78B-4-701. Definitions. As used in this part:
(1) |
“Breach of system security” means the same as that term is defined in Section 13-44-102. |
Terms Used In Utah Code 78B-4-701
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5

“NIST” means the National Institute for Standards and Technology in the United States Department of Commerce. |
(3) |
“PCI data security standard” means the Payment Card Industry Data Security Standard. |
(4) |
(a) |
“Person” means:
(iv) |
a joint stock company; |
(vi) |
a business trust; or |
(vii) |
any unincorporated organization. |

(b) |
“Person” includes a financial institution organized, chartered, or holding a license authorizing operation under the laws of this state, another state, or another country. |

“Personal information” means the same as that term is defined in Section 13-44-102. |
