(a) The Texas Department of Water Resources shall furnish to the department a copy of all permit applications to store, take, or divert water.
(b) The department shall make recommendations to the Texas Department of Water Resources to protect fish and wildlife resources, including permit conditions, mitigation, and schedules of flow or releases.

- Take: except as otherwise provided by this code, means collect, hook, hunt, net, shoot, or snare, by any means or device, and includes an attempt to take or to pursue in order to take. See Texas Parks and Wildlife Code 1.101
(c) The department shall be, on its request, a full party in any hearing on an application for a permit to store, take, or divert water.
