(1) |
Before any livestock or property is destroyed under Section 4-31-106, an appraisal of the fair market value of the livestock or other property shall be forwarded to the commissioner by a panel of three qualified appraisers appointed as follows:
Terms Used In Utah Code 4-31-107- Appraisal: A determination of property value.
- Commissioner: means the commissioner of agriculture and food. See Utah Code 4-1-109
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Livestock: means cattle, sheep, goats, swine, horses, mules, poultry, domesticated elk as defined in Section 4-39-102, or any other domestic animal or domestic furbearer raised or kept for profit. See Utah Code 4-1-109
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

one by the commissioner; |
(b) |
one by the owner of the livestock or other property subject to condemnation; and |
(c) |
one by the appraisers specified in Subsections (1)(a) and (b). |

After review, the commissioner shall forward the appraisal to the board of examiners described in Subsection 63G-9-201(2) together with the commissioner’s recommendation concerning the amount, if any, that should be allowed. |
(3) |
Any costs incurred in the appraisal shall be paid by the state. |
