Terms Used In Texas Occupations Code 802.055
- Conviction: A judgement of guilt against a criminal defendant.
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
The department shall conduct a criminal background check on each applicant who submits an application for a license under this chapter and on any controlling person of the applicant. The department may, as permitted by law:
(1) examine any criminal conviction, guilty plea, or deferred adjudication of the applicant or controlling person; and
(2) obtain any criminal history or record of the applicant or controlling person.
