(a) Any medical records submitted to, or compiled by, the retirement system pursuant to this part are confidential and shall not be disclosed except as follows:

Medical advisors: means the physicians, companies, or organizations provided for in part 4 of this chapter. See Tennessee Code 8-34-101
Member: means any person included in the membership of the retirement system, as provided in chapter 35, part 1 of this title. See Tennessee Code 8-34-101
Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
Retirement: means withdrawal from membership with a retirement allowance granted under chapters 34-37 of this title. See Tennessee Code 8-34-101
Retirement system: means the Tennessee consolidated retirement system as defined in §. See Tennessee Code 8-34-101
Subpoena: A command to a witness to appear and give testimony.
(1) To the extent that the member or the member’s legal representative consents to disclosure;(2) To employees of the retirement system for the purpose of determining a member’s qualification for disability retirement;(3) To the medical advisors;(4) In compliance with a subpoena or a court order;(5) To other state or federal agencies; provided, that such agencies maintain the same level of confidentiality as that required hereunder;(6) To the comptroller of the treasury or the comptroller’s designees for the purpose of an audit of the retirement system; or(7) In any administrative proceeding or court action between the member or the member’s legal representative and the retirement system.(b) Nothing contained in this section applies to statistical medical information if such information is not identified with a particular member. Further, nothing contained in this section applies to records concerning the identity of members receiving or applying for disability retirement benefits, to the amount of benefits to which a particular member is or may be entitled to receive, nor to any other nonmedical related information unless such information is made confidential by other statute of this state.
