4-39-301. Health and genetic purity requirements — Proof of source. The
department shall require:
(1) |
that each domesticated elk, including gametes, eggs, or sperm, imported into the state:
Terms Used In Utah Code 4-39-301- Department: means the Department of Agriculture and Food created in Chapter 2, Administration. See Utah Code 4-1-109
- Domesticated elk: means elk of the genus and species cervus elaphus, held in captivity and domestically raised for commercial purposes. See Utah Code 4-39-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(a) |
test negative for the red deer genetic factor; |
(b) |
be registered with gold or silver status with the North American Elk Breeders Association; or |
(c) |
come from a state which has a red deer genetic factor prevention program approved by the department; and |

(2) |
proof that the domesticated elk originates from a legal source as provided in Section 4-39-302. |
