(a) A claimant or victim who brings an action as a trustee as described by Article 56B.402(2) and recovers compensation awarded by the attorney general may deduct from the benefits recovered on behalf of the state the reasonable expenses of the suit, including attorney’s fees, expended in pursuing the recovery for the state.
(b) The claimant or victim must justify a deduction under Subsection (a) to the attorney general in writing on a form provided by the attorney general.
