Terms Used In Tennessee Code 8-3413
- Member: means any person included in the membership of the retirement system, as provided in chapter 35, part 1 of this title. See Tennessee Code 8-34-101
- Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
- Prior service: means service rendered prior to the date of membership in the retirement system for which credit was given under the terms of one (1) or more of the superseded systems as provided in part 6 of this chapter. See Tennessee Code 8-34-101
- Retirement: means withdrawal from membership with a retirement allowance granted under chapters 34-37 of this title. See Tennessee Code 8-34-101
- Retirement system: means the Tennessee consolidated retirement system as defined in §. See Tennessee Code 8-34-101
- Service: means service as a general employee, a teacher, a state police officer, a wildlife officer, a firefighter, a police officer, a state judge, a county judge, an attorney general, a commissioner or a county official which is paid for by an employer, and also includes service for which a former member of the general assembly is entitled to under former §. See Tennessee Code 8-34-101
- State: means the state of Tennessee. See Tennessee Code 8-34-101
Notwithstanding any provision in the Tennessee State Retirement Law to the contrary, any person, without prior service, who becomes a fulltime permanent employee on or after July 1, 1963, and is eligible for membership, shall become a member of the retirement system; provided, however, that this § 8-3413 shall not apply to any person, without prior service, who became an employee after July 1, 1949, and before July 1, 1963, and who became a member of the retirement system before July 1, 1963. It is further provided, however, that members and elected or appointed officials of the general assembly shall have the option of entering or not entering the retirement system. It is further provided that any person who has been a member of the county paid judges retirement system may elect to participate in the county paid judges retirement system if he meets the eligibility requirements set out in § 17-517, or shall have the option of not entering this retirement system by electing to participate or remain in the county paid judges retirement system.
