Terms Used In Utah Code > Title 17 > Chapter 36 - Uniform Fiscal Procedures Act for Counties

  • Account holder: means a person who has, or opens, an account or profile to use a social media company's platform. See Utah Code 13-63-101
  • Addiction: means use of a social media platform that:
    (a) indicates the user's substantial preoccupation or obsession with, or the user's substantial difficulty to cease or reduce use of, the social media platform; and
    (b) causes physical, mental, emotional, developmental, or material harms to the user. See Utah Code 13-63-101
  • Administrative functions: means the same as that term is defined in Section 31A-6b-102. See Utah Code 13-64-101
  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Administrator: means the deputy state treasurer assigned by the state treasurer. See Utah Code 67-4a-102
  • Advertiser: means a person who advertises the person's product, service, or website through the use of commercial email. See Utah Code 13-65-101
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Agent: means a person who is authorized to act on behalf of an owner with respect to a digital asset. See Utah Code 13-62-101
  • Agreement: means an agreement between:
    (a) a motorboat dealer; and
    (b) 
    (i) a manufacturer; or
    (ii) a distributor. See Utah Code 13-58-102
  • Agreement administrator: means a person who provides administrative functions related to a vehicle value protection agreement. See Utah Code 13-64-101
  • Agricultural use: means a use that relates to the tilling of soil and raising of crops, or keeping or raising domestic animals. See Utah Code 15A-1-202
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Apparent owner: means a person whose name appears on the records of a holder as the owner of property held, issued, or owing by the holder. See Utah Code 67-4a-102
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Appropriation: means an allocation of money for a specific purpose. See Utah Code 17-36-3
  • Approved code: means a code, including the standards and specifications contained in the code, approved by the division under Section 15A-1-204 for use by a compliance agency. See Utah Code 15A-1-202
  • Armed forces: means the United States Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard. See Utah Code 68-3-12.5
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Automatic renewal provision: means a provision under which a service contract is renewed for one or more specified periods if:
    (a) the renewal causes the service contract to be in effect more than six months after the day of the initiation of the service contract; and
    (b) the renewal is effective unless the consumer gives notice to the seller of the consumer's intention to terminate the service contract. See Utah Code 15-10-102
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Biological sample: means any human material known to contain DNA, including tissue, blood, urine, or saliva. See Utah Code 13-60-102
  • Board: means the Utah Fire Prevention Board created in Section 53-7-203. See Utah Code 15A-1-102
  • Budget: means a plan for financial operations for a fiscal period, embodying estimates for proposed expenditures for given purposes and the means of financing the expenditures. See Utah Code 17-36-3
  • Budget period: means the fiscal period for which a budget is prepared. See Utah Code 17-36-3
  • Budgetary fund: means a fund for which a budget is required, such as those described in Section 17-36-8. See Utah Code 17-36-3
  • Building: means a structure used or intended for supporting or sheltering any use or occupancy and any improvements attached to it. See Utah Code 15A-1-202
  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Code: means :
    (a) the State Construction Code; or
    (b) an approved code. See Utah Code 15A-1-202
  • Commercial email: means an email used primarily to:
    (a) advertise or promote a commercial website, product, or service; or
    (b) solicit money, property, or personal information. See Utah Code 13-65-101
  • Commission: means the Uniform Building Code Commission created in Section 15A-1-203. See Utah Code 15A-1-202
  • company: means an entity that:
    (a) offers consumer genetic testing products or services directly to consumers; or
    (b) collects, uses, or analyzes genetic data that a consumer provides to the entity. See Utah Code 13-60-102
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Compliance agency: means :
    (a) an agency of the state or any of its political subdivisions which issues permits for construction regulated under the codes;
    (b) any other agency of the state or its political subdivisions specifically empowered to enforce compliance with the codes; or
    (c) any other state agency which chooses to enforce codes adopted under this chapter by authority given the agency under a title other than this part and 3. See Utah Code 15A-1-202
  • Construction code: means standards and specifications published by a nationally recognized code authority for use in circumstances described in Subsection 15A-1-204(1), including:
    (a) a building code;
    (b) an electrical code;
    (c) a residential one and two family dwelling code;
    (d) a plumbing code;
    (e) a mechanical code;
    (f) a fuel gas code;
    (g) an energy conservation code;
    (h) a swimming pool and spa code; and
    (i) a manufactured housing installation standard code. See Utah Code 15A-1-202
  • Consumer: includes a representative of an association subject to:
    (i) Title 57, Chapter 8, Condominium Ownership Act; or
    (ii) Title 57, Chapter 8a, Community Association Act. See Utah Code 15-10-102
  • Consumer: means an individual who is a resident of the state. See Utah Code 13-60-102
  • Contract: A legal written agreement that becomes binding when signed.
  • Control: means :
    (a) an owner or an agent has the exclusive legal authority to conduct a transaction relating to the digital asset, including by means of a private key or the use of a multi-signature arrangement the owner or agent authorizes; or
    (b) a secured party has created a smart contract which gives the secured party exclusive legal authority to conduct a transaction relating to a digital security. See Utah Code 13-62-101
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • County executive: means :Utah Code 68-3-12.5
  • County general fund: means the general fund used by a county. See Utah Code 17-36-3
  • County legislative body: means :Utah Code 68-3-12.5
  • Countywide service: means a service provided in both incorporated and unincorporated areas of a county. See Utah Code 17-36-3
  • Covered vehicle: means a vehicle that is covered under a vehicle value protection agreement. See Utah Code 13-64-101
  • Current period: means the fiscal period in which a budget is prepared and adopted. See Utah Code 17-36-3
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Deidentified data: means data that:
    (a) cannot reasonably be linked to an identifiable individual; and
    (b) possessed by a company that:
    (i) takes administrative and technical measures to ensure that the data cannot be associated with a particular consumer;
    (ii) makes a public commitment to maintain and use data in deidentified form and not attempt to reidentify data; and
    (iii) enters into legally enforceable contractual obligation that prohibits a recipient of the data from attempting to reidentify the data. See Utah Code 13-60-102
  • Department: means any functional unit within a fund which carries on a specific activity. See Utah Code 17-36-3
  • Dependent: A person dependent for support upon another.
  • Digital asset: includes :
    (i) a digital user asset; or
    (ii) a digital security. See Utah Code 13-62-101
  • Digital security: means a digital asset which constitutes a security, as that term is defined in Section 70A-8-101. See Utah Code 13-62-101
  • Digital user asset: includes an open blockchain token. See Utah Code 13-62-101
  • Director: means the director of the Division of Consumer Protection created in Section 13-2-1. See Utah Code 13-63-101
  • Distributor: means a person who:
    (a) has an agreement with a manufacturer of motorboats to distribute motorboats within this state; and
    (b) in whole or in part sells or distributes motorboats to motorboat dealers. See Utah Code 13-58-102
  • Division: means the Division of Consumer Protection created in Section 13-2-1. See Utah Code 13-63-101
  • Division: means the Division of Consumer Protection established in Section 13-2-1. See Utah Code 13-64-101
  • Division: means the Division of Consumer Protection. See Utah Code 13-65-101
  • Division: means the Division of Professional Licensing created in Section 58-1-103, except as provided in:
    (a) 4; and
    (b) Chapter 5, State Fire Code Act. See Utah Code 15A-1-102
  • DNA: means deoxyribonucleic acid. See Utah Code 13-60-102
  • DNA: means :
    (a) deoxyribonucleic acid, ribonucleic acid, and chromosomes, which may be analyzed to detect heritable diseases or conditions, including the identification of carriers, predicting risk of disease, or establishing a clinical diagnosis; or
    (b) proteins, enzymes, or other molecules associated with a genetic process, which may be modified, replaced in part or whole, superseded, or bypassed in function by a health or medical procedure. See Utah Code 13-60-203
  • Domain name: means any alphanumeric designation that is registered with or assigned by any domain name registrar, domain name registry, or other domain name registration authority as part of an electronic address on the Internet. See Utah Code 13-65-101
  • Educational entity: means a public school, an LEA, a charter school, the Utah Schools for the Deaf and Blind, a private school, a denominational school, a parochial school, a community college, a state college, a state university, or a nonprofit private postsecondary educational institution. See Utah Code 13-63-101
  • Electronic mail service provider: means a company or a service that provides routing, relaying, handling, storage, or support for email addresses and email inboxes. See Utah Code 13-65-101
  • Employer: means the same as that term is defined in Section 34A-2-103. See Utah Code 13-60-203
  • Encumbrance system: means a method of budgetary control where part of an appropriation is reserved to cover a specific expenditure by charging obligations, such as purchase orders, contracts, or salary commitments to an appropriation account. See Utah Code 17-36-3
  • Enrollee: means the same as that term is defined in Section 31A-1-301. See Utah Code 13-59-102
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Estimated revenue: means any revenue estimated to be received during the budget period in any fund for which a budget is prepared. See Utah Code 17-36-3
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Executive: when used to describe the powers, duties, or functions of a person or body elected as the county executive or a person appointed as the county manager or administrative officer, refers to:
    (a) the power and duty to carry laws and ordinances into effect and secure their due observance; and
    (b) those powers, duties, and functions that, under constitutional and statutory provisions and through long usage and accepted practice and custom at the federal and state level, have come to be regarded as belonging to the executive branch of government. See Utah Code 17-50-101
  • Executive director: means the executive director of the Department of Commerce. See Utah Code 15A-1-202
  • Express consent: means a consumer's affirmative response to a clear, meaningful, and prominent notice regarding the collection, use, or disclosure of genetic data for a specific purpose. See Utah Code 13-60-102
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Fiduciary: A trustee, executor, or administrator.
  • Finance agreement: means the same as that term is defined in Section 31A-6b-102. See Utah Code 13-64-101
  • Finance officer: means :
    (a) the county auditor or the person selected to provide accounting services for the county in accordance with Section 17-19a-205; or
    (b) notwithstanding Subsection (13)(a), for the purposes of preparing a tentative budget in a county operating under a county executive-council form of county government, the county executive. See Utah Code 17-36-3
  • Fiscal period: means the annual or biennial period for recording county fiscal operations. See Utah Code 17-36-3
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fraud: Intentional deception resulting in injury to another.
  • Fund: means an independent fiscal and accounting entity comprised of a sum of money or other resources segregated for a specific purpose or objective. See Utah Code 17-36-3
  • Fund balance: means the excess of the assets over liabilities, reserves, and contributions, as reflected by its books of account. See Utah Code 17-36-3
  • General fund: is a s defined by the Governmental Accounting Standards Board as reflected in the Uniform Accounting Manual for All Local Governments prepared by the Office of the Utah State Auditor. See Utah Code 17-36-3
  • Genetic data: includes :
    (i) raw sequence data that result from sequencing all or a portion of a consumer's extracted DNA;
    (ii) genotypic and phenotypic information obtained from analyzing a consumer's raw sequence data; and
    (iii) self-reported health information regarding a consumer's health conditions that the consumer provides to a company that the company:
    (A) uses for scientific research or product development; and
    (B) analyzes in connection with the consumer's raw sequence data. See Utah Code 13-60-102
  • Genetic procedure: means any therapy, treatment, or medical procedure that is intended to:
    (a) add, remove, alter, activate, change, or cause mutation in an individual's inherited DNA; or
    (b) replace, supersede, or bypass a normal DNA function. See Utah Code 13-60-203
  • genetic test: means the testing, detection, or analysis of an identifiable individual's DNA that results in information that is derived from the presence, absence, alteration, or mutation of an inherited gene or genes, or the presence or absence of a specific DNA marker or markers. See Utah Code 13-60-203
  • Genetic testing: means :
    (a) a laboratory test of a consumer's complete DNA, regions of DNA, chromosomes, genes, or gene products to determine the presence of genetic characteristics of the consumer; or
    (b) an interpretation of a consumer's genetic data. See Utah Code 13-60-102
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guardian: includes a person who:Utah Code 68-3-12.5
  • Header information: means information attached to an email, including:
    (a) the originating domain name;
    (b) the originating email address;
    (c) the destination;
    (d) the routing information; and
    (e) any other information that appears in the header line identifying, or purporting to identify, a person initiating the message. See Utah Code 13-65-101
  • Health benefit plan: means the same as that term is defined in Section 31A-1-301. See Utah Code 13-59-102
  • Health care insurance: means the same as that term is defined in Section 31A-1-301. See Utah Code 13-60-203
  • Health care provider: means a person licensed to provide health care under:
    (a) 2; or
    (b) Title 58, Occupations and Professions. See Utah Code 13-59-102
  • Holder: means a person obligated to hold for the account of, or to deliver or pay to, the owner property subject to this chapter. See Utah Code 67-4a-102
  • Initiate: means an act of:
    (a) originating, transmitting, or sending commercial email; or
    (b) promising, paying, or providing other consideration for another person to originate, transmit, or send a commercial email. See Utah Code 13-65-101
  • Initiator: means a person who:
    (i) originates, transmits, or sends commercial email; or
    (ii) promises, pays, or provides other consideration for another person to originate, transmit, or send a commercial email. See Utah Code 13-65-101
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Insurer: means the same as that term is defined in Section 31A-1-301. See Utah Code 13-64-101
  • Interactive computer service: includes :
    (i) a web service;
    (ii) a web system;
    (iii) a website;
    (iv) a web application; or
    (v) a web portal. See Utah Code 13-63-101
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Interfund loan: means a loan of cash from one fund to another, subject to future repayment. See Utah Code 17-36-3
  • Intestate: Dying without leaving a will.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Last completed fiscal period: means the fiscal period next preceding the current period. See Utah Code 17-36-3
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legislative: when used to describe the powers, duties, or functions of a county commission or council, refers to:
    (a) the power and duty to enact ordinances, levy taxes, and establish budgets; and
    (b) those powers, duties, and functions that, under constitutional and statutory provisions and through long usage and accepted practice and custom at the federal and state level, have come to be regarded as belonging to the legislative branch of government. See Utah Code 17-50-101
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Manufacturer: means a person engaged in the business of constructing, manufacturing, assembling, producing, or importing new motorboats for the purpose of sale or trade. See Utah Code 13-58-102
  • Membrane-covered frame structure: means a nonpressurized building with a structure composed of a rigid framework to support a tensioned membrane that provides a weather barrier. See Utah Code 15A-1-202
  • Minor: means an individual who is under the age of 18 and:
    (a) has not been emancipated as that term is defined in Section 80-7-102; or
    (b) has not been married. See Utah Code 13-63-101
  • Money order: includes an express money order and a personal money order on which the remitter is the purchaser. See Utah Code 67-4a-102
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
  • Motorboat: means the same as that term is defined in Section 73-18-2. See Utah Code 13-58-102
  • Motorboat dealer: means a person who:
    (a) is engaged in the business of buying, selling, offering for sale, or exchanging new motorboats either outright or on conditional sale, bailment, lease, chattel mortgage, or otherwise; and
    (b) has established in this state a place of business for the sale, lease, trade, or display of new motorboats. See Utah Code 13-58-102
  • Multi-signature arrangement: means a system of access control relating to a digital asset for the purposes of preventing unauthorized transactions relating to the asset, in which two or more private keys are required to conduct a transaction. See Utah Code 13-62-101
  • Municipal service: means a service not provided on a countywide basis and not accounted for in an enterprise fund, and includes police patrol, fire protection, culinary or irrigation water retail service, water conservation, local parks, sewers, sewage treatment and disposal, cemeteries, garbage and refuse collection, street lighting, airports, planning and zoning, local streets and roads, curb, gutter, and sidewalk maintenance, and ambulance service. See Utah Code 17-36-3
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nonfreely transferable security: includes a worthless security. See Utah Code 67-4a-102
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Owner: includes :
    (i) a depositor, for a deposit;
    (ii) a beneficiary, for a trust other than a deposit in trust;
    (iii) a creditor, claimant, or payee, for other property; and
    (iv) the lawful bearer of a record that may be used to obtain money, a reward, or a thing of value. See Utah Code 67-4a-102
  • Person: means :Utah Code 68-3-12.5
  • Person: means :
    (a) an individual;
    (b) an estate;
    (c) a business association;
    (d) a public corporation;
    (e) a government entity;
    (f) an agency;
    (g) a trust;
    (h) an instrumentality; or
    (i) any other legal or commercial entity. See Utah Code 67-4a-102
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Post: means content that an account holder makes available on a social media platform for other account holders or users to view. See Utah Code 13-63-101
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Preliminary period: means a time period that:
    (a) begins the day on which the vehicle value protection agreement becomes effective; and
    (b) ends the last day on which the purchaser may cancel the vehicle value protection agreement with a full refund. See Utah Code 13-64-101
  • Private genetic information: means any information about an identifiable individual that:
    (i) is derived from:
    (A) the presence, absence, alteration, or mutation of an inherited gene or genes; or
    (B) the presence or absence of a specific DNA marker or markers; and
    (ii) has been obtained:
    (A) from a genetic test or analysis of the individual's DNA;
    (B) from a genetic test or analysis of the DNA of a blood relative of the individual; or
    (C) from a genetic procedure. See Utah Code 13-60-203
  • Private key: means a unique element of cryptographic data, which is:
    (a) held by a person;
    (b) paired with a unique, publicly available element of cryptographic data; and
    (c) associated with an algorithm that is necessary to carry out an encryption or decryption required to execute a transaction. See Utah Code 13-62-101
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Property: includes :
    (i) all income from or increments to the property;
    (ii) property referred to as or evidenced by:
    (A) money, virtual currency, interest, or a dividend, check, draft, or deposit;
    (B) a credit balance, customer's overpayment, stored-value card, payroll card, security deposit, refund, credit memorandum, unpaid wage, unused ticket for which the issuer has an obligation to provide a refund, mineral proceeds, or unidentified remittance; and
    (C) a security except for:
    (I) a worthless security; or
    (II) a security that is subject to a lien, legal hold, or restriction evidenced on the records of the holder or imposed by operation of law, if the lien, legal hold, or restriction restricts the holder's or owner's ability to receive, transfer, sell, or otherwise negotiate the security;
    (iii) a bond, debenture, note, or other evidence of indebtedness;
    (iv) money deposited to redeem a security, make a distribution, or pay a dividend;
    (v) an amount due and payable under an annuity contract or insurance policy;
    (vi) an amount distributable from a trust or custodial fund established under a plan to provide health, welfare, pension, vacation, severance, retirement, death, stock purchase, profit-sharing, employee-savings, supplemental-unemployment insurance, or a similar benefit; and
    (vii) an amount held under a preneed funeral or burial contract, other than a contract for burial rights or opening and closing services, where the contract has not been serviced following the death or the presumed death of the beneficiary. See Utah Code 67-4a-102
  • Provider: means a person who is obligated to provide a benefit to another person under a vehicle value protection agreement. See Utah Code 13-64-101
  • Purchaser: means a person who purchases a benefit from another person under a vehicle value protection agreement. See Utah Code 13-64-101
  • real property: includes :Utah Code 68-3-12.5
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Recipient: means an addressee of an unsolicited email. See Utah Code 13-65-101
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Utah Code 67-4a-102
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Retained earnings: means that part of the net earnings retained by an enterprise or internal service fund which is not segregated or reserved for any specific purpose. See Utah Code 17-36-3
  • Routine conveyance: means an Internet service provider's or email provider's automatic electronic mail message processes, including routing, relaying, handling, or storing through an automatic technical process, for which a person other than the Internet service provider or email provider has identified the electronic mail message recipients and provided the recipients' addresses. See Utah Code 13-65-101
  • Security: means the same as that term is defined in Section 31A-1-301. See Utah Code 13-64-101
  • Security: means :
    (a) a security as defined in Revised Article 8 of the Uniform Commercial Code; or
    (b) a security entitlement as defined in Revised Article 8 of the Uniform Commercial Code, including a customer security account held by a registered broker-dealer, to the extent the financial assets held in the security account are not:
    (i) registered on the books of the issuer in the name of the person for which the broker-dealer holds the assets;
    (ii) payable to the order of the person;
    (iii) specifically endorsed to the person; or
    (iv) an equity interest in a business association not included in this Subsection (32). See Utah Code 67-4a-102
  • Seller: means a person providing service, maintenance, or repair under a service contract. See Utah Code 15-10-102
  • Service contract: means a contract for service, maintenance, or repair:
    (i) in connection with real property; or
    (ii) that provides a benefit to the real property. See Utah Code 15-10-102
  • Service of process: The service of writs or summonses to the appropriate party.
  • Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
  • Social media company: means a person or entity that:
    (a) provides a social media platform that has at least 5,000,000 account holders worldwide; and
    (b) is an interactive computer service. See Utah Code 13-63-101
  • Social media platform: means an online forum that a social media company makes available for an account holder to:
    (i) create a profile;
    (ii) upload posts;
    (iii) view the posts of other account holders; and
    (iv) interact with other account holders or users. See Utah Code 13-63-101
  • Special fund: means any fund other than the county general fund, such as those described in Section 17-36-6. See Utah Code 17-36-3
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • State: means a state of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Utah Code 67-4a-102
  • State Construction Code: means the State Construction Code adopted by:
    (a) Chapter 2, Adoption of State Construction Code;
    (b) Chapter 2a, Tall Wood Buildings of Mass Timber Construction Incorporated as Part of State Construction Code;
    (c) Chapter 3, Statewide Amendments Incorporated as Part of State Construction Code;
    (d) Chapter 4, Local Amendments Incorporated as Part of State Construction Code; and
    (e) Chapter 6, Additional Construction Requirements. See Utah Code 15A-1-102
  • State Fire Code: means the State Fire Code adopted by Chapter 5, State Fire Code Act. See Utah Code 15A-1-102
  • Statute: A law passed by a legislature.
  • Testator: A male person who leaves a will at death.
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Unappropriated surplus: means that part of a fund which is not appropriated for an ensuing budget period. See Utah Code 17-36-3
  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Unsolicited commercial email: means a commercial email sent by an advertiser to a recipient that:
    (a) has not provided direct consent to the advertiser to receive the commercial email; and
    (b) does not have a preexisting or current relationship with the advertiser. See Utah Code 13-65-101
  • User: means a person who has access to view all, or some of, the posts on a social media platform, but is not an account holder. See Utah Code 13-63-101
  • Utah account holder: includes a Utah minor account holder. See Utah Code 13-63-101
  • Utah Code: means the 1953 recodification of the Utah Code, as amended, unless the text expressly references a portion of the 1953 recodification of the Utah Code as it existed:Utah Code 68-3-12.5
  • Utah email address: means an email address that is:
    (a) provided by an electronic mail service provider that sends bills for providing and maintaining that email address to a mailing address in this state;
    (b) ordinarily accessed from a computer located in this state; or
    (c) provided to an individual who is currently a resident of this state. See Utah Code 13-65-101
  • Utah minor account holder: means a Utah account holder who is a minor. See Utah Code 13-63-101
  • Utah resident: means an individual who currently resides in Utah. See Utah Code 13-63-101
  • Vehicle: means the same as that term is defined in Section 31A-6b-102. See Utah Code 13-64-101
  • Vehicle value protection agreement: includes :
    (i) a vehicle trade-in agreement;
    (ii) a vehicle diminished value agreement;
    (iii) a vehicle cash down payment protection agreement; and
    (iv) a vehicle depreciation benefit agreement. See Utah Code 13-64-101
