Terms Used In South Dakota Codified Laws > Title 37 > Chapter 32

  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Person: includes natural persons, partnerships, associations, cooperative corporations, limited liability companies, and corporations. See South Dakota Codified Laws 2-14-2
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Prize: any gift, award, or other item or service of value that is different and distinct from the goods, service, or property promoted by a sponsor and requires payment to the sponsor for the prize. See South Dakota Codified Laws 37-32-1
  • Prize notice: any notice given to an individual in this state that contains a representation that the individual has won or will receive a prize and conditions receipt of such prize on payment to the sponsor for the prize. See South Dakota Codified Laws 37-32-1
  • Property: includes property, real and personal. See South Dakota Codified Laws 2-14-2
  • Solicitor: any person who represents to an individual that the individual has won or will receive a prize. See South Dakota Codified Laws 37-32-1
  • Sponsor: any person on whose behalf a solicitor gives a prize notice. See South Dakota Codified Laws 37-32-1
  • State: the State of South Dakota. See South Dakota Codified Laws 2-14-2
