(a)  There is hereby established within the executive branch of state government and the department of human services a division of elderly affairs, effective July 1, 2011. The division shall reside within the department of human services for administrative purposes only. The head of the division shall be the director of the division of elderly affairs, appointed by and reporting directly to the governor, with the advice and consent of the senate.

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.

(b)  Effective July 1, 2019, the division of elderly affairs, as established pursuant to subsection (a) of this section, shall be henceforth referred to and renamed as the “office of healthy aging.”
