached to real property. See Ohio Code 1322.01
  • Dwelling action: means any civil action in contract or tort for damages or indemnity brought against a residential contractor for damages or the loss of use of real property caused by a construction defect. See Ohio Code 1312.01
  • Economic development corporation: means a corporation organized for the purposes described in division (B)(1) of this section. See Ohio Code 1724.01
  • Education: means any activity designed to provide information regarding propane, propane equipment, mechanical and technical practices, and uses and promotion of propane to consumers and members of the propane industry. See Ohio Code 936.01
  • Electric system: means all apparatus and electric circuits receiving electric energy or that may receive electric energy from a common source. See Ohio Code 1561.01
  • Electrical inspector: means a person appointed by the chief to examine surface and underground electrical systems and equipment at mines for fire, shock, and explosion hazards. See Ohio Code 1561.01
  • Electronic: includes electrical, digital, magnetic, optical, electromagnetic, or any other form of technology that entails capabilities similar to these technologies. See Ohio Code 1546.01
  • Electronic chattel paper: means chattel paper evidenced by a record consisting of information stored in an electronic medium. See Ohio Code 1309.102
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Electronic record: means a record generated, communicated, received, or stored by electronic means for use in an information system or for transmission from one information system to another. See Ohio Code 1546.01
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Employee: means an individual who is an employee for federal income tax purposes. See Ohio Code 718.01
  • Employee: means any person who is a member of a police department or a member of a fire department. See Ohio Code 742.01
  • Employee: means any person employed by a dealer or broker to act in the dealer's or broker's behalf to buy, sell, exchange, negotiate, or solicit sale or resale of animals in the dealer's or broker's name. See Ohio Code 943.01
  • Employee: means an individual for whom a mortgage broker, mortgage lender, or mortgage servicer, in addition to providing a wage or salary, pays social security and unemployment taxes, provides workers' compensation coverage, and withholds local, state, and federal income taxes. See Ohio Code 1322.01
  • Employer: means a person that is an employer for federal income tax purposes. See Ohio Code 718.01
  • Employer: means the government entity by which an employee is employed and paid. See Ohio Code 742.01
  • Encumbrance: includes mortgages and other liens on real property. See Ohio Code 1309.102
  • Energy: means work or heat that is, or can be, produced from any fuel or source whatsoever. See Ohio Code 1551.01
  • Energy conservation: means preservation of energy resources by efficient utilization, and reduction of waste. See Ohio Code 1551.01
  • Energy efficiency improvement: means energy efficiency technologies, products, and activities that reduce or support the reduction of energy consumption, allow for the reduction in demand, or support the production of clean, renewable energy and that are or will be permanently fixed to real property. See Ohio Code 1710.01
  • Energy resource development facility: means any energy resource development, research, or conservation facility, including pilot as well as demonstration facilities, and including undivided or other interests therein, acquired or to be acquired, or constructed or to be constructed under this chapter or Chapter 6121. See Ohio Code 1551.01
  • Enrichment: means any modification in the environment of a confined dog that seeks to enhance the dog's physical and psychological well-being by providing stimuli that meets the dog's breed-specific needs. See Ohio Code 956.01
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entity: except as otherwise provided, means a foreign association, a foreign or domestic corporation other than a cooperative, or a foreign or domestic limited liability company. See Ohio Code 1729.01
  • Entity: includes a domestic or foreign entity. See Ohio Code 1745.05
  • Entity: means any of the following:

    (1) A corporation existing under the laws of this state or any other state;

    (2) A business corporation existing under the laws of this state or any other state;

    (3) Any of the following organizations existing under the laws of this state, the United States, or any other state:

    (a) A common law trust;

    (b) An unincorporated business, for profit or nonprofit organization, including a general or limited partnership or limited liability partnership;

    (c) A limited liability company;

    (d) A for profit corporation;

    (e) An unincorporated nonprofit association. See Ohio Code 1702.01

  • Entity: means any of the following:

    (1) A corporation existing under the laws of this state or any other state;

    (2) Any of the following organizations existing under the laws of this state, the United States, or any other state:

    (a) A business trust or association;

    (b) A real estate investment trust;

    (c) A common law trust;

    (d) An unincorporated business or for profit organization, including a general or limited partnership;

    (e) A limited liability company. See Ohio Code 1705.01

  • Entity: means a general partnership, limited partnership, limited liability partnership, limited liability company, association, corporation, professional corporation, professional association, nonprofit corporation, business trust, real estate investment trust, common law trust, statutory trust, cooperative association, or any similar organization that has a governing statute, in each case, whether foreign or domestic. See Ohio Code 1706.01
  • Entity: means a business organization, including a sole proprietorship. See Ohio Code 1322.01
  • Environment: includes water, air, land, and all plants and human beings and other animals living therein, and the interrelationships that exist among them. See Ohio Code 921.01
  • Equipment: means goods other than inventory, farm products, or consumer goods. See Ohio Code 1309.102
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Equity security: means any share or similar security, or any security convertible into any such security, or carrying any warrant or right to subscribe to or purchase any such security, or any such warrant or right, or any other security that, for the protection of security holders, is treated as an equity security pursuant to rules of the division of securities. See Ohio Code 1707.01
  • Erosion control structure: means a structure that is designed solely and specifically to reduce or control erosion of the shore along or near Lake Erie, including, without limitation, revetments, seawalls, bulkheads, certain breakwaters, and similar structures. See Ohio Code 1506.01
  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Established practices: means the practices used by an unincorporated nonprofit association without material change during the most recent five years of its existence or, if it has existed for less than five years, during its entire existence. See Ohio Code 1745.05
  • Establishment: includes all premises where horses or parts thereof are processed and sold, or exposed or offered for sale at retail for human food such as canneries, sausage factories, rendering, salting, curing, and smoking houses or plants, markets, and similar places. See Ohio Code 919.01
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Exchange Act: means the "Securities Exchange Act of 1934" 48 Stat. See Ohio Code 1704.01
  • Excise taxes: means any of the taxes levied pursuant to division (B) or (C) of section 351. See Ohio Code 351.01
  • executive officer: means the president, any vice-president in charge of a principal business unit, division, or function such as administration or finance, any other officer who performs a policymaking function, or any other person who performs a similar policymaking function. See Ohio Code 1112.01
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Executor: A male person named in a will to carry out the decedent
  • Exempt domestic well: means a well that meets all of the following criteria:

    (1) Is owned by the owner of the surface estate of the tract on which the well is located;

    (2) Is used primarily to provide gas for the owner's domestic use;

    (3) Is located more than two hundred feet horizontal distance from any inhabited private dwelling house other than an inhabited private dwelling house located on the tract on which the well is located;

    (4) Is located more than two hundred feet horizontal distance from any public building that may be used as a place of resort, assembly, education, entertainment, lodging, trade, manufacture, repair, storage, traffic, or occupancy by the public. See Ohio Code 1509.01

  • Exempt income: means all of the following:

    (1) The military pay or allowances of members of the armed forces of the United States or members of their reserve components, including the national guard of any state;

    (2)(a) Except as provided in division (C)(2)(b) of this section, intangible income;

    (b) A municipal corporation that taxed any type of intangible income on March 29, 1988, pursuant to Section 3 of…. See Ohio Code 718.01

  • Exercise: means activity that allows a dog to extend to full stride, play, and engage in other types of mentally stimulating and social behaviors. See Ohio Code 956.01
  • Expungement: means a court-ordered process that involves the destruction of documentation related to past arrests and convictions. See Ohio Code 1322.01
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Face: means the advancing breast of any working place. See Ohio Code 1561.01
  • facilities: means any convention, entertainment, or sports facility, or combination of them, located within the territory of the convention facilities authority, together with all hotels, parking facilities, walkways, and other auxiliary facilities, real and personal property, property rights, easements and interests that may be appropriate for, or used in connection with, the operation of the facility. See Ohio Code 351.01
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Family affiliate: means a business entity controlled by family members or affiliates. See Ohio Code 1112.01
  • Family client: means all of the following:

    (a) Any family member;

    (b) Any former family member;

    (c) Any key employee;

    (d) Any former key employee provided that, upon the end of the individual's employment by the family trust company, the individual does not receive investment advice from the family trust company, or invest additional assets with a family trust company-advised trust, foundation, or entity, other than with respect to assets advised directly or indirectly by the family trust company immediately prior to the end of the individual's employment. See Ohio Code 1112.01

  • Family member: means all of the following, provided that the designated relative is not more than ten generations removed from the youngest generation of family members:

    (a) All lineal descendants, including adopted children, stepchildren, foster children, and individuals who were a minor when another family member became a legal guardian of the individual, of the designated relative;

    (b) Such lineal descendants' spouses or spousal equivalents. See Ohio Code 1112.01

  • Family trust company: means a corporation or limited liability company organized under the laws of this state that meets all of the following requirements:

    (1)¿It is organized to serve only family clients. See Ohio Code 1112.01

  • Farm machinery: includes compact tractors, but does not include a motor vehicle as defined in section 4501. See Ohio Code 1353.01
  • Farm products: means goods, other than standing timber, with respect to which the debtor is engaged in a farming operation and that are:

    (a) Crops grown, growing, or to be grown, including:

    (i) Crops produced on trees, vines, and bushes;

    (ii) Aquatic goods produced in aquacultural operations;

    (iii) Algacultural products as defined in section 901. See Ohio Code 1309.102

  • Farming operation: means raising, cultivating, propagating, fattening, grazing, or any other farming, livestock, or aquacultural operation. See Ohio Code 1309.102
  • Federal act: means the "Federal Insecticide, Fungicide and Rodenticide Act" 61 Stat. See Ohio Code 921.01
  • Federal banking agency: means the board of governors of the federal reserve system, the comptroller of the currency, the national credit union administration, or the federal deposit insurance corporation. See Ohio Code 1322.01
  • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
  • Federal Water Pollution Control Act: means the "Federal Water Pollution Control Act Amendments of 1972" 86 Stat. See Ohio Code 903.01
  • Federally licensed grain inspector: means a person who is licensed by the United States department of agriculture under the "United States Grain Standards Act" 39 Stat. See Ohio Code 926.01
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Feed agreement: means a written contract executed by and between a licensed handler and a producer or depositor who delivers an agricultural commodity to the licensed handler for storage whereby each of the following applies:

    (1) The producer or depositor transfers title to the agricultural commodity to the licensed handler in exchange for a nominal sum;

    (2) The producer, upon delivery of the agricultural commodity to the licensed handler, becomes a creditor of the licensed handler due to the lien that arises under section 926. See Ohio Code 926.01

  • Fiduciary: A trustee, executor, or administrator.
  • Fiduciary: means a person who does any of the following:

    (1) Exercises any discretionary authority or control with respect to the management of the system, or with respect to the management or disposition of its assets;

    (2) Renders investment advice for a fee, direct or indirect, with respect to money or property of the system;

    (3) Has any discretionary authority or responsibility in the administration of the system. See Ohio Code 742.01

  • Field: means the general area underlaid by one or more pools. See Ohio Code 1509.01
  • File number: means the number assigned to an initial financing statement under division (A) of section 1309. See Ohio Code 1309.102
  • Filing office: means an office designated in section 1309. See Ohio Code 1309.102
  • Filing-office rule: means a rule adopted under section 1309. See Ohio Code 1309.102
  • Finance charge: The total cost of credit a customer must pay on a consumer loan, including interest. The Truth in Lending Act requires disclosure of the finance charge. Source: OCC
  • Finance charge: means the amount that the retail buyer pays or contracts to pay the retail seller for the privilege of paying the principal balance in installments over a period of time. See Ohio Code 1317.01
  • Financial institution regulatory authority: includes a regulator of a business activity in which a bank or trust company is engaged, or has applied to engage in, to the extent that the regulator has jurisdiction over a bank or trust company engaged in that business activity. See Ohio Code 1121.01
  • Financial product or service: means a product or service that requires licensure or other authorization under, or that includes a business model, delivery mechanism, or element that requires a license or other authorization to act as a financial institution or other person that is regulated by, Title XI or Chapter 1315. See Ohio Code 1355.01
  • Financing costs: has the meaning given in division (K) of section 133. See Ohio Code 1557.01
  • Financing statement: means a record composed of an initial financing statement and any filed record or records relating to the initial financing statement. See Ohio Code 1309.102
  • Fire boss: means a person whom the mine foreperson is required to employ under certain conditions designated in this chapter and Chapters 1563. See Ohio Code 1561.01
  • Fire department: means a fire department of the state or an instrumentality of the state or of a municipal corporation, township, joint fire district, or other political subdivision. See Ohio Code 742.01
  • First aid: means the one-time treatment or subsequent observation of scratches, cuts not requiring stitches, burns, splinters, and contusions or a diagnostic procedure, including examinations and x-rays, that does not ordinarily require medical treatment even though provided by a physician or other licensed professional personnel. See Ohio Code 993.01
  • First purchaser: means :

    (1) With regard to crude oil and condensate, the person to whom title first is transferred beyond the gathering tank or tanks, beyond the facility from which the crude oil was first produced, or both;

    (2) With regard to natural gas, the person to whom title first is transferred beyond the inlet side of the measurement station from which the natural gas was first produced. See Ohio Code 1510.01

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fish: means a cold-blooded vertebrate having fins. See Ohio Code 1531.01
  • Fishing: means taking or attempting to take fish by any method, and all other acts such as placing, setting, drawing, or using any device commonly used to take fish whether resulting in a taking or not. See Ohio Code 1531.01
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Fixture filing: includes the filing of a financing statement covering goods of a transmitting utility that are or are to become fixtures. See Ohio Code 1309.102
  • Fixtures: means goods that have become so related to particular real property that an interest in them arises under real property law. See Ohio Code 1309.102
  • Floodplain: means the area adjoining any river, stream, watercourse, or lake that has been or may be covered by flood water. See Ohio Code 1521.01
  • Floodplain management: means the implementation of an overall program of corrective and preventive measures for reducing flood damage, including the collection and dissemination of flood information, construction of flood control works, nonstructural flood damage reduction techniques, and adoption of rules, ordinances, or resolutions governing development in floodplains. See Ohio Code 1521.01
  • Forbearance: A means of handling a delinquent loan. A
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Foreign animal disease: means a contagious or infectious disease that is not present in United States domestic or nondomestic species populations and is listed by the United States department of agriculture as a "foreign animal disease. See Ohio Code 941.01
  • Foreign association: means a corporation organized under the cooperative laws of another state or the District of Columbia or a foreign corporation organized under corporation laws of another state, the District of Columbia, or the United States that operates on a cooperative basis. See Ohio Code 1729.01
  • Foreign bank: includes , without limitation, a foreign commercial bank, foreign merchant bank, or other foreign institution that engages in banking activities usually conducted in connection with the business of banking in the country that granted its charter or countries where the foreign institution is operating. See Ohio Code 1119.01
  • Foreign corporation: means a nonprofit corporation formed under the laws of another state. See Ohio Code 1702.01
  • Foreign credit union: means a credit union formed under the laws of another state which are substantially similar to this chapter. See Ohio Code 1733.01
  • Foreign limited liability company: means an entity that is all of the following:

    (1) An unincorporated association;

    (2) Organized under the laws of a state other than this state or under the laws of a foreign country;

    (3) Organized under a statute pursuant to which an association may be formed that affords to each of its members limited liability with respect to the liabilities of the entity;

    (4) Not required to be registered, qualified, or organized under any statute of this state other than this chapter. See Ohio Code 1706.01

  • Foreperson: means the person designated to assist the mine foreperson in the immediate supervision of a portion or the whole of a mine or of the persons employed therein. See Ohio Code 1561.01
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Former family member: means a spouse, spousal equivalent, or stepchild who was a family member but is no longer a family member due to a divorce or other similar event. See Ohio Code 1112.01
  • Fraud: Intentional deception resulting in injury to another.
  • Frozen desserts: means frozen desserts, including the mixes, described in 21 C. See Ohio Code 917.01
  • Fuel: means petroleum, crude oil, petroleum product, coal, natural gas, synthetic natural or artificial gas, nuclear, or other substance used primarily for its energy content. See Ohio Code 1551.01
  • Full-time equivalent positions: means the total number of hours worked at a facility in a work week, divided by forty hours per week. See Ohio Code 333.01
  • Fund-raising counsel: means any person who, for compensation, plans, manages, advises, consults, or prepares material for or with respect to the solicitation in this state of contributions for any charitable organization or at any time has custody of contributions from a solicitation, but does not solicit contributions and does not employ, procure, or otherwise engage any compensated person to solicit contributions. See Ohio Code 1716.01
  • funds: means , except where the context does not permit, the bond service fund, and any other funds, including reserve funds, created under the bond proceedings and stated to be special funds in those proceedings, including all moneys and investments, and earnings from investments, credited and to be credited to the particular fund. See Ohio Code 1557.01
  • Fungus: means any nonchlorophyll-bearing thallophyte, which is any nonchlorophyll-bearing plant of a lower order than mosses and liverworts, as for example, rust, smut, mildew, mold, yeast, and bacteria, except those on or in living human beings or other animals, or processed food, beverages, or pharmaceuticals. See Ohio Code 921.01
  • Fur-bearing animals: includes minks, weasels, raccoons, skunks, opossums, muskrats, fox, beavers, badgers, otters, coyotes, and bobcats. See Ohio Code 1531.01
  • Game: includes game birds, game quadrupeds, and fur-bearing animals. See Ohio Code 1531.01
  • Game birds: includes mourning doves, ringneck pheasants, bobwhite quail, ruffed grouse, sharp-tailed grouse, pinnated grouse, wild turkey, Hungarian partridge, Chukar partridge, woodcocks, black-breasted plover, golden plover, Wilson's snipe or jacksnipe, greater and lesser yellowlegs, rail, coots, gallinules, duck, geese, brant, and crows. See Ohio Code 1531.01
  • Game quadrupeds: includes cottontail rabbits, gray squirrels, black squirrels, fox squirrels, red squirrels, flying squirrels, chipmunks, groundhogs or woodchucks, white-tailed deer, wild boar, elk, and black bears. See Ohio Code 1531.01
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Gas: means all natural gas and all other fluid hydrocarbons that are not oil, including condensate. See Ohio Code 1509.01
  • Gas: means an inflammable gas, chiefly methane, that when mixed in certain proportions with air is explosive. See Ohio Code 1561.01
  • Gas: means any natural, manufactured, or by-product gas or any mixture thereof. See Ohio Code 1571.01
  • Gas storage reservoir: means a continuous area of a subterranean porous sand or rock stratum or strata into which gas is or may be injected for the purpose of storing it therein and removing it therefrom and includes a gas storage reservoir as defined in section 1571. See Ohio Code 1509.01
  • Gas storage well inspector: means the gas storage well inspector in the division. See Ohio Code 1571.01
  • General intangible: includes payment intangibles and software. See Ohio Code 1309.102
  • General permit: has the meaning that is established in rules. See Ohio Code 903.01
  • General use pesticide: means a pesticide that is classified for general use under the federal act. See Ohio Code 921.01
  • Generic form: means an electronic or paper form that is not prescribed by a particular municipal corporation and that is designed for reporting taxes withheld by an employer, agent of an employer, or other payer, estimated municipal income taxes, or annual municipal income tax liability or for filing a refund claim. See Ohio Code 718.01
  • Geographic area: means any county or counties within this state or parts thereof as may be designated by the director. See Ohio Code 941.01
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Good faith: means honesty in fact in the conduct or transaction concerned. See Ohio Code 1305.01
  • Goods: includes (i) fixtures, (ii) standing timber that is to be cut and removed under a conveyance or contract for sale, (iii) the unborn young of animals, (iv) crops grown, growing, or to be grown, even if the crops are produced on trees, vines, or bushes, and (v) manufactured homes. See Ohio Code 1309.102
  • Goods: means all things, including specially manufactured goods but not including the money in which the price is to be paid or things in action, that satisfy both of the following:

    (a) They are movable at the time of identification for sale or identification to the contract for sale;

    (b) They are purchased primarily for personal, family, or household purposes. See Ohio Code 1317.01

  • Governing principles: means all agreements, whether oral, in a record, or implied from its established practices, or any combination of them, that govern the purpose or operation of an unincorporated nonprofit association and the rights and obligations of its members and managers. See Ohio Code 1745.05
  • Governing statute: means the law that governs an entity's internal affairs. See Ohio Code 1706.01
  • government: includes a country, state, county, or other political subdivision, agency, or instrumentality. See Ohio Code 1706.01
  • Governmental agency: means the United States government or any department, agency, or instrumentality thereof; any department, agency, or instrumentality of a state government; any municipal corporation, county, township, board of education, or other political subdivision or any other body corporate and politic of a state; or any agency, commission, or authority established under an interstate compact or agreement. See Ohio Code 1551.01
  • Governmental agency: means a department, division, or other unit of the state government or of a municipal corporation, county, township, or other political subdivision of the state; any state university or college, as defined in section 3345. See Ohio Code 351.01
  • Governmental unit: includes an organization having a separate corporate existence if the organization is eligible to issue debt on which interest is exempt from income taxation under the laws of the United States. See Ohio Code 1309.102
  • Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Grantor: The person who establishes a trust and places property into it.
  • Ground equipment: means any device, other than aircraft, used on land or water to apply pesticides in any form. See Ohio Code 921.01
  • Ground water: means all water occurring in an aquifer. See Ohio Code 1514.01
  • Ground water: means all water occurring in an aquifer. See Ohio Code 1521.01
  • Ground water stress area: means a definable geographic area in which ground water quantity is being affected by human activity or natural forces to the extent that continuous availability of supply is jeopardized by withdrawals. See Ohio Code 1521.01
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Handler: means a person who acquires agricultural products under a sales contract for the purpose of processing or reselling agricultural products. See Ohio Code 1729.01
  • handler: means any person who is engaged in the business of agricultural commodity handling. See Ohio Code 926.01
  • handling: means any of the following:

    (1) Engaging in or participating in the business of purchasing from producers agricultural commodities for any use in excess of thirty thousand bushels annually;

    (2) Operating a warehouse as a bailee for the receiving, storing, shipping, or conditioning of an agricultural commodity;

    (3) Receiving into a warehouse an agricultural commodity purchased under a delayed price agreement;

    (4) Providing marketing functions, including storage, delayed price marketing, deferred payment, feed agreements, or any other marketing transaction whereby control is exerted over the monetary proceeds of a producer's agricultural commodities by a person other than the producer. See Ohio Code 926.01

  • Health benefit plan: means any hospital or medical expense policy of insurance or a health care plan provided by an insurer, including a health insuring corporation plan, provided by or through an insurer, or any combination thereof. See Ohio Code 1731.01
  • Health district: means a city or general health district created by or under the authority of Chapter 3709. See Ohio Code 935.01
  • Health-care-insurance receivable: means an interest in or claim under a policy of insurance that is a right to payment of a monetary obligation for health-care goods or services provided. See Ohio Code 1309.102
  • Hearsay: Statements by a witness who did not see or hear the incident in question but heard about it from someone else. Hearsay is usually not admissible as evidence in court.
  • Hemp: means the plant Cannabis sativa L. See Ohio Code 928.01
  • Hemp cultivation license: means a license to cultivate hemp issued under section 928. See Ohio Code 928.01
  • Hemp processing license: means a license to process hemp issued under section 928. See Ohio Code 928.01
  • Hemp product: includes cosmetics, personal care products, dietary supplements or food intended for animal or human consumption, cloth, cordage, fiber, fuel, paint, paper, particleboard, and any other product containing one or more cannabinoids derived from hemp, including cannabidiol. See Ohio Code 928.01
  • High volume breeder: means an establishment that keeps, houses, and maintains six or more breeding dogs and does at least one of the following:

    (1) In return for a fee or other consideration, sells five or more adult dogs or puppies in any calendar year to dog brokers or pet stores;

    (2) In return for a fee or other consideration, sells forty or more puppies in any calendar year to the public; or

    (3) Keeps, houses, and maintains, at any given time in a calendar year, more than forty puppies that are under four months of age, that have been bred on the premises of the establishment, and that have been primarily kept, housed, and maintained from birth on the premises of the establishment. See Ohio Code 956.01

  • Holder of the retail installment contract: means any person to which the money owed by the retail buyer on the retail installment contract has been paid. See Ohio Code 1317.01
  • Horizontal well: means a well that is drilled for the production of oil or gas in which the wellbore reaches a horizontal or near horizontal position in the Point Pleasant, Utica, or Marcellus formation and the well is stimulated. See Ohio Code 1509.01
  • Horse: means an animal of the equine family. See Ohio Code 919.01
  • Horse meat: means the meat of a horse. See Ohio Code 919.01
  • Horse meat food product: means any article intended for human food that is derived in whole or in part from horse meat. See Ohio Code 919.01
  • Humane society: means an organization that is organized under section 1717. See Ohio Code 935.01
  • Humane society: means an organization that is organized under section 1717. See Ohio Code 956.01
  • Hunting: includes every attempt to kill or wound and every act of assistance to any other person in killing or wounding or attempting to kill or wound wild birds or wild quadrupeds. See Ohio Code 1531.01
  • Hydrologic study area: means the area within a four-mile radius from the boundary of the withdrawal area. See Ohio Code 1521.01
  • Imitation: means imitation as described in 21 C. See Ohio Code 917.01
  • Immediate family: means a person's spouse residing in the person's household, brothers and sisters of the whole or of the half blood, children, including adopted children, parents, and grandparents. See Ohio Code 921.01
  • Immediate family: means an individual's spouse, child, stepchild, parent, stepparent, grandparent, grandchild, brother, sister, parent-in-law, brother-in-law, or sister-in-law. See Ohio Code 1322.01
  • Impact facility: means a permanent structure, including all interior or exterior square footage used for educational or exhibition activities, that meets all of the following criteria:

    (1) It is used for the sale of tangible personal property or services;

    (2) At least ten per cent of the facility's total square footage is dedicated to educational or exhibition activities;

    (3) At least thirty million dollars is invested in land, buildings, infrastructure, and equipment for the facility at the site of the facility over a period of not more than two years;

    (4) An annualized average of at least one hundred fifty new full-time equivalent positions will be created and maintained at the facility;

    (5) More than fifty per cent of the visitors to the facility are reasonably anticipated to live at least fifty miles from the facility. See Ohio Code 333.01

  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • Impoundment: means the reservoir created by a dam or other artificial barrier across a watercourse that causes water to be stored deeper than and generally beyond the banks of the natural channel of the watercourse during periods of normal flow, but does not include water stored behind rock piles, rock riffle dams, and low channel dams where the depth of water is less than ten feet above the channel bottom and is essentially confined within the banks of the natural channel during periods of normal stream flow. See Ohio Code 1546.01
  • imprisonment: means being imprisoned under a sentence imposed for an offense or serving a term of imprisonment, prison term, jail term, term of local incarceration, or other term under a sentence imposed for an offense in an institution under the control of the department of rehabilitation and correction, a county, multicounty, municipal, municipal-county, or multicounty-municipal jail or workhouse, a minimum security jail, a community-based correctional facility, or another facility described or referred to in section 2929. See Ohio Code 1.05
  • in writing: includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures. See Ohio Code 1.59
  • in-stream mining operation: means all of the premises, facilities, and equipment used in the process of removing minerals by in-stream mining from a mining area. See Ohio Code 1514.01
  • In-stream mining: means all or any part of a process followed in the production of minerals from the bottom of the channel of a watercourse that drains a surface area of more than one hundred square miles. See Ohio Code 1514.01
  • Inactivate: means to shut off temporarily all flow of gas from a well at a point below the horizon of the coal mine that might be affected by such flow of gas, by means of a plug or other suitable device or by injecting water, bentonite, or some other equally nonporous material into the well, or any other method approved by an oil and gas resources inspector. See Ohio Code 1571.01
  • incidentally use: means the application of a general use pesticide on an occasional, isolated, site-specific basis in order to avoid immediate personal harm. See Ohio Code 921.01
  • Include: when used in a definition, does not exclude other things or persons otherwise within the meaning of the term defined. See Ohio Code 1707.01
  • Income: means the following:

    (1)(a) For residents, all income, salaries, qualifying wages, commissions, and other compensation from whatever source earned or received by the resident, including the resident's distributive share of the net profit of pass-through entities owned directly or indirectly by the resident and any net profit of the resident, except as provided in division (D)(5) of this section. See Ohio Code 718.01

  • Income source: means any and all sources of income to the community authority, including community development charges of which the new community authority is the beneficiary as provided in section 349. See Ohio Code 349.01
  • Incorporator: means any incorporator of a corporation and any organizer of, or any person participating, other than in a representative or professional capacity, in the organization of an unincorporated issuer. See Ohio Code 1707.01
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Independent contractor: means an individual who performs duties for another person and is not subject to that person's supervision or control. See Ohio Code 1322.01
  • Independent producer: means a producer that is not engaged in refining either oil or natural gas. See Ohio Code 1510.01
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Individual: means a natural person. See Ohio Code 1322.01
  • Individual permit: has the meaning that is established in rules. See Ohio Code 903.01
  • Inflatable watercraft: means any vessel constructed of rubber, canvas, or other material that is designed to be inflated with any gaseous substance, constructed with two or more air cells, and operated as a vessel. See Ohio Code 1546.01
  • Ingredient statement: means a statement of the name and percentage of each active ingredient, together with the total percentage of inert ingredients. See Ohio Code 921.01
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Insect: means any of the numerous small invertebrate animals generally having the body more or less obviously segmented, for the most part belonging to the class insecta, including, but not limited to, beetles, bugs, bees, and flies, and to other allied classes of arthropods, including, but not limited to, spiders, mites, ticks, centipedes, and wood lice. See Ohio Code 921.01
  • Insider: includes all of the following:

    (1) If the debtor is an individual, any of the following:

    (a) A relative of the debtor or of a general partner of the debtor;

    (b) A partnership in which the debtor is a general partner;

    (c) A general partner in a partnership described in division (G)(1)(b) of this section;

    (d) A corporation of which the debtor is a director, officer, or person in control. See Ohio Code 1336.01

  • Insolvent: means that the corporation is unable to pay its obligations as they become due in the usual course of its affairs. See Ohio Code 1702.01
  • Inspection: means the examination, checking, or testing necessary to determine the wholesomeness, sanitary conditions, adulteration, misbranding, quality, and purity of horse meat products or the sanitary condition of horse meat processing establishments. See Ohio Code 919.01
  • Inspection: includes a reinspection. See Ohio Code 993.01
  • Installation permit: means a permit for the installation or modification of a disposal system or any part of a disposal system issued by the director of environmental protection under division (J)(1) of section 6111. See Ohio Code 903.01
  • Institutional investor: means any of the following, whether acting for itself or for others in a fiduciary capacity:

    (1) A bank or international banking institution;

    (2) An insurance company;

    (3) A separate account of an insurance company;

    (4) An investment company as defined in the "Investment Company Act of 1940" 15 U. See Ohio Code 1707.01

  • Instrument: includes any will, declaration of trust, agreement of trust, agency, or custodianship, or court order creating a fiduciary relationship. See Ohio Code 1111.01
  • Instrument: means a negotiable instrument or any other writing that evidences a right to the payment of a monetary obligation, is not itself a security agreement or lease, and is of a type that in ordinary course of business is transferred by delivery with any necessary indorsement or assignment. See Ohio Code 1309.102
  • Insurer: means an insurance company authorized to do the business of sickness and accident insurance in this state or, for the purposes of this chapter, a health insuring corporation authorized to issue health care plans in this state. See Ohio Code 1731.01
  • Intangible income: means income of any of the following types: income yield, interest, capital gains, dividends, or other income arising from the ownership, sale, exchange, or other disposition of intangible property including, but not limited to, investments, deposits, money, or credits as those terms are defined in Chapter 5701 of the Revised Code, and patents, copyrights, trademarks, tradenames, investments in real estate investment trusts, investments in regulated investment companies, and appreciation on deferred compensation. See Ohio Code 718.01
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Integrated pest management: means a sustainable approach to managing pests by combining biological, cultural, physical, and chemical tools in a way that minimizes economic, health, and environmental risks. See Ohio Code 921.01
  • Inter vivos: Transfer of property from one living person to another living person.
  • interest equivalent: has the meaning given in division (R) of section 133. See Ohio Code 1557.01
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Internal Revenue Code: means the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 1716.01
  • Internal Revenue Code: means the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 1111.01
  • Internal Revenue Code: means the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 1745.05
  • Internet: means the international computer network of both federal and nonfederal interoperable packet switched data networks, including the graphical subnetwork known as the world wide web. See Ohio Code 1.59
  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Intestate: Dying without leaving a will.
  • Intoxicating liquor: includes all liquids and compounds that contain more than three and two-tenths per cent of alcohol by weight and are fit for use for beverage purposes. See Ohio Code 1707.01
  • Inventory: means farm machinery or construction equipment held by a dealer for sale or lease and also means any data processing hardware that the supplier requires the dealer to purchase. See Ohio Code 1353.01
  • Inventory: means goods, other than farm products, that:

    (a) Are leased by a person as lessor;

    (b) Are held by a person for sale or lease or to be furnished under a contract of service;

    (c) Are furnished by a person under a contract of service; or

    (d) Consist of raw materials, work in process, or materials used or consumed in a business. See Ohio Code 1309.102

  • Investment adviser: means any person who, for compensation, engages in the business of advising others, either directly or through publications or writings, as to the value of securities or as to the advisability of investing in, purchasing, or selling securities, or who, for compensation and as a part of regular business, issues or promulgates analyses or reports concerning securities. See Ohio Code 1707.01
  • Investment adviser representative: means a supervised person of an investment adviser, provided that the supervised person has more than five clients who are natural persons other than excepted persons defined in division (EE) of this section, and that more than ten per cent of the supervised person's clients are natural persons other than excepted persons defined in division (EE) of this section. See Ohio Code 1707.01
  • Investment company: means any investment company as defined in section 3 and registered under section 8 of the "Investment Company Act of 1940" 54 Stat. See Ohio Code 1111.01
  • Investment property: means a security, whether certificated or uncertificated, a security entitlement, a securities account, a commodity contract, or a commodity account. See Ohio Code 1309.102
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Island: means a rock or land elevation above the waters of Lake Erie having an area of five or more acres above water. See Ohio Code 1531.01
  • Issue: means the first delivery of an instrument by the maker or drawer to a holder or nonholder for the purpose of giving rights of the instrument to any person. See Ohio Code 1303.01
  • Issuer: means a maker or drawer of an issued or unissued instrument. See Ohio Code 1303.01
  • Issuer: means a bank or other person that issues a letter of credit, but does not include an individual who makes an engagement for personal, family, or household purposes. See Ohio Code 1305.01
  • Issuer: means the state, or any county or municipal corporation of the state. See Ohio Code 902.01
  • Issuer: means every person who has issued, proposes to issue, or issues any security. See Ohio Code 1707.01
  • Issuing authority: means in the case of a municipal corporation, the legislative authority thereof; and in the case of a county, the board of county commissioners or whatever officers, board, commission, council, or other body might succeed to or assume the legislative powers of the board of county commissioners. See Ohio Code 902.01
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Juror: A person who is on the jury.
  • Kayak: means a paddlecraft that is typically pointed at both ends and is propelled by human muscular effort by one or more seated individuals who use a double-bladed paddle, including an open kayak with an open deck for operator seating, an enclosed kayak designed to enclose an occupant within a cockpit, a tandem kayak designed for multiple occupants, and a racing kayak. See Ohio Code 1546.01
  • kennel: means an establishment that keeps, houses, and maintains adult dogs, as defined in section 956. See Ohio Code 955.02
  • Key employee: means all of the following:

    (1) Any natural person who is an executive officer, director, trustee, or general partner of, or a person serving in a similar capacity to, the family trust company. See Ohio Code 1112.01

  • Label: means the written, printed, or graphic matter on, or attached to the pesticide or device, or any of its containers or wrappers. See Ohio Code 921.01
  • Labeling: means all labels and other written, printed, or graphic matter:

    (1) Accompanying the pesticide product or device at any time;

    (2) To which reference is made on the label or in literature accompanying the pesticide product or device, except when accurate, nonmisleading reference is made to current official publications of the United States environmental protection agency, the United States department of agriculture or interior, the United States department of health and human services, state experiment stations, state agricultural colleges, or other similar federal or state institutions or official agencies, authorized by law to conduct research in the field of pesticides;

    (3) Including all brochures, technical and sales bulletins, and all advertising material. See Ohio Code 921.01

  • Land acquisition: means the acquisition of real property and interests in real property as part of a new community development program. See Ohio Code 349.01
  • Land development: means the process of clearing and grading land, making, installing, or constructing water distribution systems, sewers, sewage collection systems, steam, gas, and electric lines, roads, streets, curbs, gutters, sidewalks, storm drainage facilities, and other installations or work, whether within or without the new community district, and the construction of community facilities. See Ohio Code 349.01
  • Land use infraction: means a violation of any municipal zoning code provisions that regulate parking on private property, a motor vehicle service or repair business in residential districts, or signage and other graphics displays, and any municipal ordinance, resolution, or other regulation dealing with the display of house numbers on buildings. See Ohio Code 765.01
  • Lands eligible for remining: means those lands that otherwise would be eligible for expenditures under division (C)(1) of section 1513. See Ohio Code 1513.01
  • Law enforcement officer: means a sheriff, deputy sheriff, constable, police officer of a township or joint police district, marshal, deputy marshal, municipal police officer, or state highway patrol trooper. See Ohio Code 935.01
  • Law enforcement officer: means a law enforcement officer as defined in section 2901. See Ohio Code 765.01
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Layaway arrangement: means a contract for sale at retail, other than one involving the sale of a motor vehicle by a dealer, in which the buyer agrees to buy and the seller agrees to sell specific goods at a future time and both of the following apply:

    (a) Until such future time, the seller agrees to retain possession of but remove the specific goods from its retail inventory and not offer the specific goods for sale to other persons or promises the availability thereof at the agreed time of delivery;

    (b) The buyer agrees to pay the seller the layaway price, in whole or in part, by deposit, down payment, part payment, periodically or in installments or otherwise prior to delivery of the specific goods. See Ohio Code 1317.01

  • Layaway price: means the price at which the specific goods that are the subject of a layaway arrangement are offered for sale at retail by the seller if such sale were a sale for cash to be paid in full upon delivery on the date the layaway arrangement was entered into instead of pursuant to a layaway arrangement. See Ohio Code 1317.01
  • Lead county: means the county in which the majority of the initial length of a proposed improvement would be located, as set forth in a petition, when the proposed improvement would be located in two or more counties. See Ohio Code 940.01
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Lease-purchase agreement: means an agreement for the use of personal property by an individual primarily for personal, family, or household purposes for an initial period of four months or less that is automatically renewable with each lease payment after the initial period and that permits the lessee to acquire ownership of the property. See Ohio Code 1351.01
  • Legacy: A gift of property made by will.
  • Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
  • Legatee: A beneficiary of a decedent
  • Legislative authority of a participating political subdivision: means , with reference to a township, the board of township trustees. See Ohio Code 1710.01
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • Lending institution: means a bank that has its principal place of business located in this state, a bank subsidiary corporation that is wholly owned by a bank having its principal place of business located in this state, any state or federal governmental agency or instrumentality including without limitation the federal land bank, production credit association, or bank for cooperatives, or any of their local associations, or any other financial institution or entity authorized to make mortgage loans and qualified to do business in this state. See Ohio Code 902.01
  • Lessee: means an individual who leases personal property pursuant to a lease-purchase agreement. See Ohio Code 1351.01
  • Lessor: means a person who, in the ordinary course of business, regularly offers to lease or arranges for personal property to be leased pursuant to a lease-purchase agreement. See Ohio Code 1351.01
  • Letter of credit: means a definite undertaking that satisfies the requirements of section 1305. See Ohio Code 1305.01
  • Letter-of-credit right: means a right to payment or performance under a letter of credit, whether or not the beneficiary has demanded or is at the time entitled to demand payment or performance. See Ohio Code 1309.102
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a license issued under section 917. See Ohio Code 917.01
  • Licensed dealer: means a dealer licensed under this chapter. See Ohio Code 1707.01
  • Licensed family trust company: means a family trust company licensed under this chapter. See Ohio Code 1112.01
  • Licensed salesperson: means a salesperson licensed under this chapter. See Ohio Code 1707.01
  • Licensee: means any person who is licensed in accordance with this chapter. See Ohio Code 953.21
  • Licensee: means any individual who has been issued a mortgage loan originator license under this chapter. See Ohio Code 1322.01
  • Licensure: includes certification as used in the federal act. See Ohio Code 921.01
  • Lien: means a charge against or an interest in property to secure payment of a debt or performance of an obligation, and includes a security interest created by agreement, a judicial lien obtained by legal or equitable process or proceedings, a common law lien, or a statutory lien. See Ohio Code 1336.01
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Lien creditor: means :

    (a) A creditor who has acquired a lien on the property involved by attachment, levy or the like;

    (b) An assignee for benefit of creditors from the time of assignment;

    (c) A trustee in bankruptcy from the date of the filing of the petition; or

    (d) A receiver in equity from the time of appointment. See Ohio Code 1309.102

  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Life settlement contract: includes a viatical settlement contract as defined in section 3916. See Ohio Code 1707.01
  • lifeboat: means a watercraft that is held aboard another vessel and used exclusively for emergency purposes. See Ohio Code 1548.01
  • Limited liability company: means a limited liability company formed under Chapter 1705. See Ohio Code 718.01
  • Lineal descendant: Direct descendant of the same ancestors.
  • Linear feet: when used to indicate distance between two points that are not in the same plane, means the length in feet of the shortest horizontal line that connects two lines projected vertically upward or downward from the two points. See Ohio Code 1571.01
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • livestock: means either of the following:

    (A) Equine animals regardless of the purpose for which they are raised;

    (B) Any of the following animals that are raised for human food products or fiber:

    (1) Porcine animals;

    (2) Bovine animals;

    (3) Caprine animals;

    (4) Ovine animals;

    (5) Poultry;

    (6) Alpacas;

    (7) Llamas;

    (8) Any other animal designated in rules adopted under section 904. See Ohio Code 904.01

  • livestock: means horses, mules, and other equidae, cattle, sheep, and goats and other bovidae, swine and other suidae, poultry, alpacas, llamas, and monitored captive deer, captive deer with status, or captive deer with certified chronic wasting disease status. See Ohio Code 943.01
  • Livestock: means cattle, sheep, goats, and other animals of the family bovidae, swine and other animals of the family suidae, horses, mules, burros, asses, and other animals of the family equidae, alpacas, and llamas. See Ohio Code 947.01
  • Livestock: means horses, mules, asses, hogs, sheep, goats, cattle, and any other animal that is raised or maintained domestically for food, fiber, or hunting purposes. See Ohio Code 971.01
  • Loading platform: means any place operated by a licensee for loading dead animals, or parts thereof, onto trucks to take them to a rendering plant or composting facility. See Ohio Code 953.21
  • Loan: includes a loan made to or through, or a deposit with, a lending institution or a loan made directly to the owner or operator of a project to finance one or more projects. See Ohio Code 902.01
  • Loan processor or underwriter: means an individual who, with respect to the origination of a residential mortgage loan, performs any of the following activities at the direction or subject to the supervision of a licensed mortgage loan originator or registered mortgage loan originator:

    (1) Receiving, collecting, distributing, or analyzing information common for the processing or underwriting of a residential mortgage loan;

    (2) Communicating with a borrower to obtain the information necessary for the processing or underwriting of a loan, to the extent the communication does not include offering or negotiating loan rates or terms or counseling borrowers about residential mortgage loan rates or terms. See Ohio Code 1322.01

  • Local agency: means any municipal corporation, school district, special purpose district, or township of the state or any elected officer or board, bureau, commission, department, division, institution, or instrumentality of a county. See Ohio Code 1347.01
  • Local government entities: means any county, municipal corporation, township, metropolitan or township park district, soil and water conservation district, conservancy district, or joint recreation district. See Ohio Code 1557.01
  • Longwall mining: means a system of mining designed for full pillar extraction that minimizes the possibility of outburst or squeezes and allows total caving of the main roof in the pillar area. See Ohio Code 1561.01
  • Longwall working face: means a working face in a coal mine in which work extracting coal from its natural deposit in the earth is performed during a mining cycle by longwall mining. See Ohio Code 1561.01
  • Maintains: means state or local agency ownership of, control over, responsibility for, or accountability for systems and includes, but is not limited to, state or local agency depositing of information with a data processing center for storage, processing, or dissemination. See Ohio Code 1347.01
  • Maintenance: means the preservation and upkeep of an amusement ride for the purpose of maintaining its designed operational capability. See Ohio Code 993.01
  • Major concentrated animal feeding facility: means a concentrated animal feeding facility with a total design capacity of more than ten times the number of animals specified in any of the categories in division (M) of this section. See Ohio Code 903.01
  • Maker: means a person who signs or is identified in a note as a person undertaking to pay. See Ohio Code 1303.01
  • Manager: means a person, irrespective of the person's designation as director or other designation, that is responsible, alone or in concert with others, for the management of an unincorporated nonprofit association as stated in division (E) of section 1745. See Ohio Code 1745.05
  • Manager: means any person designated by the limited liability company or its members with the authority to manage all or part of the activities or affairs of the limited liability company on behalf of the limited liability company, which person has agreed to serve in such capacity, whether such person is designated as a manager, director, officer, or otherwise. See Ohio Code 1706.01
  • Manufacture milk: means milk produced by a person holding a valid producer license of the manufacture milk category issued pursuant to section 917. See Ohio Code 917.01
  • Manufacture milk plant: means a place, including a governmental operation, where manufacture milk or a manufactured milk product is collected, handled, controlled, manufactured, processed, stored, pasteurized, ultra-pasteurized, repasteurized, commercially sterilized, aseptically processed, bottled, or prepared for distribution, but does not include a place where a manufactured milk product is purchased in packaged form and is stored and handled for the sole purpose of sale to the ultimate consumer. See Ohio Code 917.01
  • Manufacture milk processor: means any person who operates or controls a manufacture milk plant, transfer station, receiving station, or milk transport cleaning facility that is located in this state or from which manufacture milk or manufactured milk products are sold or offered for sale for human consumption, as applicable. See Ohio Code 917.01
  • Manufacture milk producer: means a person located in this state who sells or offers for sale manufacture milk obtained from a cow, goat, sheep, or other animal that the person owns or controls. See Ohio Code 917.01
  • Manufactured home: includes any structure that meets all of the requirements of this paragraph except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the United States secretary of housing and urban development and complies with the standards established under Title 42 of the United States Code. See Ohio Code 1309.102
  • Manufactured milk products: means all products, other than raw milk for sale to the ultimate consumer and grade A milk products, that are derived from milk and are for human consumption, including:

    (1) Butter;

    (2) Natural or processed cheese;

    (3) Evaporated, condensed, and dry products;

    (4) Frozen desserts;

    (5) Such other products derived from milk as the director may specify by rule that have the standard of identity, quality, strength, purity, grade, and, if added, permitted optional ingredients found in the standards of identity established for the product in rules adopted by the director under section 917. See Ohio Code 917.01

  • Manufactured-home transaction: means a secured transaction:

    (a) That creates a purchase-money security interest in a manufactured home, other than a manufactured home held as inventory; or

    (b) In which a manufactured home, other than a manufactured home held as inventory, is the primary collateral. See Ohio Code 1309.102

  • Manure: means animal excreta. See Ohio Code 939.01
  • Manure: means any of the following wastes used in or resulting from the production of agricultural animals or direct agricultural products such as milk or eggs: animal excreta, discarded products, bedding, process waste water, process generated waste water, waste feed, silage drainage, and compost products resulting from mortality composting or the composting of animal excreta. See Ohio Code 903.01
  • Manure storage or treatment facility: means any excavated, diked, or walled structure or combination of structures designed for the biological stabilization, holding, or storage of manure. See Ohio Code 903.01
  • Map: means a graphic representation of the location and size of the existing or proposed items it is made to represent, accurately drawn according to a given scale. See Ohio Code 1571.01
  • Market area: means any area that the director finds is a natural marketing area and designates as such. See Ohio Code 917.01
  • Marketing agreement: means an agreement, contract, or other arrangement between a cooperative and a member in which the member agrees to market all or a part of the products or produce produced by the member, or agrees to purchase all or a part of the member's requirements for inputs, services, or supplies. See Ohio Code 1729.01
  • Marketing cooperative: means any agricultural cooperative meeting the requirements of the "Co-operative Marketing Associations Act" 42 Stat. See Ohio Code 1729.01
  • Markup: The process by which congressional committees and subcommittees debate, amend, and rewrite proposed legislation.
  • Material and substantial violation: means any of the following:

    (1) Failure to obtain a permit to drill, reopen, convert, plugback, or plug a well under this chapter;

    (2) Failure to obtain, maintain, update, or submit proof of insurance coverage that is required under this chapter;

    (3) Failure to obtain, maintain, update, or submit proof of a surety bond that is required under this chapter;

    (4) Failure to restore a disturbed land surface as required by section 1509. See Ohio Code 1509.01

  • Medical kennel for dogs: means a facility that is maintained by a veterinarian and operated primarily for the treatment of sick or injured dogs. See Ohio Code 956.01
  • Medication-assisted treatment: means alcohol and drug addiction services that are accompanied by medication approved by the United States food and drug administration for the treatment of alcoholism or drug addiction, prevention of relapse of alcoholism or drug addiction, or both. See Ohio Code 340.01
  • Medium concentrated animal feeding operation: includes an animal feeding facility that is designated by the director as a medium concentrated animal feeding operation pursuant to rules. See Ohio Code 903.01
  • Member: means a person who has been qualified and accepted into membership in a cooperative. See Ohio Code 1729.01
  • Member: means a person who is a member of a credit union. See Ohio Code 1733.01
  • Member: means a person that, under the governing principles of an unincorporated nonprofit association, is entitled to participate in the selection of persons authorized to manage the affairs of the association or in the adoption of the policies and activities of the association. See Ohio Code 1745.05
  • Member: means one having membership rights and privileges in a corporation in accordance with its articles or regulations. See Ohio Code 1702.01
  • Member: means a person whose name appears on the records of the limited liability company as the owner of a membership interest in that company. See Ohio Code 1705.01
  • Member: means a person that has been admitted as a member of a limited liability company under section 1706. See Ohio Code 1706.01
  • Member of a fire department: means all of the following:

    (a) Any person who commences employment after November 8, 1990, as a full-time firefighter with a fire department, in a position in which the person is required to satisfactorily complete or have satisfactorily completed a firefighter training course approved under former section 3303. See Ohio Code 742.01

  • Member of a police department: means any of the following:

    (a) Any person who receives an original appointment as a full-time regular police officer in a police department from a duly established civil service eligible list or pursuant to section 124. See Ohio Code 742.01

  • Member of the fund: means any person, except an other system retirant as defined in section 742. See Ohio Code 742.01
  • members: as used in this chapter with respect to the right of a member to vote, voting procedure, the required proportion of member votes, actions that are required or permitted to be taken by members, and the number of members required for a quorum, means the delegates or other members entitled to vote. See Ohio Code 1729.17
  • Membership interest: means a member's right to receive distributions from a limited liability company or series thereof. See Ohio Code 1706.01
  • Membership stock: means any class of stock or other equity interest in a cooperative, continuous ownership of which is required for membership in the cooperative. See Ohio Code 1729.01
  • Methane: is a hydrocarbon gas (CH4) frequently encountered in coal mines. See Ohio Code 1561.01
  • Migrate: means the transit or movement of fish to or from one place to another as a result of natural forces or instinct and includes, but is not limited to, movement of fish induced or caused by changes in the water flow. See Ohio Code 1531.01
  • Milk: means the lacteal secretion, substantially free from colostrum, obtained by the complete milking of one or more healthy cows, goats, sheep, or other animals and intended for either of the following purposes:

    (1) To be sold for human consumption or for use in dairy products;

    (2) To be used for human consumption or for use in dairy products on the premises of a governmental agency or institution. See Ohio Code 917.01

  • milk dealer: means a person who purchases or receives milk from a producer for the purpose of bottling, packaging, selling, processing, jobbing, brokering, or distributing the milk except where the milk is disposed of in the same container in which it is received, without removal from the container and without processing in any way except by necessary refrigeration. See Ohio Code 917.01
  • milk hauler: means a person who owns or leases a vehicle or conveyance used to transport raw milk, but does not include a producer transporting raw milk that the producer has produced. See Ohio Code 917.01
  • Milk plant: means a grade A milk plant or manufacture milk plant. See Ohio Code 917.01
  • milk processor: means a grade A milk processor or a manufacture milk processor. See Ohio Code 917.01
  • milk producer: means a grade A milk producer or a manufacture milk producer. See Ohio Code 917.01
  • Mine: means an underground or surface excavation or development with or without shafts, slopes, drifts, or tunnels for the extraction of coal, gypsum, asphalt, rock, or other materials containing the same, or for the extraction of natural gas or petroleum by means that are substantially similar to the underground extraction of coal, gypsum, asphalt, rock, or other materials containing the same, with hoisting or haulage equipment and appliances for the extraction of such materials; and embraces the land or property of the mining plant, the surface, and underground, that is used for or contributes to the mining properties, or concentration or handling of coal, gypsum, asphalt, rock, or other materials containing the same or of natural gas or petroleum. See Ohio Code 1561.01
  • Mine foreperson: means the person whom the operator or superintendent places in charge of the inside or outside workings of the mine and of the persons employed therein or thereat. See Ohio Code 1561.01
  • Minerals: means sand, gravel, clay, shale, gypsum, halite, limestone, dolomite, sandstone, other stone, metalliferous or nonmetalliferous ore, or other material or substance of commercial value excavated in a solid state from natural deposits on or in the earth, but does not include coal or peat. See Ohio Code 1514.01
  • Minority leader: See Floor Leaders
  • monetary obligation: means a monetary obligation secured by the goods or owed under a lease of the goods and includes a monetary obligation with respect to software used in the goods. See Ohio Code 1309.102
  • Monitored captive deer: means whitetail deer that have been legally acquired or their offspring, are tested for chronic wasting disease in accordance with rules, and are held in private ownership for agricultural or personal purposes or in a wild animal hunting preserve licensed under section 1533. See Ohio Code 943.01
  • Mortality composting: means the controlled decomposition of organic solid material consisting of dead animals that stabilizes the organic fraction of the material. See Ohio Code 903.01
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage: means a consensual interest in real property, including fixtures, that secures payment or performance of an obligation. See Ohio Code 1309.102
  • Mortgage: means the consensual interest in real property located in this state, including improvements to that property, securing a debt evidence by a mortgage, trust indenture, deed of trust, or other lien on real property. See Ohio Code 1322.01
  • Mortgage broker: means an entity that for compensation or gain, or in the expectation of compensation or gain, obtains, attempts to obtain, or assists in obtaining a residential mortgage loan for a borrower from a mortgage lender. See Ohio Code 1322.01
  • Mortgage lender: means an entity that for compensation or gain, or in the expectation of compensation or gain consummates a residential mortgage loan, advances funds, offers to advance funds, or commits to advancing funds for a borrower. See Ohio Code 1322.01
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgage loan originator: means an individual who for compensation or gain, or in the expectation of compensation or gain, does any of the following:

    (a) Takes a residential mortgage loan application;

    (b) Assists or offers to assist a buyer in obtaining or applying to obtain a residential mortgage loan by, among other things, advising on loan terms, including rates, fees, and other costs;

    (c) Offers or negotiates terms of a residential mortgage loan;

    (d) Issues or offers to issue a commitment for a residential mortgage loan to a buyer. See Ohio Code 1322.01

  • Mortgage servicer: means a person that, for compensation or gain for itself or on behalf of the holder of a residential mortgage loan, holds the servicing rights for more than five residential mortgage loans, records mortgage payments on its books for more than five residential mortgage loans, or performs other functions to carry out the residential mortgage holder's obligations or rights under the mortgage agreement for more than five residential mortgage loans including, when applicable, the receipt of funds from the mortgagor to be held in escrow for payment of real estate taxes and insurance premiums and the distribution of such funds to the taxing authority and insurance company. See Ohio Code 1322.01
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Mountain top removal: means a coal mining operation that will remove an entire coal seam or seams running through the upper fraction of a mountain, ridge, or hill by removing all of the overburden and creating a level plateau with no highwalls remaining instead of restoring to approximate original contour, and is capable of supporting postmining uses in accordance with the requirements established by the chief. See Ohio Code 1513.01
  • Municipal corporation: includes a joint economic development district or joint economic development zone that levies an income tax under section 715. See Ohio Code 718.01
  • Municipal executive: means the mayor, city manager, or other chief executive officer of the municipal corporation in which a special improvement district is located. See Ohio Code 1710.01
  • Municipal inspection: means the horse meat inspection service maintained by municipal corporation officials. See Ohio Code 919.01
  • Municipal taxable income: means the following:

    (a) For a person other than an individual, income apportioned or sitused to the municipal corporation under section 718. See Ohio Code 718.01

  • Mutual benefit association: means any unincorporated nonprofit association organized under this chapter other than a public benefit association. See Ohio Code 1745.05
  • Mutual benefit corporation: means any corporation organized under this chapter other than a public benefit corporation. See Ohio Code 1702.01
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC
  • National flood insurance program: means the national flood insurance program established in the "National Flood Insurance Act of 1968" 82 Stat. See Ohio Code 1521.01
  • Nationwide mortgage licensing system and registry: means a licensing system developed and maintained by the conference of state bank supervisors and the American association of residential mortgage regulators, or their successor entities, for the licensing and registration of persons providing non-depository financial services. See Ohio Code 1322.01
  • Native wildlife: means any species of the animal kingdom indigenous to this state. See Ohio Code 1531.01
  • Natural resources law enforcement officers: means peace officers as specified in division (A)(6) of section 109. See Ohio Code 935.01
  • Negotiable receipt: means a receipt on which it is stated that the agricultural commodity received will be delivered to the bearer or to the order of any person named in the receipt. See Ohio Code 926.01
  • Net: means fishing devices with meshes composed of twine or synthetic material and includes, but is not limited to, trap nets, fyke nets, crib nets, carp aprons, dip nets, and seines, except minnow seines and minnow dip nets. See Ohio Code 1531.01
  • Net cost: means the original invoice price that the dealer paid for the merchandise to a supplier, less all applicable discounts allowed, plus freight charges incurred by the dealer from the supplier's location to the dealer's location. See Ohio Code 1353.01
  • Net operating loss: means a loss incurred by a person in the operation of a trade or business. See Ohio Code 718.01
  • New community: means a community or development of property in relation to an existing community planned so that the resulting community includes facilities for the conduct of industrial, commercial, residential, cultural, educational, and recreational activities, and designed in accordance with planning concepts for the placement of utility, open space, and other supportive facilities. See Ohio Code 349.01
  • New community authority: means a body corporate and politic in this state, established pursuant to section 349. See Ohio Code 349.01
  • New community development program: means a program for the development of a new community characterized by well-balanced and diversified land use patterns and which includes land acquisition and land development, the acquisition, construction, operation, and maintenance of community facilities, and the provision of services authorized in this chapter. See Ohio Code 349.01
  • New community district: means the area of land described by the developer in the petition as set forth in division (A) of section 349. See Ohio Code 349.01
  • New debtor: means a person that becomes bound as debtor under division (D) of section 1309. See Ohio Code 1309.102
  • New value: means (i) money, (ii) money's worth in property, services, or new credit, or (iii) release by a transferee of an interest in property previously transferred to the transferee. See Ohio Code 1309.102
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nominated person: means a person whom the issuer (a) designates or authorizes to pay, accept, negotiate, or otherwise give value under a letter of credit and (b) undertakes by agreement or custom and practice to reimburse. See Ohio Code 1305.01
  • Noncash proceeds: means proceeds other than cash proceeds. See Ohio Code 1309.102
  • Nondomestic animal: means any animal that is not domestic, including at least nonindigenous animals and animals usually not in captivity. See Ohio Code 941.01
  • Nongame birds: includes all other wild birds not included and defined as game birds or migratory game birds. See Ohio Code 1531.01
  • Nonnative wildlife: means any wild animal not indigenous to this state, but does not include domestic deer. See Ohio Code 1531.01
  • Nonnegotiable receipt: means a receipt on which it is stated that the agricultural commodity received will be delivered to the depositor or to the order of any other person named in the receipt. See Ohio Code 926.01
  • Nonprofit corporation: means a domestic or foreign corporation that is formed otherwise than for the pecuniary gain or profit of, and whose net earnings or any part of them is not distributable to, its members, directors, officers, or other private persons, except that the payment of reasonable compensation for services rendered and the distribution of assets on dissolution as permitted by section 1702. See Ohio Code 1702.01
  • Nonresident: means an individual that is not a resident. See Ohio Code 718.01
  • Nonresident: means any individual who does not qualify as a resident. See Ohio Code 1531.01
  • Normal service pension benefit: means the pension benefit payable to a member of the fund under division (C)(1) of section 742. See Ohio Code 742.01
  • Notice: means that the person who claims the benefit of the notice has done one of the following:

    (1) Stated the fact to the person entitled to notice;

    (2) Delivered through the mail or by other means of communication a written statement of the fact to the person entitled to notice or to a proper person at the place of business or residence of the person entitled to receive a notice. See Ohio Code 1705.01

  • Novel financial product or service: means a financial product or service that makes use of or incorporates new or emerging technology, or reimagines uses of existing technologies, to address a problem, provide a benefit, or otherwise offer a product, service, business model, or delivery mechanism that is not known by the superintendent of financial institutions to have a comparable widespread offering in this state. See Ohio Code 1355.01
  • NPDES permit: includes the federally enforceable provisions of a permit to operate into which NPDES permit provisions have been incorporated. See Ohio Code 903.01
  • Oath: includes affirmation, and "swear" includes affirm. See Ohio Code 1.59
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Obligations: means bonds, notes, or other evidences of obligation of the state, including any interest coupons pertaining thereto, issued pursuant to Chapter 1557 of the Revised Code. See Ohio Code 1557.01
  • Obligor: means a person who, with respect to an obligation secured by a security interest in or an agricultural lien on the collateral, (i) owes payment or other performance of the obligation, (ii) has provided property other than the collateral to secure payment or other performance of the obligation, or (iii) is otherwise accountable in whole or in part for payment or other performance of the obligation. See Ohio Code 1309.102
  • Of unsound mind: means that the person lacks the relevant mental capacity. See Ohio Code 1.02
  • Offeree: means the beneficial or record owner of any security that an offeror acquires or offers to acquire in connection with a control bid. See Ohio Code 1707.01
  • Offeror: means a person who makes, or in any way participates or aids in making, a control bid and includes persons acting jointly or in concert, or who intend to exercise jointly or in concert any voting rights attached to the securities for which the control bid is made and also includes any subject company making a control bid for its own securities. See Ohio Code 1707.01
  • Ohio business gateway: means the online computer network system, created under section 125. See Ohio Code 718.01
  • Ohio soil and water conservation commission: means the Ohio soil and water conservation commission established in section 940. See Ohio Code 939.01
  • Oil: means crude petroleum oil and all other hydrocarbons, regardless of gravity, that are produced in liquid form by ordinary production methods, but does not include hydrocarbons that were originally in a gaseous phase in the reservoir. See Ohio Code 1509.01
  • One-hundred-year flood: means a flood having a one per cent chance of being equaled or exceeded in any given year. See Ohio Code 1521.01
  • One-hundred-year floodplain: means that portion of a floodplain inundated by a one-hundred-year flood. See Ohio Code 1521.01
  • Open season: means that period of time during which the taking of wild animals protected by this chapter and Chapter 1533 of the Revised Code is permitted. See Ohio Code 1531.01
  • Open-end credit: A credit agreement (typically a credit card) that allows a customer to borrow against a preapproved credit line when purchasing goods and services. The borrower is only billed for the amount that is actually borrowed plus any interest due. (Also called a charge account or revolving credit.) Source: OCC
  • opening: when used in clauses relating to the time when a coal mine operator intends to open a new coal mine, or the time when a new coal mine is opened, or the time of the opening of a new coal mine, or when used in other similar clauses to convey like meanings, means that time and condition in the initial development of a new coal mine when the second opening required by section 1563. See Ohio Code 1571.01
  • Operating agreement: includes any amendments to the operating agreement. See Ohio Code 1706.01
  • Operation: means the use or operation, or both, of an amusement ride with riders. See Ohio Code 993.01
  • Operation and management plan: means a written record, developed or approved by the director of agriculture, the director's designee, or the board of supervisors of a soil and water conservation district, for the owner or operator of agricultural land or an animal feeding operation that contains both of the following:

    (1) Implementation schedules and operational procedures for a level of management and pollution abatement practices that will abate the degradation of the waters of the state by residual farm products, manure, and soil sediment, including attached pollutants;

    (2) Best management practices that are to be used by the owner or operator. See Ohio Code 939.01

  • Operator: means any firm, corporation, or individual operating any mine or part thereof. See Ohio Code 1561.01
  • Operator: means any person conducting a coal mining operation. See Ohio Code 1513.01
  • operator: when used in referring to the operator of a gas storage reservoir, means a person who is engaged in the work of preparing to inject, or who injects gas into, or who stores gas in, or who removes gas from, a gas storage reservoir, and who owns the right to do so. See Ohio Code 1571.01
  • Operator: means any person engaged in surface mining who removes minerals, or minerals and incidental coal, from the earth by surface mining or who removes overburden for the purpose of determining the location, quality, or quantity of a mineral deposit. See Ohio Code 1514.01
  • Operator: includes any person who uses, navigates, employs, or has under the person's control a vessel, or vessel and detachable motor, on the waters in this state. See Ohio Code 1546.01
  • Oral argument: An opportunity for lawyers to summarize their position before the court and also to answer the judges' questions.
  • Order: means a written instruction to pay money signed by the person giving the instruction. See Ohio Code 1303.01
  • Organizational board of commissioners: means the following:

    (1) For a new community district that is located in only one county, the board of county commissioners of that county;

    (2) For a new community district that is located in more than one county, a board consisting of the members of the board of county commissioners of each of the counties in which the district is located, provided that action of the board shall require a majority vote of the members of each separate board of county commissioners; or

    (3) For a new community district that is located entirely within the boundaries of a municipal corporation or for a new community district where more than half of the new community district is located within the boundaries of the most populous municipal corporation of a county, the legislative authority of the municipal corporation. See Ohio Code 349.01

  • Organizational documents: means any of the following:

    (1) For a general partnership or foreign general partnership, its partnership agreement;

    (2) For a limited partnership or foreign limited partnership, its certificate of limited partnership and partnership agreement;

    (3) For a limited liability limited partnership or foreign limited liability limited partnership, its certificate of limited partnership and partnership agreement;

    (4) For a limited liability company or foreign limited liability company, its articles of organization and operating agreement, or comparable records as provided in its governing statute;

    (5) For a business or statutory trust or foreign business or statutory trust, its trust instrument, or comparable records as provided in its governing statute;

    (6) For a for-profit corporation or foreign for-profit corporation, its articles of incorporation, regulations, and other agreements among its shareholders that are authorized by its governing statute, or comparable records as provided in its governing statute;

    (7) For a nonprofit corporation or foreign nonprofit corporation, its articles of incorporation, regulations, and other agreements that are authorized by its governing statute or comparable records as provided in its governing statute;

    (8) For a professional association, its articles of incorporation, regulations, and other agreements among its shareholders that are authorized by its governing statute, or comparable records as provided in its governing statute;

    (9) For any other entity, the basic records that create the entity, determine its internal governance, and determine the relations among the persons that own it, are members of it, or govern it. See Ohio Code 1706.01

  • Organizer: means a person executing the initial articles of organization filed by the secretary of state in accordance with section 1706. See Ohio Code 1706.01
  • Orphaned well: means a well that has not been properly plugged or its land surface restored in accordance with this chapter and the rules adopted under it to which either of the following apply:

    (1) The owner of the well is unknown, deceased, or cannot be located and the well is abandoned. See Ohio Code 1509.01

  • Other great lakes states and provinces: means states other than this state that are parties to the great lakes basin compact under Chapter 6161 of the Revised Code and the Canadian provinces of Ontario and Quebec. See Ohio Code 1521.01
  • Other payer: includes casino operators and video lottery terminal sales agents. See Ohio Code 718.01
  • Outside auditor: means an accountant who is licensed to practice as a certified public accountant or public accountant by this state, and who is retained by a credit union to audit its accounts, but who is not otherwise employed by the credit union. See Ohio Code 1733.01
  • Overburden: means all of the earth and other materials, except topsoil, covering a natural deposit of coal, and also means such earth and other materials after removal from their natural state in the process of coal mining. See Ohio Code 1513.01
  • Overburden: means all of the earth and other materials that cover a natural deposit of minerals and also means such earth and other materials after removal from their natural state in the process of surface mining. See Ohio Code 1514.01
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means any person who owns or leases and controls or manages the operation of an amusement ride, and includes individuals, partnerships, corporations, both profit and nonprofit, and the state and any of its political subdivisions and their departments or agencies. See Ohio Code 993.01
  • Owner: includes a person having any title or interest in any property, rights, easements, or interests authorized to be acquired by Chapter 351 of the Revised Code. See Ohio Code 351.01
  • Owner: means an owner or a prospective owner of a residential building or a dwelling unit in a residential building who enters into a contract with a residential contractor for the construction or substantial rehabilitation of that residential building or unit. See Ohio Code 1312.01
  • Owner: means both of the following:

    (1) The owner of land in fee simple, of estates for life, of easements, or of rights-of-way while used by the owners thereof as farm outlets;

    (2) Any of the following with regard to any land that it owns, leases, manages, or otherwise controls and that is adjacent to land used to graze livestock:

    (a) The department of natural resources;

    (b) A conservancy district organized under Chapter 6101. See Ohio Code 971.01

  • Owner: includes any person, other than a secured party, who claims lawful possession of a vessel by virtue of legal title or equitable interest therein that entitled the person to use or possess the vessel, including a person entitled to use or possess a vessel subject to a security interest in another person, but does not include a lessee under a lease not intended as a security. See Ohio Code 1546.01
  • owner of land: means an owner of record as shown by the records in the office of the county recorder. See Ohio Code 940.01
  • Paddlecraft: means any type of canoe, kayak, paddleboard, or other vessel powered only by its occupants using a single or double-bladed paddle as a lever without the aid of a fulcrum provided by oarlocks, tholepins, crutches, or similar mechanisms. See Ohio Code 1546.01
  • Park board: means the board of park commissioners of a park district that is created under Chapter 1545 of the Revised Code. See Ohio Code 1506.01
  • Participating in the conduct of the affairs of a bank or trust company: means either making decisions or, directly or indirectly, taking actions that are management or policymaking in nature and generally within the scope of authority of the bank's or trust company's board of directors or executive officers. See Ohio Code 1121.01
  • Participating political subdivision: means the municipal corporation or township, or each of the municipal corporations or townships, that has territory within the boundaries of a special improvement district created under this chapter. See Ohio Code 1710.01
  • Partition fence: includes a fence that has been considered a division line between two such properties even though a subsequent land survey indicates that the fence is not located directly on the division line. See Ohio Code 971.01
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Party: means a party to an instrument. See Ohio Code 1303.01
  • Pass-through entity: means a partnership not treated as an association taxable as a C corporation for federal income tax purposes, a limited liability company not treated as an association taxable as a C corporation for federal income tax purposes, an S corporation, or any other class of entity from which the income or profits of the entity are given pass-through treatment for federal income tax purposes. See Ohio Code 718.01
  • Patron: means a person with which a cooperative has made an enforceable agreement to allocate and distribute a per unit retain, patronage dividend, or patronage refund with respect to business conducted by the cooperative with or for the person. See Ohio Code 1729.01
  • Patronage stock: means any stock or other equity interest in a cooperative that was originally issued by the cooperative with respect to patronage transactions. See Ohio Code 1729.01
  • Payment intangible: means a general intangible under which the account debtor's principal obligation is a monetary obligation. See Ohio Code 1309.102
  • Pension: means a retirement benefit plan, regardless of whether the plan satisfies the qualifications described under section 401(a) of the Internal Revenue Code, including amounts that are taxable under the "Federal Insurance Contributions Act" Chapter 21 of the Internal Revenue Code, excluding employee contributions and elective deferrals, and regardless of whether such amounts are paid in the same taxable year in which the amounts are included in the employee's wages, as defined by section 3121(a) of the Internal Revenue Code. See Ohio Code 718.01
  • Per stirpes: The legal means by which the children of a decedent, upon the death of an ancestor at a level above that of the decedent, receive by right of representation the share of the ancestor
  • Performance bond: means the surety bond required to be filed under section 1514. See Ohio Code 1514.01
  • Performance security: means a form of financial assurance, including, without limitation, a surety bond issued by a surety licensed to do business in this state; cash; a negotiable certificate of deposit; an irrevocable letter of credit that automatically renews; a negotiable bond of the United States, this state, or a municipal corporation in this state; a trust fund of which the state is the primary beneficiary; or other form of financial guarantee or financial assurance that is acceptable to the chief. See Ohio Code 1513.01
  • Permanent amusement ride: means an amusement ride that is erected to remain a lasting part of the premises. See Ohio Code 993.01
  • Permanent structure: means any residential, commercial, industrial, institutional, or agricultural building, any mobile home as defined in division (O) of section 4501. See Ohio Code 1506.01
  • Permit: means a permit to conduct coal mining and reclamation operations issued by the chief pursuant to section 1513. See Ohio Code 1513.01
  • Permit: includes an initial, renewed, or modified permit to install, permit to operate, NPDES permit, and installation permit unless expressly stated otherwise. See Ohio Code 903.01
  • Permit area: means the area of land to be affected indicated on the approved map submitted by the operator with the application required by section 1513. See Ohio Code 1513.01
  • Permit to install: means a permit issued under section 903. See Ohio Code 903.01
  • Permit to operate: means a permit issued or renewed under section 903. See Ohio Code 903.01
  • Person: means an individual, partnership, corporation, association, organization, government or governmental subdivision or agency, business trust, estate, trust, or any other legal or commercial entity. See Ohio Code 1336.01
  • Person: means any individual, government agency, political subdivision, partnership, corporation, association, co-operative association, or other business unit. See Ohio Code 917.01
  • Person: includes a natural person, partnership, corporation, cooperative, or other entity. See Ohio Code 1729.01
  • Person: means any agency of this state, any political subdivision of this state or of the United States, and any legal entity defined as a person under section 1. See Ohio Code 1506.01
  • Person: includes , without limitation, an individual, the estate of a deceased individual, a corporation, an unincorporated society or association, or any other organization of individuals. See Ohio Code 1733.01
  • Person: includes any political subdivision, department, agency, or instrumentality of this state; the United States and any department, agency, or instrumentality thereof; any legal entity defined as a person under section 1. See Ohio Code 1509.01
  • Person: means an individual, corporation, business trust, statutory entity trust, estate, trust, partnership, limited liability company, cooperative, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, two or more persons having a joint or common interest, or any other legal or commercial entity. See Ohio Code 1745.05
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
  • Person: means any individual, firm, partnership, association, or corporation, or any combination of them. See Ohio Code 351.01
  • Person: includes , but is not limited to, a nonprofit corporation, a business corporation, a partnership, an unincorporated society or association, and two or more persons having a joint or common interest. See Ohio Code 1702.01
  • Person: includes individuals, firms, companies, joint stock companies, business trusts, estates, trusts, partnerships, limited liability partnerships, limited liability companies, associations, C corporations, S corporations, governmental entities, and any other entity. See Ohio Code 718.01
  • Person: means any natural person; partnership, limited partnership, trust, estate, association, limited liability company, or corporation; any custodian, nominee, trustee, executor, administrator, or other fiduciary; or any other individual or entity in its own or any representative capacity. See Ohio Code 1705.01
  • Person: includes an individual, corporation, trust, partnership of two or more persons having a joint or common interest, and any other association. See Ohio Code 1317.01
  • Person: means a person as defined in section 1. See Ohio Code 1531.01
  • Person: means an individual, entity, trust, estate, government, custodian, nominee, trustee, personal representative, fiduciary, or any other individual, entity, or series thereof in its own or any representative capacity, in each case, whether foreign or domestic. See Ohio Code 1706.01
  • Person: includes an individual, firm, association, partnership, corporation, or other legal entity, and the state and any of its agencies, institutions, instrumentalities, or political subdivisions. See Ohio Code 947.01
  • Person: except as otherwise provided in this chapter, means a natural person, firm, partnership, limited partnership, partnership association, syndicate, joint-stock company, unincorporated association, trust or trustee except where the trust was created or the trustee designated by law or judicial authority or by a will, and a corporation or limited liability company organized under the laws of any state, any foreign government, or any political subdivision of a state or foreign government. See Ohio Code 1707.01
  • Person: means any natural person, partnership, association, or corporation. See Ohio Code 953.21
  • Person: means an individual, sole proprietorship, corporation, company, limited liability company, partnership, limited liability partnership, trust, or association. See Ohio Code 1322.01
  • Person: includes any legal entity defined as a person in section 1. See Ohio Code 1546.01
  • Personal flotation device: means a United States coast guard approved personal safety device designed to provide buoyancy to support a person in the water. See Ohio Code 1546.01
  • Personal information: means any information that describes anything about a person, or that indicates actions done by or to a person, or that indicates that a person possesses certain personal characteristics, and that contains, and can be retrieved from a system by, a name, identifying number, symbol, or other identifier assigned to a person. See Ohio Code 1347.01
  • Personal property: means any property that is not real property under the laws of the state where it is located when it is offered or made available for a lease-purchase agreement. See Ohio Code 1351.01
  • Personal property: All property that is not real property.
  • Pest: means a harmful, destructive, or nuisance insect, fungus, rodent, nematode, bacterium, bird, snail, weed, or parasitic plant or a harmful or destructive form of plant or animal life or virus, or any plant or animal species that the director declares to be a pest, except viruses, bacteria, or other microorganisms on or in living animals, including human beings. See Ohio Code 921.01
  • Pesticide: includes a pest monitoring system designated by rule. See Ohio Code 921.01
  • Pesticide business: means a person who performs pesticide business activities. See Ohio Code 921.01
  • Pesticide applicator: means a commercial applicator or a private applicator. See Ohio Code 921.01
  • Pesticide business activities: means any of the following:

    (1) The application of pesticides to the property of another for hire;

    (2) The solicitation to apply pesticides;

    (3) The conducting of authorized diagnostic inspections. See Ohio Code 921.01

  • Pesticide business registered location: means a location at which pesticide business activities are conducted and that is registered through the issuance of a license to a pesticide business under section 921. See Ohio Code 921.01
  • Pesticide dealer: means any person who distributes restricted use pesticides or pesticides whose uses or distribution are further restricted by the director to the ultimate user or to a commercial applicator who is employed by that pesticide dealer. See Ohio Code 921.01
  • Pesticide-use category: means a specialized field of pesticide application or of diagnostic inspection as defined by rule. See Ohio Code 921.01
  • Pet store: means an individual retail store to which both of the following apply: the store sells forty or more puppies or adult dogs in any calendar year to the public; and with regard to the sale of a dog from the store, the sales person, the buyer of a dog, and the dog for sale are physically present during the sales transaction so that the buyer may personally observe the dog and help ensure its health prior to taking custody. See Ohio Code 956.01
  • Physician assistant: means an individual who is licensed under Chapter 4730 of the Revised Code to provide services as a physician assistant to patients under the supervision, control, and direction of one or more physicians. See Ohio Code 1.64
  • Pillar: means a solid block of ore, coal, or other material, left unmined to support the overlying strata in a mine. See Ohio Code 1561.01
  • Pillar: means a solid block of coal or other material left unmined to support the overlying strata in a coal mine, or to protect a well. See Ohio Code 1571.01
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plant regulator: means any substance or mixture of substances, intended, through physiological action, for accelerating or retarding the growth or rate of maturation, or for otherwise altering the behavior of plants or the produce thereof, but does not include substances to the extent that they are intended as plant nutrients, trace elements, nutritional chemicals, plant inoculants, or soil amendments. See Ohio Code 921.01
  • Plat: means a map of a tract or parcel of land. See Ohio Code 711.001
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Plea agreement: An arrangement between the prosecutor, the defense attorney, and the defendant in which the defendant agrees to plead guilty in exchange for special considerations. Source:
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Pledged facilities: means the project or projects mortgaged or facilities the rentals, revenues, and other income, charges, and moneys from which are pledged, or both, for the payment of the principal of and interest on the bonds issued under authority of section 902. See Ohio Code 902.01
  • Police department: means the police department of a municipal corporation. See Ohio Code 742.01
  • Pollutant: means dredged spoil, solid waste, incinerator residue, filter backwash, sewage, garbage, sewage sludge, munitions, chemical wastes, biological materials, radioactive materials except those regulated under the "Atomic Energy Act of 1954" 68 Stat. See Ohio Code 903.01
  • Pollution: means placing any sediments, solids, or waterborne mining-related wastes, including, but not limited to, acids, metallic cations, or their salts, in excess of amounts prescribed by the chief into any waters of the state or affecting the properties of any waters of the state in a manner that renders those waters harmful or inimical to the public health, or to animal or aquatic life, or to the use of the waters for domestic water supply, industrial or agricultural purposes, or recreation. See Ohio Code 1513.01
  • Pool: means an underground reservoir containing a common accumulation of oil or gas, or both, but does not include a gas storage reservoir. See Ohio Code 1509.01
  • Population: means that shown by the most recent regular federal census. See Ohio Code 1.59
  • Possession: means both actual and constructive possession and any control of things referred to. See Ohio Code 1531.01
  • Postal service: means the United States postal service. See Ohio Code 718.01
  • Poultry: includes chickens, turkeys, waterfowl, and game birds. See Ohio Code 941.01
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Powercraft: means any vessel propelled by machinery, fuel, rockets, or similar device. See Ohio Code 1546.01
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Preferred partition fence: includes a barbed wire, electric, or live fence, provided that the owners of adjoining properties agree, in writing, to allow such fences. See Ohio Code 971.01
  • Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
  • Prepared clay: means a clay that is plastic and is thoroughly saturated with fresh water to a weight and consistency great enough to settle through saltwater in the well in which it is to be used, except as otherwise approved by the chief of the division of oil and gas resources management. See Ohio Code 1509.01
  • Presentation: means delivery of a document to an issuer or nominated person for honor or giving of value under a letter of credit. See Ohio Code 1305.01
  • Presenter: means a person making a presentation as, or on behalf of, a beneficiary or nominated person. See Ohio Code 1305.01
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Principal amount: refers to the aggregate of the amount as stated or provided for in the bond proceedings authorizing the obligations as the amount on which interest or interest equivalent is initially calculated, and does not include any premium paid by the initial purchaser of the obligations. See Ohio Code 1557.01
  • Principal office: means the location specified by a limited liability company, foreign limited liability company, or other entity as its principal office in the last filed record in which the limited liability company, foreign limited liability company, or other entity specified its principal office on the records of the secretary of state. See Ohio Code 1706.01
  • Private applicator: means an individual who is licensed under section 921. See Ohio Code 921.01
  • Private facility: means any facility that is accessible only to members of the facility and not accessible to the general public, even upon payment of a fee or charge, and that requires approval for membership by a membership committee representing the current members who have a policy requiring monetary payment to belong to the facility. See Ohio Code 993.01
  • private sewage collection tile: means any tile, ditch, pipe, or other improvement installed by a private person to receive and convey sewage and sewage effluent from at least five household sewage treatment systems, as those systems are defined in section 3718. See Ohio Code 521.01
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • Process generated waste water: means water that is directly or indirectly used in the operation of an animal feeding facility for any of the following:

    (1) Spillage or overflow from animal watering systems;

    (2) Washing, cleaning, or flushing pens, barns, manure pits, or other areas of an animal feeding facility;

    (3) Direct contact swimming, washing, or spray cooling of animals;

    (4) Dust control. See Ohio Code 903.01

  • Process waste water: means any process generated waste water and any precipitation, including rain or snow, that comes into contact with manure, litter, bedding, or any other raw material or intermediate or final material or product used in or resulting from the production of animals or direct products such as milk or eggs. See Ohio Code 903.01
  • Processing: means to perform any act incidental to the manufacture, preparation, development, or changing of horse meat to convert it into marketable form to be sold or offered for sale at retail. See Ohio Code 919.01
  • Processing: means changing the physical or chemical characteristics of agricultural products. See Ohio Code 1729.01
  • processing: means converting hemp into a hemp product. See Ohio Code 928.01
  • Producer: means a person engaged in the production of agricultural products for the market, including a lessor of real or personal property used for production of agricultural products for the market that receives as rent part of the agricultural product. See Ohio Code 1729.01
  • Producer: means a person who complies with all of the following:

    (1) Produces oil or natural gas in this state;

    (2) Derives a majority of income from ownership in properties producing oil or natural gas ;

    (3) Is the owner of record for the respective wells from which assessments are levied under this chapter. See Ohio Code 1510.01

  • Producer: means any person who grows an agricultural commodity on land that the person owns or leases. See Ohio Code 926.01
  • Product name: means a coined or specific designation applied to an individual pesticide of a fixed combination and derivation. See Ohio Code 921.01
  • Production area: means any of the following components of an animal feeding facility:

    (1) Animal confinement areas, including, but not limited to, open lots, housed lots, feedlots, confinement houses, stall barns, free stall barns, milkrooms, milking centers, cowyards, barnyards, medication pens, animal walkways, and stables;

    (2) Manure storage areas, including, but not limited to, manure storage or treatment facilities;

    (3) Raw material storage areas, including, but not limited to, feed silos, silage bunkers, commodity buildings, and bedding materials;

    (4) Waste containment areas, including, but not limited to, any of the following:

    (a) An egg washing or egg processing facility;

    (b) An area used in the storage, handling, treatment, or disposal of mortalities;

    (c) Settling basins, runoff ponds, liquid impoundments, and areas within berms and diversions that are designed and maintained to separate uncontaminated storm water runoff from contaminated water and to contain and treat contaminated storm water runoff. See Ohio Code 903.01

  • Production operation: means all operations and activities and all related equipment, facilities, and other structures that may be used in or associated with the exploration and production of oil, gas, or other mineral resources that are regulated under this chapter, including operations and activities associated with site preparation, site construction, access road construction, well drilling, well completion, well stimulation, well site activities, reclamation, and plugging. See Ohio Code 1509.01
  • Professional solicitor: means any person who, for compensation, performs on behalf of or for the benefit of a charitable organization any service in connection with which contributions are or will be solicited in this state by the compensated person or by any person it employs, procures, or otherwise engages directly or indirectly to solicit contributions. See Ohio Code 1716.01
  • project: means any coal research and development, or any coal research and development facility, including undivided or other interests, acquired or to be acquired, constructed or to be constructed, or operating or to be operated by a person doing business in this state or by an educational or scientific institution located in this state with all or a part of the cost of the project being paid from a loan or grant from the Ohio coal development office or a loan guaranteed by the office under this chapter, including all buildings and facilities that the office determines necessary for the operation of the project, together with all property, rights, easements, and interests that may be required for the operation of the project. See Ohio Code 1555.01
  • Project: means any capital improvements for state and local parks and land and water recreation facilities; soil and water restoration and protection; land management including preservation of natural areas and reforestation; water management including dam safety, stream and lake management, and flood control and flood damage reduction; fish and wildlife resource management; and any other improvements that enhance the use and enjoyment of natural resources by individuals. See Ohio Code 1557.01
  • Project: means real or personal property, or both, including undivided and other interests therein, acquired by gift or purchase, constructed, reconstructed, enlarged, improved, furnished, or equipped, or any combination thereof, by an issuer, or by others from the proceeds of bonds, located within the boundaries of the issuer, and used or to be used by a borrower for agricultural purposes as provided in division (D) of this section. See Ohio Code 902.01
  • Promise: means a written undertaking to pay money that is signed by the person undertaking to pay. See Ohio Code 1303.01
  • Promissory note: means an instrument that evidences a promise to pay a monetary obligation, does not evidence an order to pay, and does not contain an acknowledgment by a bank that the bank has received for deposit a sum of money or funds. See Ohio Code 1309.102
  • Propane: means liquefied petroleum gas, a material with a vapor pressure not exceeding that of commercial propane composed predominately of the following hydrocarbons or mixtures:

    (A) Propane;

    (B) Propylene;

    (C) Butane;

    (D) Butylene

    "Propane council" or "council" means the propane council created under section 936. See Ohio Code 936.01

  • Property: means anything that may be the subject of ownership. See Ohio Code 1336.01
  • Property: means real and personal property. See Ohio Code 1.59
  • Proposal: means a record authenticated by a secured party that includes the terms on which the secured party is willing to accept collateral in full or partial satisfaction of the obligation it secures pursuant to sections 1309. See Ohio Code 1309.102
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Provider: means a hospital, urgent care facility, nursing home, physician, podiatrist, dentist, pharmacist, chiropractor, certified registered nurse anesthetist, dietitian, or other health care provider licensed by this state, or group of such health care providers. See Ohio Code 1731.01
  • Proximate city: means the following:

    (1) For a new community district other than a new community district described in division (M)(2) or (3) of this section, any city that, as of the date of filing of the petition under section 349. See Ohio Code 349.01

  • Public benefit association: means an unincorporated nonprofit association that is exempt from federal income taxation under section 501(c)(3) of the Internal Revenue Code or is organized for a public or charitable purpose and that upon dissolution must distribute its assets to a public benefit association, the United States, a state or any political subdivision of a state, or a person that is recognized as exempt from federal income taxation under section 501(c)(3) of the Internal Revenue Code. See Ohio Code 1745.05
  • Public benefit corporation: means a corporation that is recognized as exempt from federal income taxation under section 501(c)(3) of the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 1702.01
  • Public benefit entity: means an entity that is recognized as exempt from federal income taxation under section 501(c)(3) of the Internal Revenue Code or is organized for a public or charitable purpose and that upon dissolution must distribute its assets to a public benefit entity, the United States, a state or any political subdivision of a state, or a person that is recognized as exempt from federal income taxation under section 501(c)(3) of the Internal Revenue Code. See Ohio Code 1745.05
  • Public benefit entity: means any entity that is recognized as exempt from federal income taxation under section 501(c)(3) of the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 1702.01
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public improvement: means the planning, design, construction, reconstruction, enlargement, or alteration of any facility or improvement, including the acquisition of land, for which a special assessment may be levied under Chapter 727 of the Revised Code, and includes any special energy improvement project or shoreline improvement project. See Ohio Code 1710.01
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public meeting: means a nonadversarial public hearing at which a person may present written or oral statements for the director of agriculture's consideration and includes public hearings held under section 6111. See Ohio Code 903.01
  • Public organic record: means a record that is available to the public for inspection and is:

    (a) A record consisting of the record initially filed with or issued by a state or the United States to form or organize an organization and any record filed with or issued by the state or the United States that amends or restates the initial record;

    (b) An organic record of a business trust consisting of the record initially filed with a state and any record filed with the state that amends or restates the initial record, if a statute of the state governing business trusts requires that the record be filed with the state; or

    (c) A record consisting of legislation enacted by the legislature of a state or the congress of the United States that forms or organizes an organization, any record amending the legislation, and any record filed with or issued by the state or the United States that amends or restates the name of the organization. See Ohio Code 1309.102

  • Public roads: includes all public highways, roads, and streets in the state, whether maintained by the state, county, city, township, or other political subdivision. See Ohio Code 351.01
  • Public service: means any service that can be provided by a municipal corporation or any service for which a special assessment may be levied under Chapter 727 of the Revised Code. See Ohio Code 1710.01
  • Public utilities: means those utilities defined in sections 4905. See Ohio Code 1707.01
  • Public-finance transaction: means a secured transaction in connection with which:

    (a) Debt securities are issued;

    (b) All or a portion of the securities issued have an initial stated maturity of at least twenty years; and

    (c) The debtor, obligor, secured party, account debtor or other person obligated on collateral, assignor or assignee of a secured obligation, or assignor or assignee of a security interest is a state or a governmental unit of a state. See Ohio Code 1309.102

  • Publicly funded assistance programs: include physical health, behavioral health, social, employment, education, and housing programs funded or provided by the state or a political subdivision of the state. See Ohio Code 355.01
  • Publicly traded partnership: means any partnership, an interest in which is regularly traded on an established securities market. See Ohio Code 718.01
  • Puppy: means a dog that is under twelve months of age. See Ohio Code 956.01
  • Purchase: means , with respect to loans, the purchase of loans from, or other acquisition by an issuer of loans of, lending institutions. See Ohio Code 902.01
  • Purchase: means any act by which a purchase is made. See Ohio Code 1707.01
  • Purchase money loan: means a cash advance that is received by a consumer from a creditor in return for a finance charge within the meaning of the "Truth in Lending Act" 82 Stat. See Ohio Code 1317.01
  • Qualified alliance program: means an alliance program under which health care benefits are provided to one thousand or more participants. See Ohio Code 1731.01
  • Qualified independent producer association: means an association that complies with all of the following:

    (1) It is in existence on December 18, 1997. See Ohio Code 1510.01

  • Qualified municipal corporation: means a municipal corporation that, by resolution or ordinance adopted on or before December 31, 2011, adopted Ohio adjusted gross income, as defined by section 5747. See Ohio Code 718.01
  • qualified nonprofit corporation: means a nonprofit corporation that existed before the creation of the corresponding district under this chapter, that is composed of members located within or adjacent to the district, that has established a police department under section 1702. See Ohio Code 1710.01
  • Qualified purchaser: means either of the following:

    (a) A natural person who owns not less than five million dollars in investments as defined by rule by the division of securities;

    (b) A natural person, acting for the person's own account or accounts of other qualified purchasers, who in the aggregate owns and invests on a discretionary basis, not less than twenty-five million dollars in investments as defined by rule by the division of securities. See Ohio Code 1707.01

  • Qualifying investment: means a person's investment in land, buildings, infrastructure, and equipment for creating an impact facility. See Ohio Code 333.01
  • Qualifying wages: means wages, as defined in section 3121(a) of the Internal Revenue Code, without regard to any wage limitations, adjusted as follows:

    (1) Deduct the following amounts:

    (a) Any amount included in wages if the amount constitutes compensation attributable to a plan or program described in section 125 of the Internal Revenue Code. See Ohio Code 718.01

  • Quorum: The number of legislators that must be present to do business.
  • Railway: means any railroad built under and governed by the Ferguson Act of 1869, and does not include property, land, right-of-way, or easements which are a part of the railroad line but are no longer necessary for the operation of the railroad, as determined by the railway board of trustees. See Ohio Code 746.01
  • Railway board of trustees: means a board of trustees established by a municipal corporation pursuant to H. See Ohio Code 746.01
  • Raw milk for sale to the ultimate consumer: means the raw milk sold or offered for sale by a raw milk retailer. See Ohio Code 917.01
  • Raw milk retailer: means a person who, prior to October 31, 1965, was engaged continuously in the business of selling or offering for sale raw milk directly to ultimate consumers. See Ohio Code 917.01
  • Raw rendering material: means any body, part of a body, or product of a body of any dead animal that is unwholesome, condemned, inedible, or otherwise unfit for human consumption. See Ohio Code 953.21
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Reassembly: means the installation, erection, or reconstruction of the main mechanical, safety, electrical, or electronic components of an amusement ride following transportation or storage and prior to operation. See Ohio Code 993.01
  • Receipt: means a warehouse receipt issued by a licensed handler. See Ohio Code 926.01
  • Recess: A temporary interruption of the legislative business.
  • Reclamation: means backfilling, grading, resoiling, planting, and other work that has the effect of restoring an area of land affected by coal mining so that it may be used for forest growth, grazing, agricultural, recreational, and wildlife purpose, or some other useful purpose of equal or greater value than existed prior to any mining. See Ohio Code 1513.01
  • Record: means information that is inscribed on a tangible medium, or that is stored in an electronic or other medium and is retrievable in perceivable form. See Ohio Code 1305.01
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Ohio Code 1745.05
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in written or paper form through an automated process. See Ohio Code 1706.01
  • record owner: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Ohio Code 1309.102
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Recovery housing: means housing for individuals recovering from alcoholism or drug addiction that provides an alcohol and drug-free living environment, peer support, assistance with obtaining alcohol and drug addiction services, and other alcoholism and drug addiction recovery assistance. See Ohio Code 340.01
  • Recreational river area: means an area declared a recreational river area by the director under this chapter and includes those rivers or sections of rivers that are readily accessible by road or railroad, that may have some development along their shorelines, and that may have undergone some impoundment or diversion in the past. See Ohio Code 1546.01
  • Reduction in demand: means a change in customer behavior or a change in customer-owned or operated assets that reduces or has the capability to reduce the demand for electricity as a result of price signals or other incentives. See Ohio Code 1710.01
  • Registered mail: includes certified mail and "certified mail" includes registered mail. See Ohio Code 1.02
  • Registered mortgage loan originator: means an individual to whom both of the following apply:

    (1) The individual is a mortgage loan originator and an employee of a depository institution, a subsidiary that is owned and controlled by a depository institution and regulated by a federal banking agency, or an institution regulated by the farm credit administration. See Ohio Code 1322.01

  • Registered organization: means an organization formed or organized solely under the law of a single state or the United States by the filing of a public organic record with, the issuance of a public organic record by, or the enactment of legislation by the state or the United States. See Ohio Code 1309.102
  • Registrant: means a person who has registered a pesticide under this chapter. See Ohio Code 921.01
  • Registrant: means any person that has been issued a certificate of registration under this chapter. See Ohio Code 1322.01
  • Registration by coordination: means that there has been compliance with section 1707. See Ohio Code 1707.01
  • Registration by description: means that the requirements of section 1707. See Ohio Code 1707.01
  • Registration by qualification: means that the requirements of sections 1707. See Ohio Code 1707.01
  • Regulated individual: means a director, committee member, officer, or employee of a credit union. See Ohio Code 1733.01
  • Regulated person: means any of the following:

    (1) A director, officer, or employee of or agent for a bank or trust company or a person who controls a state bank, foreign bank, or trust company. See Ohio Code 1121.01

  • Regulations: includes the code of regulations of a credit union and any amendments thereto or an amended code of regulations and any amendments thereto. See Ohio Code 1733.01
  • Regulatory sandbox: means the program established by this chapter under which a person is licensed to temporarily test a novel financial product or service on a limited basis without otherwise being licensed or authorized to act under the laws of this state. See Ohio Code 1355.01
  • Related entity: means any of the following:

    (1) An individual stockholder, or a member of the stockholder's family enumerated in section 318 of the Internal Revenue Code, if the stockholder and the members of the stockholder's family own directly, indirectly, beneficially, or constructively, in the aggregate, at least fifty per cent of the value of the taxpayer's outstanding stock;

    (2) A stockholder, or a stockholder's partnership, estate, trust, or corporation, if the stockholder and the stockholder's partnerships, estates, trusts, or corporations own directly, indirectly, beneficially, or constructively, in the aggregate, at least fifty per cent of the value of the taxpayer's outstanding stock;

    (3) A corporation, or a party related to the corporation in a manner that would require an attribution of stock from the corporation to the party or from the party to the corporation under division (OO)(4) of this section, provided the taxpayer owns directly, indirectly, beneficially, or constructively, at least fifty per cent of the value of the corporation's outstanding stock;

    (4) The attribution rules described in section 318 of the Internal Revenue Code apply for the purpose of determining whether the ownership requirements in divisions (OO)(1) to (3) of this section have been met. See Ohio Code 718.01

  • Related member: means a person that, with respect to the taxpayer during all or any portion of the taxable year, is either a related entity, a component member as defined in section 1563(b) of the Internal Revenue Code, or a person to or from whom there is attribution of stock ownership in accordance with section 1563(e) of the Internal Revenue Code except, for purposes of determining whether a person is a related member under this division, "twenty per cent" shall be substituted for "5 percent" wherever "5 percent" appears in section 1563(e) of the Internal Revenue Code. See Ohio Code 718.01
  • Relative: means an individual related by consanguinity within the third degree as determined by the common law, a spouse, or an individual related to a spouse within the third degree as so determined, and includes an individual in an adoptive relationship within the third degree. See Ohio Code 1336.01
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Remitter: means a person who purchases an instrument from its issuer if the instrument is payable to an identified person other than the purchaser. See Ohio Code 1303.01
  • Rendering plant: means any premises where raw rendering materials are converted into fats, oils, feeds, fertilizer, and other products. See Ohio Code 953.21
  • Reorganization plan: means the plan to reorganize into a mutual holding company structure described in section 1116. See Ohio Code 1116.01
  • Reorganizing mutual state bank: means a mutual state bank that proposes to reorganize into a mutual holding company structure in accordance with this chapter. See Ohio Code 1116.01
  • Repair: means to restore an amusement ride to a condition equal to or better than original design specifications. See Ohio Code 993.01
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Reptiles: includes common musk turtle (sternotherus odoratus), common snapping turtle (Chelydra serpentina serpentina), spotted turtle (Clemmys guttata), eastern box turtle (Terrapene carolina carolina), Blanding's turtle (Emydoidea blandingii), common map turtle (Graptemys geographica), ouachita map turtle (Graptemys pseudogeographica ouachitensis), midland painted turtle (Chrysemys picta marginata), red-eared slider (Trachemys scripta elegans), eastern spiny softshell turtle (Apalone spinifera spinifera), midland smooth softshell turtle (Apalone mutica mutica), northern fence lizard (Sceloporus undulatus hyacinthinus), ground skink (Scincella lateralis), five-lined skink (Eumeces fasciatus), broadhead skink (Eumeces laticeps), northern coal skink (Eumeces anthracinus anthracinus), European wall lizard (Podarcis muralis), queen snake (Regina septemvittata), Kirtland's snake (Clonophis kirtlandii), northern water snake (Nerodia sipedon sipedon), Lake Erie watersnake (Nerodia sipedon insularum), copperbelly water snake (Nerodia erythrogaster neglecta), northern brown snake (Storeria dekayi dekayi), midland brown snake (Storeria dekayi wrightorum), northern redbelly snake (Storeria occipitomaculata occipitomaculata), eastern garter snake (Thamnophis sirtalis sirtalis), eastern plains garter snake (Thamnophis radix radix), Butler's garter snake (Thamnophis butleri), shorthead garter snake (Thamnophis brachystoma), eastern ribbon snake (Thamnophis sauritus sauritus), northern ribbon snake (Thamnophis sauritus septentrionalis), eastern hognose snake (Heterodon platirhinos), eastern smooth earth snake (Virginia valeriae valeriae), northern ringneck snake (Diadophis punctatus edwardsii), midwest worm snake (Carphophis amoenus helenae), eastern worm snake (Carphophis amoenus amoenus), black racer (Coluber constrictor constrictor), blue racer (Coluber constrictor foxii), rough green snake (opheodrys aestivus), smooth green snake (opheodrys vernalis vernalis), black rat snake (Elaphe obsoleta obsoleta), eastern fox snake (Elaphe vulpina gloydi), black kingsnake (Lampropeltis getula nigra), eastern milk snake (Lampropeltis triangulum triangulum), northern copperhead (Agkistrodon contortrix mokasen), eastern massasauga (Sistrurus catenatus catenatus), and timber rattlesnake (Crotalus horridus horridus). See Ohio Code 1531.01
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Rescue facility: means a nonprofit organization as described in section 170 of the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 935.01
  • Research kennel for dogs: means a facility housing dogs that is maintained exclusively for research purposes. See Ohio Code 956.01
  • reservoir: means a continuous area of a subterranean porous sand or rock stratum or strata, any part of which or of the protective area of which, is within a coal bearing township, into which gas is or may be injected for the purpose of storing it therein and removing it therefrom, or for the purpose of testing whether such stratum is suitable for such storage purposes. See Ohio Code 1571.01
  • Resident: means an individual who is domiciled in the municipal corporation as determined under section 718. See Ohio Code 718.01
  • Resident: means any individual who has resided in this state for not less than six months preceding the date of making application for a license or permit. See Ohio Code 1531.01
  • Residential building: includes any structure that is used as a model to promote the sale of a similar dwelling house. See Ohio Code 1312.01
  • Residential contractor: means a person or entity who, for pay, enters into a contract with an owner for the construction or the substantial rehabilitation of a residential building and who has primary responsibility for the construction or substantial rehabilitation of a residential building. See Ohio Code 1312.01
  • Residential mortgage loan: means any loan that meets both of the following requirements:

    (1) It is primarily for personal, family, or household use and is secured by a mortgage, deed of trust, or other equivalent consensual security interest on a dwelling or on residential real estate. See Ohio Code 1322.01

  • Residential real estate: means any real property located in this state upon which is constructed a dwelling or upon which a dwelling is intended to be built within a two-year period, subject to 24 C. See Ohio Code 1322.01
  • Residual farm products: means bedding, wash waters, waste feed, and silage drainage. See Ohio Code 939.01
  • Residue: means any poisonous or deleterious pesticide governed by 40 C. See Ohio Code 941.01
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Restricted information: means any information about an individual, other than personal information, that, alone or in combination with other information, including personal information, can be used to distinguish or trace the individual's identity or that is linked or linkable to an individual, if the information is not encrypted, redacted, or altered by any method or technology in such a manner that the information is unreadable, and the breach of which is likely to result in a material risk of identity theft or other fraud to person or property.   • Restricted snake: means any of the following:

    (1) All of the following constricting snakes that are twelve feet or longer:

    (a) Green anacondas;

    (b) Yellow anacondas;

    (c) Reticulated pythons;

    (d) Indian pythons;

    (e) Burmese pythons;

    (f) North African rock pythons;

    (g) South African rock pythons;

    (h) Amethystine pythons. See Ohio Code 935.01

  • Restricted use pesticide: means any pesticide or pesticide use classified by the administrator of the United States environmental protection agency for use only by a pesticide applicator or by an individual working under the direct supervision of a pesticide applicator. See Ohio Code 921.01
  • Resulting stock state bank: means a stock state bank that is organized as a subsidiary of a reorganizing mutual state bank to receive a substantial part of the assets and liabilities, including all deposit accounts, of the reorganizing mutual state bank upon consummation of the reorganization. See Ohio Code 1116.01
  • Retail: means to dispose of specific goods to, or to acquire specific goods by, a person for use other than for purposes of resale. See Ohio Code 1317.01
  • Retail buyer: means a buyer that is a party to a retail installment sale, or any legal successor in interest of such person. See Ohio Code 1317.01
  • Retail installment contract: means any written instrument that is executed in connection with any retail installment sale and is required by section 1317. See Ohio Code 1317.01
  • Retail installment sale: includes every retail installment contract to sell specific goods, every consumer transaction in which the cash price may be paid in installments over a period of time, and every retail sale of specific goods to any person in which the cash price may be paid in installments over a period of time. See Ohio Code 1317.01
  • Retail seller: means a seller that is a party to a retail installment sale. See Ohio Code 1317.01
  • Retailer: means a person engaged primarily in the sale of odorized propane to the ultimate consumer or to a retail propane dispenser. See Ohio Code 936.01
  • Retirement allowance: means the total pension benefit or disability benefit to which a member of the fund may be entitled under division (C) of section 742. See Ohio Code 742.01
  • Retirement benefit plan: means an arrangement whereby an entity provides benefits to individuals either on or after their termination of service because of retirement or disability. See Ohio Code 718.01
  • Retreat mining: means the removal of pillars and ribs and stumps and other coal remaining in a section of a coal mine after the development mining has been completed in such section. See Ohio Code 1571.01
  • Revenues: means all rentals and other charges received by the Ohio water development authority for the use or services of any energy resource development facility, any contract, gift, or grant received with respect to any energy resource development facility, and moneys received with respect to the lease, sublease, sale, including installment sale or conditional sale, or other disposition of an energy resource development facility, moneys received in repayment of and for interest on any loans made by the authority to a person or governmental agency, whether from the United States or any department, administration, or agency thereof, or otherwise, proceeds of energy resource development revenue bonds to the extent that the use thereof for payment of principal of, premium, if any, or interest on the bonds is authorized by the authority, proceeds from any insurance, condemnation, or guaranty pertaining to a facility or property mortgaged to secure bonds or pertaining to the financing of a facility, and income and profit from the investment of the proceeds of energy resource development revenue bonds or of any revenues. See Ohio Code 1551.01
  • Revenues: means all rentals and other charges received by the convention facilities authority for the use or services of any facility, the sale of any merchandise, or the operation of any concessions; any gift or grant received with respect to any facility, any moneys received with respect to the lease, sublease, sale, including installment sale or conditional sale, or other disposition of a facility or part thereof; moneys received in repayment of and for interest on any loans made by the authority to a person or governmental agency, whether from the United States or any department, administration, or agency thereof, or otherwise; proceeds of convention facilities authority revenue bonds to the extent the use thereof for payment of principal or of premium, if any, or interest on the bonds is authorized by the authority; proceeds from any insurance, appropriation, or guaranty pertaining to a facility or property mortgaged to secure bonds or pertaining to the financing of the facility; income and profit from the investment of the proceeds of convention facilities authority revenue bonds or of any revenues; contributions of the proceeds of a tax levied pursuant to division (C) of section 5739. See Ohio Code 351.01
  • Revenues: means the rentals, revenues, payments, repayments, income, charges, and moneys derived or to be derived from the use, lease, sublease, rental, sale, including installment sale or conditional sale, or other disposition of pledged facilities, or derived or to be derived pursuant to a loan made for a project, bond proceeds to the extent provided in the bond proceedings for the payment of principal of, or premium, if any, or interest on the bonds, proceeds from any insurance, condemnation, or guaranty pertaining to pledged facilities or the financing thereof, any income and profit from the investment of the proceeds of bonds or of any revenues, any fees and charges received by or on behalf of an issuer for the services of or commitments by the issuer, and moneys received in repayment of and for interest on any loan made or purchased by an issuer, moneys received by an issuer upon the sale of any bonds of the issuer under section 902. See Ohio Code 902.01
  • Revocable trust: A trust agreement that can be canceled, rescinded, revoked, or repealed by the grantor (person who establishes the trust).
  • Revolving credit: A credit agreement (typically a credit card) that allows a customer to borrow against a preapproved credit line when purchasing goods and services. The borrower is only billed for the amount that is actually borrowed plus any interest due. (Also called a charge account or open-end credit.) Source: OCC
  • Rider: means any person who sits, stands, or is otherwise conveyed or carried as a passenger on an amusement ride, but does not include employees or agents of the owner of the amusement ride. See Ohio Code 993.01
  • Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). Source: OCC
  • Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
  • Rowboat: includes a racing shell and a rowing skull regardless of length or construction. See Ohio Code 1546.01
  • Royalty interest: means the fee holder's share in the production from a well. See Ohio Code 1509.01
  • Rule: means a rule adopted under section 903. See Ohio Code 903.01
  • Rule: means a rule adopted under section 921. See Ohio Code 921.01
  • Rule: includes regulation. See Ohio Code 1.59
  • Rule: means a rule adopted under section 935. See Ohio Code 935.01
  • rule: means any rule adopted by the chief of the division of wildlife under section 1531. See Ohio Code 1531.01
  • Rule: means a rule adopted under section 943. See Ohio Code 943.01
  • Rules: means rules adopted by the chief of the division of parks and watercraft under this chapter or Chapter 1547 of the Revised Code, unless the context indicates otherwise. See Ohio Code 1546.01
  • S corporation: means a person that has made an election under subchapter S of Chapter 1 of Subtitle A of the Internal Revenue Code for its taxable year. See Ohio Code 718.01
  • Safe Drinking Water Act: means the "Safe Drinking Water Act" 88 Stat. See Ohio Code 1509.01
  • Safe operation: means , except as provided in section 993. See Ohio Code 993.01
  • Sailboat: means any vessel, equipped with mast and sails, dependent upon the wind to propel it in the normal course of operation. See Ohio Code 1546.01
  • Salary: includes payments for overtime that are included in the payroll for the period in which the overtime is worked or the payroll for any period not later than sixty days after the overtime is worked. See Ohio Code 742.01
  • Sales contract: means a marketing agreement or other similar arrangement between a handler and a producer, negotiated by the producer or by an agricultural cooperative acting as agent for a producer, under which the producer agrees to grow or produce agricultural products for sale to the handler. See Ohio Code 1729.01
  • salesperson: means every natural person, other than a dealer, who is employed, authorized, or appointed by a dealer to sell securities within this state. See Ohio Code 1707.01
  • Sandbox participant: means a person that has been granted a license to test a novel financial product or service in the regulatory sandbox. See Ohio Code 1355.01
  • Scenic river area: means an area declared a scenic river area by the director under this chapter and includes those rivers or sections of rivers that are free of impoundments, with shorelines or watersheds still largely primitive and shorelines largely undeveloped, but accessible in places by roads. See Ohio Code 1546.01
  • Seal: means any band or object made of metal, plastic, or other material placed on a vehicle or other means of conveyance so that when the vehicle or conveyance is opened, the band or object is affected, altered, or broken. See Ohio Code 941.01
  • Secondary obligor: means an obligor to the extent that:

    (a) The obligor's obligation is secondary; or

    (b) The obligor has a right of recourse with respect to an obligation secured by collateral against the debtor, another obligor, or property of either. See Ohio Code 1309.102

  • Secured party: means :

    (a) A person in whose favor a security interest is created or provided for under a security agreement, whether or not any obligation to be secured is outstanding;

    (b) A person that holds an agricultural lien;

    (c) A consignor;

    (d) A person to whom accounts, chattel paper, payment intangibles, or promissory notes have been sold;

    (e) A trustee, indenture trustee, agent, collateral agent, or other representative in whose favor a security interest or agricultural lien is created or provided for; or

    (f) A person who holds a security interest arising under section 1302. See Ohio Code 1309.102

  • Securities and exchange commission: means the securities and exchange commission established by the Securities Exchange Act of 1934. See Ohio Code 1707.01
  • Security: means any certificate or instrument, or any oral, written, or electronic agreement, understanding, or opportunity, that represents title to or interest in, or is secured by any lien or charge upon, the capital, assets, profits, property, or credit of any person or of any public or governmental body, subdivision, or agency. See Ohio Code 1707.01
  • Security agreement: means an agreement that creates or provides for a security interest. See Ohio Code 1309.102
  • Security interest: means a mortgage, lien, or other encumbrance on, or pledge or assignment of, or other security interest with respect to all or any part of pledged facilities, revenues, reserve funds, or other funds established under the bond proceedings, or on, of, or with respect to, a lease, sublease, sale, conditional sale, or installment sale agreement, loan agreement, or any other agreement pertaining to the lease, sublease, sale, or other disposition of a project or pertaining to a loan made for a project, or any guaranty or insurance agreement made with respect thereto, or any interest of the issuer therein, or any other interest granted, assigned, purchased, or released to secure payments of the principal of, premium, if any, or interest on any bonds or to secure any other payments to be made by an issuer under the bond proceedings. See Ohio Code 902.01
  • Sell: means any act by which a sale is made. See Ohio Code 1707.01
  • Seller: means a person who sells or agrees to sell goods. See Ohio Code 1317.01
  • Service charge: means the amount that the retail buyer pays or contracts to pay the retail seller for the privilege of paying the principal balance in installments over a period of time in addition to the finance charge for the same privilege. See Ohio Code 1317.01
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sewage: means human body wastes and the wastes from toilets and other receptacles intended to receive or retain body waste. See Ohio Code 1546.01
  • Shaft: means a vertical opening through the strata that is or may be used for ventilation, drainage, or hoisting workers or material or both in connection with the mining of coal or other minerals or materials. See Ohio Code 1561.01
  • Share account: means an account established for a member for which no share certificates are issued but which are included in the registry of shares, which includes all transactions of the credit union pertaining to such shares. See Ohio Code 1733.01
  • Shore structure: includes , but is not limited to, beaches; groins; revetments; bulkheads; seawalls; breakwaters; certain dikes designated by the chief of the division of water resources; piers; docks; jetties; wharves; marinas; boat ramps; any associated fill or debris used as part of the construction of shore structures that may affect shore erosion, wave action, or inundation; and fill or debris that is placed along or near the shore, including bluffs, banks, or beach ridges, for the purpose of stabilizing slopes. See Ohio Code 1506.01
  • Shoreline improvement project: means acquiring, constructing, installing, equipping, improving, maintaining, or repairing real or tangible personal property necessary or useful for making improvements to abate erosion along either the Lake Erie shoreline or any water resource. See Ohio Code 1710.01
  • Shot firer: means a practical and experienced person whose duties are to charge, set off, and discharge the shots under the direction of the mine foreperson or foreperson. See Ohio Code 1561.01
  • Sign: means , with the present intent to authenticate or adopt a record, either of the following:

    (1) To execute or adopt a tangible symbol;

    (2) To attach to or logically associate with the record an electronic symbol, sound, or process. See Ohio Code 1706.01

  • Single member limited liability company: means a limited liability company that has one direct member. See Ohio Code 718.01
  • Small concentrated animal feeding operation: means an animal feeding facility that is not a large or medium concentrated animal feeding operation and that is designated by the director as a small concentrated animal feeding operation pursuant to rules. See Ohio Code 903.01
  • Small dealer: means any person found by the department buying, receiving, selling, slaughtering, with the exception of those persons designated by division (B)(1) of section 918. See Ohio Code 943.01
  • Small employer: means any employer that had total revenue of less than five hundred thousand dollars during the preceding taxable year. See Ohio Code 718.01
  • small employer health care alliance: means an existing or newly created organization that has been granted a certificate of authority by the superintendent of insurance under section 1731. See Ohio Code 1731.01
  • Software: means a computer program and any supporting information provided in connection with a transaction relating to the program. See Ohio Code 1309.102
  • Soil and water conservation district: means a district organized in accordance with this chapter. See Ohio Code 940.01
  • Sole ownership: The type of property ownership in which one individual holds legal title to the property and has full control of it.
  • solicitation: includes but is not limited to the following methods of requesting or securing the promise, pledge, or grant of money, property, financial assistance, or any other thing of value:

    (a) Any oral or written request;

    (b) Making any announcement to the press, on radio or television, by telephone or telegraph, or by any other communication device concerning an appeal or campaign by or for any charitable organization or for any charitable purpose;

    (c) Distributing, circulating, posting, or publishing any handbill, written advertisement, or other publication that directly or by implication seeks to obtain any contribution;

    (d) Selling or offering or attempting to sell any advertisement, advertising space, book, card, tag, coupon, chance, device, magazine, membership, merchandise, subscription, sponsorship, flower, ticket, admission, candy, cookies, or other tangible item, or any right of any description in connection with which an appeal is made for any charitable organization or charitable purpose, or when the name of any charitable organization is used or referred to in any such appeal as an inducement or reason for making the sale, or when in connection with the sale or offer or attempt to sell, any statement is made that all or part of the proceeds from the sale will be used for any charitable purpose or will benefit any charitable organization. See Ohio Code 1716.01

  • Source separated recyclable materials: means materials that are separated from other solid wastes at the location where the materials are generated for the purpose of recycling the materials at a legitimate recycling facility. See Ohio Code 343.01
  • Special energy improvement project: means any property, device, structure, or equipment necessary for the acquisition, installation, equipping, and improvement of any real or personal property used for the purpose of creating a solar photovoltaic project, a solar thermal energy project, a geothermal energy project, a customer-generated energy project, or an energy efficiency improvement, whether such real or personal property is publicly or privately owned. See Ohio Code 1710.01
  • Special improvement district: means a special improvement district organized under this chapter. See Ohio Code 1710.01
  • Special purpose district: means any geographic or political jurisdiction that is created by statute to perform a limited and specific function, and includes, but is not limited to, library districts, conservancy districts, metropolitan housing authorities, park districts, port authorities, regional airport authorities, regional transit authorities, regional water and sewer districts, sanitary districts, soil and water conservation districts, and regional planning agencies. See Ohio Code 1347.01
  • Specific goods: means goods, including related services, identified and agreed upon at the time a contract to sell or a sale is made. See Ohio Code 1317.01
  • Spoil bank: means a pile of removed overburden. See Ohio Code 1514.01
  • Sports facility: means a facility intended to house major league professional athletic teams. See Ohio Code 351.01
  • Spousal equivalent: means a cohabitant occupying a relationship generally equivalent to that of a spouse. See Ohio Code 1112.01
  • State: means the United States, any state, territory, insular possession, or other political subdivision of the United States, including the District of Columbia. See Ohio Code 1733.01
  • state: means the state of Ohio. See Ohio Code 1.59
  • State: means the United States; any state, territory, insular possession, or other political subdivision of the United States, including the District of Columbia; any foreign country or nation; and any province, territory, or other political subdivision of a foreign country or nation. See Ohio Code 1702.01
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Ohio Code 1309.102
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Ohio Code 1706.01
  • State: means any state of the United States, any territory or possession of the United States, the District of Columbia, and any province of Canada. See Ohio Code 1707.01
  • state agency: except as otherwise provided in the title, means every organized body, office, or agency established by the laws of the state for the exercise of any function of state government. See Ohio Code 1.60
  • State agency: means the office of any elected state officer and any agency, board, commission, department, division, or educational institution of the state. See Ohio Code 1347.01
  • State retirement system: means the public employees retirement system, Ohio police and fire pension fund, state teachers retirement system, school employees retirement system, and state highway patrol retirement system. See Ohio Code 1707.01
  • State retirement system investment officer: means an individual employed by a state retirement system as a chief investment officer, assistant investment officer, or the person in charge of a class of assets or in a position that is substantially equivalent to chief investment officer, assistant investment officer, or person in charge of a class of assets. See Ohio Code 1707.01
  • state trail: means any trail acquired by the director, or trail established or maintained pursuant to an agreement, under section 1519. See Ohio Code 1519.01
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Steep slope: means any slope above twenty degrees or such lesser slope as may be defined by the chief after considering soil, climate, and other characteristics of a region. See Ohio Code 1513.01
  • stimulation of a well: means the process of enhancing well productivity, including hydraulic fracturing operations. See Ohio Code 1509.01
  • Stock bank: means a bank that has an ownership structure in the form of shares of stock and is doing business under authority granted by the superintendent of financial institutions or the bank regulatory authority of another state or the United States. See Ohio Code 1116.01
  • Storage: means the deposit of an agricultural commodity into a warehouse either for the account of the licensed handler operating the warehouse or for the account of a depositor. See Ohio Code 926.01
  • Strip mining: means those coal mining and reclamation operations incident to the extraction of coal from the earth by removing the materials over a coal seam, before recovering the coal, by auger coal mining, or by recovery of coal from a deposit that is not in its original geologic location. See Ohio Code 1513.01
  • Structure: means a walled and roofed building, including, without limitation, gas or liquid storage tanks and manufactured homes. See Ohio Code 1521.01
  • Subdivision: means either of the following:

    (1) The division of any parcel of land shown as a unit or as contiguous units on the last preceding general tax list and duplicate of real and public utility property, into two or more parcels, sites, or lots, any one of which is less than five acres for the purpose, whether immediate or future, of transfer of ownership, provided, however, that the following are exempt:

    (a) A division or partition of land into parcels of more than five acres not involving any new streets or easements of access;

    (b) The sale or exchange of parcels between adjoining lot owners, where that sale or exchange does not create additional building sites;

    (c) If the planning authority adopts a rule in accordance with section 711. See Ohio Code 711.001

  • Subject company: means an issuer that satisfies both of the following:

    (a) Its principal place of business or its principal executive office is located in this state, or it owns or controls assets located within this state that have a fair market value of at least one million dollars. See Ohio Code 1707.01

  • Subpoena: A command to a witness to appear and give testimony.
  • Subpoena duces tecum: A command to a witness to produce documents.
  • Subsidiary holding company: means a stock company that is controlled by a mutual holding company and that owns the stock of a stock state bank whose depositors have membership rights in the parent mutual holding company. See Ohio Code 1116.01
  • Substantial damage: means damage of any origin that is sustained by a structure if the cost of restoring the structure to its condition prior to the damage would equal or exceed fifty per cent of the market value of the structure before the damage occurred. See Ohio Code 1521.01
  • Substantial improvement: includes repairs to structures that have incurred substantial damage regardless of the actual repair work performed. See Ohio Code 1521.01
  • Substantial rehabilitation: includes the addition of a room and the removal or installation of a wall, partition, or portion of the structural design. See Ohio Code 1312.01
  • Successor of a beneficiary: means a person who succeeds to substantially all of the rights of a beneficiary by operation of law, including a corporation with or into which the beneficiary has been merged or consolidated, an administrator, executor, personal representative, trustee in bankruptcy, debtor in possession, liquidator, and receiver. See Ohio Code 1305.01
  • Summons: Another word for subpoena used by the criminal justice system.
  • Superintendent: means the person who has, on behalf of the operator, immediate supervision of one or more mines. See Ohio Code 1561.01
  • Superintendent of credit unions: means the "division of financial institutions" the "superintendent of financial institutions of this state" or the "deputy superintendent for credit unions"; and whenever the context requires it, may be read as "director of commerce. See Ohio Code 1733.01
  • Superintendent of financial institutions: includes the deputy superintendent for consumer finance as provided in section 1181. See Ohio Code 1322.01
  • Supervised person: means a natural person who is any of the following:

    (1) A partner, officer, or director of an investment adviser, or other person occupying a similar status or performing similar functions with respect to an investment adviser;

    (2) An employee of an investment adviser;

    (3) A person who provides investment advisory services described in division (X)(1) of this section on behalf of the investment adviser and is subject to the supervision and control of the investment adviser. See Ohio Code 1707.01

  • Supervisor: means one of the members of the governing body of a district. See Ohio Code 940.01
  • Supplier: means a manufacturer, wholesaler, or distributor of farm machinery or construction equipment to dealers under a dealer agreement who also may require the dealer to purchase data processing hardware to satisfy the minimum requirements of the dealer agreement. See Ohio Code 1353.01
  • Supporting obligation: means a letter-of-credit right or secondary obligation that supports the payment or performance of an account, chattel paper, a document, a general intangible, an instrument, or investment property. See Ohio Code 1309.102
  • Surface mining: means all or any part of a process followed in the production of minerals from the earth or from the surface of the land by surface excavation methods, such as open pit mining, dredging, placering, or quarrying, and includes the removal of overburden for the purpose of determining the location, quantity, or quality of mineral deposits, and the incidental removal of coal at a rate less than one-sixth the total weight of minerals and coal removed during the year, but does not include: test or exploration boring; mining operations carried out beneath the surface by means of shafts, tunnels, or similar mine openings; the extraction of minerals, other than coal, by a landowner for the landowner's own noncommercial use where such material is extracted and used in an unprocessed form on the same tract of land; the extraction of minerals, other than coal, from borrow pits for highway construction purposes, provided that the extraction is performed under a bond, a contract, and specifications that substantially provide for and require reclamation practices consistent with the requirements of this chapter; the removal of minerals incidental to construction work, provided that the owner or person having control of the land upon which the construction occurs, the contractor, or the construction firm possesses a valid building permit; the removal of minerals to a depth of not more than five feet, measured from the highest original surface elevation of the area to be excavated, where not more than one acre of land is excavated during twelve successive calendar months; routine dredging of a watercourse for purely navigational or flood control purposes during which materials are removed for noncommercial purposes, including activities conducted by or on behalf of a conservancy district, organized under Chapter 6101. See Ohio Code 1514.01
  • surface mining operation: means all of the premises, facilities, and equipment used in the process of removing minerals, or minerals and incidental coal, by surface mining from a mining area in the creation of which mining area overburden or minerals, or minerals and incidental coal, are disturbed or removed, such surface mining area being located upon a single tract of land or upon two or more contiguous tracts of land. See Ohio Code 1514.01
  • Surviving entity: means an entity into which one or more other entities are merged, whether the entity pre-existed the merger or was created pursuant to the merger. See Ohio Code 1706.01
  • System: includes both records that are manually stored and records that are stored using electronic data processing equipment. See Ohio Code 1347.01
  • Tangible chattel paper: means chattel paper evidenced by a record consisting of information that is inscribed on a tangible medium. See Ohio Code 1309.102
  • Tax administrator: means , subject to division (U)(2) of this section, the individual charged with direct responsibility for administration of an income tax levied by a municipal corporation in accordance with this chapter, and also includes the following:

    (a) A municipal corporation acting as the agent of another municipal corporation;

    (b) A person retained by a municipal corporation to administer a tax levied by the municipal corporation, but only if the municipal corporation does not compensate the person in whole or in part on a contingency basis;

    (c) The central collection agency or the regional income tax agency or their successors in interest, or another entity organized to perform functions similar to those performed by the central collection agency and the regional income tax agency. See Ohio Code 718.01

  • Tax commissioner: means the tax commissioner appointed under section 121. See Ohio Code 718.01
  • Tax return preparer: means any individual described in section 7701(a)(36) of the Internal Revenue Code and 26 C. See Ohio Code 718.01
  • Taxable year: means the corresponding tax reporting period as prescribed for the taxpayer under the Internal Revenue Code. See Ohio Code 718.01
  • Taxpayer: means a person subject to a tax levied on income by a municipal corporation in accordance with this chapter. See Ohio Code 718.01
  • Temporary amusement ride: means an amusement ride that is relocated at least once per year with or without disassembly. See Ohio Code 993.01
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent
  • Tenant: means an individual who resides on land for which the individual pays rent and whose annual income is primarily derived from agricultural production conducted on that land, as "agricultural production" is defined in section 929. See Ohio Code 1531.01
  • terminal pay: means the following payments made by an employer to an employee regardless of whether the payments are made before or after termination:

    (1) Payments for accrued but unused leave, including sick leave, vacation, personal leave, and compensatory time;

    (2) Payments deferred more than one year compensating the employee for holidays worked or for longevity;

    (3) Payments for overtime worked that are not included in the payroll for the period in which the overtime is worked or the payroll for any period ending not later than sixty days after the overtime is worked;

    (4) Other payments that are not compensation for services rendered in the last pay period in which services were rendered and are designated as terminal pay by rule of the board of trustees of the Ohio police and fire pension fund. See Ohio Code 742.01

  • Termination statement: means an amendment of a financing statement that:

    (a) Identifies, by its file number, the initial financing statement to which it relates; and

    (b) Indicates either that it is a termination statement or that the identified financing statement is no longer effective. See Ohio Code 1309.102

  • Territory of the authority: means all of the area of the county creating the convention facilities authority. See Ohio Code 351.01
  • Test: means to provide products and services as allowed by this chapter. See Ohio Code 1355.01
  • Testator: A male person who leaves a will at death.
  • tester: means a person who operates a moisture meter and other quality testing devices to determine the quality of an agricultural commodity. See Ohio Code 926.01
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Testing: means injecting gas into, or storing gas in or removing gas from, a gas storage reservoir for the sole purpose of determining whether such reservoir is suitable for use as a gas storage reservoir. See Ohio Code 1571.01
  • Thermoneutral zone: means the range of ambient temperature in which a dog is able to maintain normal body temperature without a change in metabolic rate. See Ohio Code 956.01
  • Ticket: means a scale weight ticket, a load slip, or any evidence, other than a receipt, given to a depositor by a licensed handler upon delivery of an agricultural commodity to the handler. See Ohio Code 926.01
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • total revenue: means receipts of any type or kind, including, but not limited to, sales receipts; payments; rents; profits; gains, dividends, and other investment income; compensation; commissions; premiums; money; property; grants; contributions; donations; gifts; program service revenue; patient service revenue; premiums; fees, including premium fees and service fees; tuition payments; unrelated business revenue; reimbursements; any type of payment from a governmental unit, including grants and other allocations; and any other similar receipts reported for federal income tax purposes or under generally accepted accounting principles. See Ohio Code 718.01
  • Tract: means a single, individual parcel of land or a portion of a single, individual parcel of land. See Ohio Code 1509.01
  • Trained serviceperson: means an employee of a pesticide business, other business, agency of the United States government, state agency, or political subdivision who has been trained to apply pesticides while under the direct supervision of a commercial applicator. See Ohio Code 921.01
  • Transaction: means the charge by a hotel for each occupancy by transient guests of a room or suite of rooms used in a hotel as a single unit for any period of twenty-four hours or less. See Ohio Code 351.01
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: means every direct or indirect, absolute or conditional, and voluntary or involuntary method of disposing of or parting with an asset or an interest in an asset, and includes payment of money, release, lease, and creation of a lien or other encumbrance. See Ohio Code 1336.01
  • Transmitting utility: means a person primarily engaged in the business of:

    (a) Operating a railroad, subway, street railway, or trolley bus;

    (b) Transmitting communications electrically, electromagnetically, or by light;

    (c) Transmitting goods by pipeline or sewer; or

    (d) Transmitting or producing and transmitting electricity, steam, gas, or water. See Ohio Code 1309.102

  • Trapping: includes every act of assistance to any other person in capturing wild birds or wild quadrupeds by means of the device whether or not the means results in capture. See Ohio Code 1531.01
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Tribunal: means a court or, if provided in the operating agreement or otherwise agreed, an arbitrator, arbitration panel, or other tribunal. See Ohio Code 1705.01
  • Tribunal: means a court or, if provided in the operating agreement or otherwise agreed, an arbitrator, arbitration panel, or other tribunal. See Ohio Code 1706.01
  • Trotline: means a device for catching fish that consists of a line having suspended from it, at frequent intervals, vertical lines with hooks attached. See Ohio Code 1531.01
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trust business: means accepting and executing trusts of property, serving as a trustee, executor, administrator, guardian, receiver, or conservator, and providing fiduciary services as a business. See Ohio Code 1111.01
  • Trustee: A person or institution holding and administering property in trust.
  • Underground excavations: when used in referring to the underground excavations of a coal mine, includes the abandoned underground excavations of such mine. See Ohio Code 1571.01
  • Undertaking: includes a bond. See Ohio Code 1.02
  • Undivided earnings: consist of all accumulated net earnings and reserves required under division (B) of section 1733. See Ohio Code 1733.01
  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • Unincorporated nonprofit association: means an unincorporated organization, consisting of two or more members joined by mutual consent pursuant to an agreement, written, oral, or inferred from conduct, for one or more common, nonprofit purposes. See Ohio Code 1745.05
  • Unique identifier: means a number or other identifier assigned by protocols established by the nationwide mortgage licensing system and registry. See Ohio Code 1322.01
  • United States: includes all the states. See Ohio Code 1.59
  • University: means an institution of higher education as defined in section 3345. See Ohio Code 928.01
  • Unreasonable adverse effects on the environment: means any unreasonable risk to human beings or the environment taking into account the economic, social, and environmental benefits and costs of the use of any pesticide. See Ohio Code 921.01
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • Urban sediment and storm water runoff pollution: means failure to use management or conservation practices to abate wind or water erosion of the soil or to abate the degradation of the waters of the state by soil sediment or storm water runoff in conjunction with land grading, excavating, filling, or other activities that disturb the soil and increase storm water runoff on land used or being developed for nonfarm commercial, industrial, residential, or other nonfarm purposes, except lands being used in a strip mine operation as defined in section 1513. See Ohio Code 940.01
  • Urbanized area: means an area where a well or production facilities of a well are located within a municipal corporation or within a township that has an unincorporated population of more than five thousand in the most recent federal decennial census prior to the issuance of the permit for the well or production facilities. See Ohio Code 1509.01
  • USDA: means the United States department of agriculture. See Ohio Code 928.01
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Usury: Charging an illegally high interest rate on a loan. Source: OCC
  • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.
  • Varied assessment: means any assessment that does not meet the criteria established in division (H) of this section. See Ohio Code 940.01
  • Vector: means a disease carrier, usually from, but not limited to, the arthropod class, that transfers an infectious agent that may transmit a dangerously contagious or infectious disease from one host to another. See Ohio Code 941.01
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Vessel: includes every description of craft, including nondisplacement craft, multimodal craft, and submersibles, being used or capable of being used as a means of transportation on water. See Ohio Code 1546.01
  • Veterinarian: means a person who is licensed under Chapter 4741 of the Revised Code. See Ohio Code 935.01
  • Veterinarian: means either a veterinarian licensed in this state under Chapter 4741 of the Revised Code or a veterinarian licensed out of this state by an applicable state entity. See Ohio Code 956.01
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Video lottery terminal sales agent: means a lottery sales agent licensed under Chapter 3770 of the Revised Code to conduct video lottery terminals on behalf of the state pursuant to section 3770. See Ohio Code 718.01
  • Visible: means visible on a dark night with clear atmosphere. See Ohio Code 1546.01
  • Voice vote: A vote in which the Presiding Officer states the question, then asks those in favor and against to say "Yea" or "Nay," respectively, and announces the result according to his or her judgment. The names or numbers of legisators voting on each side are not recorded.
  • volunteer: means a manager, officer, member, or agent of an unincorporated nonprofit association, or another person acting for the association, who satisfies both of the following:

    (a) Performs services for or on behalf of, and under the authority or auspices of, that unincorporated nonprofit association;

    (b) Does not receive compensation, either directly or indirectly, for performing those services. See Ohio Code 1745.05

  • volunteer: means a director, officer, or agent of a corporation, or another person associated with a corporation, who satisfies both of the following:

    (a) Performs services for or on behalf of, and under the authority or auspices of, that corporation;

    (b) Does not receive compensation, either directly or indirectly, for performing those services. See Ohio Code 1702.01

  • Voting member: means an association member or an individual member who is qualified to vote as provided by law, the articles, or the regulations. See Ohio Code 1733.01
  • Voting member: means a member possessing voting rights, either generally or in respect of the particular question involved, as the case may be. See Ohio Code 1702.01
  • Voting shares: means shares of a domestic or foreign corporation, entitling the holder of the shares to vote at the time in the election of directors of the corporation without regard to the voting power represented by shares that thereafter may exist upon a default, failure, or other contingency. See Ohio Code 1704.01
  • Warehouse: means any building, bin, protected enclosure, or similar premises under the control of a licensed or unlicensed handler used for receiving, storing, shipping, or handling an agricultural commodity. See Ohio Code 926.01
  • Waste: includes all of the following:

    (1) Physical waste, as that term generally is understood in the oil and gas industry;

    (2) Inefficient, excessive, or improper use, or the unnecessary dissipation, of reservoir energy;

    (3) Inefficient storing of oil or gas;

    (4) Locating, drilling, equipping, operating, or producing an oil or gas well in a manner that reduces or tends to reduce the quantity of oil or gas ultimately recoverable under prudent and proper operations from the pool into which it is drilled or that causes or tends to cause unnecessary or excessive surface loss or destruction of oil or gas;

    (5) Other underground or surface waste in the production or storage of oil, gas, or condensate, however caused. See Ohio Code 1509.01

  • Water resources: means any waters of the state that are available or may be made available to agricultural, industrial, commercial, and domestic users. See Ohio Code 1521.01
  • Watercourse: means a substantially natural channel with recognized banks and bottom in which a flow of water occurs, with an average of at least ten feet mean surface water width and at least five miles of length. See Ohio Code 1546.01
  • Watercourse: means any naturally occurring perennial or intermittent stream, river, or creek flowing within a defined stream bed and banks. See Ohio Code 1514.01
  • Watercraft: means any of the following when used or capable of being used for transportation on the water:

    (1) A vessel operated by machinery either permanently or temporarily affixed;

    (2) A sailboat other than a sailboard;

    (3) An inflatable, manually propelled vessel that is required by federal law to have a hull identification number meeting the requirements of the United States coast guard;

    (4) A canoe, kayak, pedalboat, or rowboat;

    (5) Any of the following multimodal craft being operated on waters in this state:

    (a) An amphibious vehicle;

    (b) A submersible;

    (c) An airboat or hovercraft. See Ohio Code 1546.01

  • Waters: includes any lake, pond, reservoir, stream, channel, lagoon, or other body of water, or any part thereof, whether natural or artificial. See Ohio Code 1531.01
  • Waters in this state: means all streams, rivers, lakes, ponds, marshes, watercourses, waterways, and other bodies of water, natural or humanmade, that are situated wholly or partially within this state or within its jurisdiction and are used for recreational boating. See Ohio Code 1546.01
  • Waters of the state: means all streams, lakes, ponds, marshes, watercourses, waterways, springs, irrigation systems, drainage systems, and other bodies of water, surface or underground, natural or artificial, that are situated wholly or partially within this state or within its jurisdiction, except those private waters that do not combine or effect a junction with natural surface or underground waters. See Ohio Code 1509.01
  • Waters of the state: means all streams, lakes, ponds, marshes, watercourses, waterways, wells, springs, irrigation systems, drainage systems, and other bodies or accumulations of water, surface or underground, natural or artificial, regardless of the depth of the strata in which underground water is located, that are situated wholly or partly within, or border upon, this state, or are within its jurisdiction. See Ohio Code 1513.01
  • Waters of the state: includes all streams, lakes, ponds, marshes, watercourses, waterways, wells, springs, irrigation systems, drainage systems, and other bodies or accumulations of water, surface and underground, natural or artificial, regardless of the depth of the strata in which underground water is located, that are situated wholly or partly within or bordering upon this state or are within its jurisdiction. See Ohio Code 1521.01
  • Waters of the state: means all streams, lakes, ponds, wetlands, watercourses, waterways, wells, springs, irrigation systems, drainage systems, and other bodies or accumulations of water, surface and underground, natural or artificial, regardless of the depth of the strata in which underground water is located, that are situated wholly or partly within, or border on, this state or are within its jurisdiction, except those private waters that do not combine or effect a junction with natural surface or underground waters. See Ohio Code 939.01
  • Wearable personal flotation device: includes a personal flotation device marked as "Type I" "Type II" "Type III" "Type V with Type II performance" or "Type V with Type III performance. See Ohio Code 1546.01
  • Weed: means any plant that grows where not wanted. See Ohio Code 921.01
  • Well: means any borehole, whether drilled or bored, within the state for production, extraction, or injection of any gas or liquid mineral, excluding potable water to be used as such, but including natural or artificial brines and oil field waters. See Ohio Code 1509.01
  • Well: means any borehole, whether drilled or bored, within the state, for the production, extraction, or injection of any gas or liquid mineral, excluding only potable water to be used as such, but including natural or artificial brines and oil field waters. See Ohio Code 1561.01
  • Well: means any hole, drilled or bored, or being drilled or bored, into the earth, whether for the purpose of, or whether used for:

    (1) Producing or extracting any gas or liquid mineral, or natural or artificial brines, or oil field waters;

    (2) Injecting gas into or removing gas from an underground gas storage reservoir;

    (3) Introducing water or other liquid pressure into an oil bearing sand to recover oil contained in such sand, provided that "well" does not mean a hole drilled or bored, or being drilled or bored, into the earth, whether for the purpose of, or whether used for, producing or extracting potable water to be used as such. See Ohio Code 1571.01

  • Well: means any excavation, regardless of design or method of construction, created for any of the following purposes:

    (1) Removing ground water from or recharging water into an aquifer, excluding subsurface drainage systems installed to enhance agricultural crop production or urban or suburban landscape management or to control seepage in dams and levees;

    (2) Determining the quantity, quality, level, or movement of ground water in or the stratigraphy of an aquifer, excluding borings for instrumentation in dams, levees, or highway embankments;

    (3) Removing or exchanging heat from ground water, excluding horizontal trenches that are installed for water source heat pump systems. See Ohio Code 1521.01

  • Well field: means a contiguous land area containing two or more wells that provide water to a facility. See Ohio Code 1521.01
  • Well pad: means the area that is cleared or prepared for the drilling of one or more horizontal wells. See Ohio Code 1509.01
  • Whoever: includes all persons, natural and artificial; partners; principals, agents, and employees; and all officials, public or private. See Ohio Code 1.02
  • Wholesale distributor: means a person whose primary business involves the sale of propane to a retailer. See Ohio Code 936.01
  • Wild animal hunting preserve: means an area of land where game, captive white-tailed deer, and nonnative wildlife, other than game birds, are released and hunted as authorized by a wild animal hunting preserve license obtained under section 1533. See Ohio Code 1531.01
  • Wild animals: includes mollusks, crustaceans, aquatic insects, fish, reptiles, amphibians, wild birds, wild quadrupeds, and all other wild mammals, but does not include domestic deer. See Ohio Code 1531.01
  • Wild birds: includes game birds and nongame birds. See Ohio Code 1531.01
  • Wild quadrupeds: includes game quadrupeds and fur-bearing animals. See Ohio Code 1531.01
  • Wild river area: means an area declared a wild river area by the director of natural resources under this chapter and includes those rivers or sections of rivers that are free of impoundments and generally inaccessible except by trail, with watersheds or shorelines essentially primitive and waters unpolluted, representing vestiges of primitive America. See Ohio Code 1546.01
  • Wildlife sanctuary: means a nonprofit organization as described in section 170 of the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 935.01
  • Withdrawal area: means the proposed well or well field location or locations. See Ohio Code 1521.01
  • Withdrawal from an agricultural district: includes the explicit removal of land from an agricultural district, conversion of land in an agricultural district to use for purposes other than agricultural production, and withdrawal of land from a land retirement or conservation program to use for purposes other than agricultural production. See Ohio Code 929.01
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
