(1) Subject to the granting of primacy as described in Section 40-11-3, the board may authorize the division to issue a permit.

Terms Used In Utah Code 40-11-5

  • Board: means the Board of Oil, Gas, and Mining. See Utah Code 40-11-1
  • Division: means the Division of Oil, Gas, and Mining. See Utah Code 40-11-1
  • Geologic carbon storage: means the permanent or short-term underground storage of carbon dioxide in a storage reservoir. See Utah Code 40-11-1
  • Permit: means a permit issued by the division and approved by the board allowing a person to operate a storage facility. See Utah Code 40-11-1
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) A person may only transfer a permit to another person with permission of the board.
(3) A person may not engage in geologic carbon storage in the state without a permit.
