(a) Any person required by this chapter to be licensed who engages in real estate appraisal activity in this state without obtaining a license for the appraisal activity or who violates this chapter commits a Class A misdemeanor and shall be ineligible to obtain a license for a period of one (1) year from the date of the person’s conviction of the offense.

Terms Used In Tennessee Code 62-39-319

  • Appraisal: A determination of property value.
  • Appraisal: means the act or process of developing an opinion of value of identified real estate. See Tennessee Code 62-39-102
  • Commission: means the real estate appraiser commission established pursuant to §. See Tennessee Code 62-39-102
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
  • Real estate: means an identified parcel or tract of land, including improvements, if any. See Tennessee Code 62-39-102
  • Real estate appraiser: means a person who engages in real estate appraisal activity for a fee or other valuable consideration. See Tennessee Code 62-39-102
  • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
  • Year: means a calendar year, unless otherwise expressed. See Tennessee Code 1-3-105
(b) The board shall not deny, revoke, suspend, refuse to renew or discriminate against any applicant for membership or lack of membership in any real estate appraiser organization.
(c) No person, corporation, governmental entity, bank or other financial institution shall discriminate against any appraiser for membership or lack of membership in any appraisal organization. A violation of this subsection (c) is a Class A misdemeanor.
(d) Any attempt by any person, corporation, governmental entity, bank or other financial institution to unduly intimidate an appraiser or influence an appraiser’s report relating to market conditions or determination of value is a Class A misdemeanor.
(e) The commission shall use all available means to locate and communicate with all persons holding themselves out as appraisers.
