32B-6-503. Commission’s power to issue airport loungelicense.
(1)
Before a person may store, sell, offer for sale, furnish, or allow the consumption of an alcoholic product on its premises as an airport lounge licensee, the person shall first obtain an airport lounge license from the commission in accordance with this part.
Terms Used In Utah Code 32B-6-503
Airport lounge: means a business location:
(a)
at which an alcoholic product is sold at retail for consumption on the premises; and
(b)
that is located at an international airport or domestic airport. See Utah Code 32B-1-102
offer for sale: means a transaction, exchange, or barter whereby, for consideration, an alcoholic product is either directly or indirectly transferred, solicited, ordered, delivered for value, or by a means or under a pretext is promised or obtained, whether done by a person as a principal, proprietor, or as staff, unless otherwise defined in this title or the rules made by the commission. Premises: means a building, enclosure, or room used in connection with the storage, sale, furnishing, consumption, manufacture, or distribution, of an alcoholic product, unless otherwise defined in this title or rules made by the commission. See Utah Code 32B-1-102
Store: means to place or maintain in a location an alcoholic product. See Utah Code 32B-1-102
(2)
Subject to Subsection (3), the commission may issue an airport lounge license:
(a)
to establish airport lounge licensed premises beyond the security point at an international airport or a domestic airport; and
(b)
in the numbers the commission considers proper for the storage, sale, offer for sale, furnishing, and consumption of an alcoholic product on licensed premises operated as an airport lounge.
(3)
(a)
The commission may not issue more than 26 airport lounge licenses for an international airport at any time.
(b)
The commission may not issue a total number of domestic airport airport lounge licenses that at any time exceeds three.
