(1) After proceeding pursuant to Title 63G, Chapter 4, Administrative Procedures Act, and Title 58, Chapter 1, Division of Professional Licensing Act, the division may impose administrative penalties of up to $10,000 for acts of unprofessional conduct or unlawful conduct under this chapter.

Terms Used In Utah Code 58-71-402

  • Division: means the Division of Professional Licensing created in Section 58-1-103. See Utah Code 58-1-102
  • Unlawful conduct: means the same as that term is defined in Sections 58-1-501 and 58-71-501. See Utah Code 58-71-102
  • Unprofessional conduct: means the same as that term is defined in Sections 58-1-501 and 58-71-502, and as may be further defined by division rule. See Utah Code 58-71-102
(2) Assessment of a penalty under this section does not affect any other action the division is authorized to take regarding a license issued under this chapter.
