(a) The commissioner of education, acting through the commissioner’s authorized agents and pursuant to regulations of the state board of education that are adopted pursuant to § 49-1-302(i), shall be responsible for inspecting and approving those child care programs subject to the state board’s jurisdiction pursuant to § 49-1-302(i).

Terms Used In Tennessee Code 49-1-1101

  • Child care: means the provision of supervision, protection and, at a minimum, the basic needs of a child or children for three (3) or more hours a day, but less than twenty-four (24) hours a day. See Tennessee Code 49-1-1102
  • Commissioner: means the chief administrative officer in charge of the department of education. See Tennessee Code 49-1-1102
  • Department: means the department of education. See Tennessee Code 49-1-1102
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
(b) The commissioner has the authority to issue certificates of approval from the department of education for those child care programs that meet the child care standards of the board, and the commissioner shall be responsible for enforcing the board’s standards for such programs.
