Terms Used In Texas Estates Code 1105.162
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Surety: includes a personal surety and a corporate surety. See Texas Estates Code 22.032
Instead of executing an affidavit under § 1105.201 or creating a lien under § 1105.202 when required, a personal surety may deposit the surety’s own cash or securities in the same manner as a guardian instead of pledging real property as security, subject to the provisions governing the deposits if made by a guardian.
