Terms Used In South Carolina Code 16-1-110

  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Statute: A law passed by a legislature.
A felony or misdemeanor provided by statute or in common law which is not assigned a classification pursuant to § 16-1-90 or 16-1-100 must be punished as provided before enactment of the classification system.
