Terms used in §§ 58-33-76 to 58-33-82, inclusive, mean:

(1) “Authorized agency,” the Department of Labor and Regulation, the attorney general, any state‘s attorney, any duly constituted criminal investigative department or agency of the United States, and any county or municipal law enforcement agency having investigative jurisdiction; and

  • Fraud: Intentional deception resulting in injury to another.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • State: when used in context signifying a jurisdiction other than the State of South Dakota, a state, the District of Columbia, a territory, commonwealth, or possession of the United States of America, or a province of the Dominion of Canada. See South Dakota Codified Laws 58-1-2

(2) “False or fraudulent claim, statement, or representation,” any act of insurance fraud as defined by § 58-33-37.
