Terms Used In Utah Code > Title 20A > Chapter 21 - Electronic Signature Gathering

  • Address: includes :
    (i) a post office box number;
    (ii) a rural free delivery route number; and
    (iii) a street name and number. See Utah Code 16-10a-102
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Approved device: means a device described in Subsection 20A-21-201(4). See Utah Code 20A-21-101
  • Articles of incorporation: include :
    (a) amended and restated articles of incorporation;
    (b) articles of merger; and
    (c) a document of a similar import to those described in Subsections (4)(a) and (b). See Utah Code 16-10a-102
  • Ballot: means the storage medium, including a paper, mechanical, or electronic storage medium, that records an individual voter's vote. See Utah Code 20A-1-102
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bylaws: includes amended bylaws and restated bylaws. See Utah Code 16-10a-102
  • Candidate qualification process: means the process, described in Section 20A-9-403 or 20A-9-408, of gathering signatures to seek the nomination of a registered political party. See Utah Code 20A-21-101
  • Career and technical education course: means a concurrent enrollment course in career and technical education, as determined by the policy established by the Utah Board of Higher Education under Section 53E-10-302. See Utah Code 53E-10-301
  • Concurrent enrollment: means enrollment in a course offered through the concurrent enrollment program described in Section 53E-10-302. See Utah Code 53E-10-301
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporate name: means :
    (a) the name of a domestic corporation or a domestic nonprofit corporation as stated in its articles of incorporation; or
    (b) the name of a foreign corporation or a foreign nonprofit corporation as stated in its articles of incorporation or document of similar import. See Utah Code 16-10a-102
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Deliver: includes delivery by mail or another means of transmission authorized by Section 16-10a-103, except that delivery to the division means actual receipt by the division. See Utah Code 16-10a-102
  • Distribution: means the following by a corporation to or for the benefit of its shareholders in respect of any of the corporation's shares:
    (i) a direct or indirect transfer of money or other property, other than a corporation's own shares; or
    (ii) incurrence of indebtedness by the corporation. See Utah Code 16-10a-102
  • Division: means the Division of Corporations and Commercial Code. See Utah Code 16-10a-102
  • domestic corporation: means a corporation for profit that:
    (a) is not a foreign corporation; and
    (b) is incorporated under or subject to this chapter. See Utah Code 16-10a-102
  • Election: means a regular general election, a municipal general election, a statewide special election, a local special election, a regular primary election, a municipal primary election, and a special district election. See Utah Code 20A-1-102
  • Election officer: means :
    (a) the lieutenant governor, for all statewide ballots and elections;
    (b) the county clerk for:
    (i) a county ballot and election; and
    (ii) a ballot and election as a provider election officer as provided in Section 20A-5-400. See Utah Code 20A-1-102
  • Electronic candidate qualification process: means the same as that term is defined in Section 20A-9-101. See Utah Code 20A-21-101
  • Electronic initiative process: means the same as that term is defined in Section 20A-7-101. See Utah Code 20A-21-101
  • Electronic referendum process: means the same as that term is defined in Section 20A-7-101. See Utah Code 20A-21-101
  • Electronic signature: means an electronic sound, symbol, or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign the record. See Utah Code 20A-1-102
  • electronically transmitted: means a process of communication not directly involving the physical transfer of paper that is suitable for the receipt, retention, retrieval, and reproduction of information by the recipient, whether by e-mail, facsimile, or otherwise. See Utah Code 16-10a-102
  • Eligible instructor: means an instructor who meets the requirements described in Subsection 53E-10-302(6). See Utah Code 53E-10-301
  • Eligible student: means a student who:
    (a) 
    (i) is enrolled in, and counted in average daily membership in, a public school within the state; or
    (ii) is in the custody of the Division of Juvenile Justice Services and subject to the jurisdiction of the Youth Parole Authority;
    (b) has on file a plan for college and career readiness as described in Section 53E-2-304; and
    (c) is in grade 9, 10, 11, or 12. See Utah Code 53E-10-301
  • Employee: includes an officer but not a director, unless the director accepts a duty that makes that director also an employee. See Utah Code 16-10a-102
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entity: includes :
    (a) a domestic and foreign corporation;
    (b) a nonprofit corporation;
    (c) a limited liability company;
    (d) a profit or nonprofit unincorporated association;
    (e) a business trust;
    (f) an estate;
    (g) a partnership;
    (h) a trust;
    (i) two or more persons having a joint or common economic interest;
    (j) a state;
    (k) the United States; and
    (l) a foreign government. See Utah Code 16-10a-102
  • Fiduciary: A trustee, executor, or administrator.
  • Foreign corporation: means a corporation for profit incorporated under a law other than the law of this state. See Utah Code 16-10a-102
  • Governmental subdivision: means :
    (a) county;
    (b) municipality; or
    (c) another type of governmental subdivision authorized by the laws of this state. See Utah Code 16-10a-102
  • Individual: means :
    (a) a natural person;
    (b) the estate of an incompetent individual; or
    (c) the estate of a deceased individual. See Utah Code 16-10a-102
  • Institution of higher education: means an institution described in Subsection 53B-1-102(1)(a). See Utah Code 53E-10-301
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • LEA: means a school district or charter school. See Utah Code 53E-10-301
  • Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
  • Local school board: means a board elected under 2. See Utah Code 53E-1-102
  • Manual candidate qualification process: means the same as that term is defined in Section 20A-9-101. See Utah Code 20A-21-101
  • Notice: is a s provided in Section 16-10a-103. See Utah Code 16-10a-102
  • Parent: means a parent or legal guardian. See Utah Code 53E-1-102
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means :Utah Code 68-3-12.5
  • Petition: means :
    (a) as it relates to the electronic initiative process or the electronic referendum process, the electronic record that an individual signs to indicate the individual is in favor of placing the initiative or referendum on the ballot; or
    (b) as it relates to electronic candidate qualification process, the electronic record that an individual signs to indicate the individual is in favor of placing an individual's name on the ballot to run for a particular elective office. See Utah Code 20A-21-101
  • Political party: means an organization of registered voters that has qualified to participate in an election by meeting the requirements of Chapter 8, Political Party Formation and Procedures. See Utah Code 20A-1-102
  • Principal office: means the office, in or out of this state, designated by a domestic or foreign corporation as its principal office in the most recent document on file with the division providing the information, including:
    (a) an annual report;
    (b) an application for a certificate of authority; or
    (c) a notice of change of principal office. See Utah Code 16-10a-102
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Receive: when used in reference to receipt of a writing or other document by a domestic or foreign corporation, means the writing or other document is actually received by:
    (a) the corporation at its:
    (i) registered office in this state; or
    (ii) principal office;
    (b) the secretary of the corporation, wherever the secretary is found; or
    (c) another person authorized by the bylaws or the board of directors to receive the writing or other document, wherever that person is found. See Utah Code 16-10a-102
  • Record date: means the date established under 6, or 7, on which a corporation determines the identity of its shareholders. See Utah Code 16-10a-102
  • Registered office: means the office within this state designated by a domestic or foreign corporation as its registered office in the most recent document on file with the division providing that information, including:
    (a) articles of incorporation;
    (b) an application for a certificate of authority; or
    (c) a notice of change of registered office. See Utah Code 16-10a-102
  • Resident: means a person who resides within a specific voting precinct in Utah. See Utah Code 20A-1-102
  • Secretary: means the corporate officer to whom the bylaws or the board of directors delegates responsibility under Subsection 16-10a-830(3) for:
    (a) the preparation and maintenance of:
    (i) minutes of the meetings of the board of directors and of the shareholders; and
    (ii) the other records and information required to be kept by the corporation by Section 16-10a-830; and
    (b) authenticating records of the corporation. See Utah Code 16-10a-102
  • Share: means the unit into which the proprietary interests in a corporation are divided. See Utah Code 16-10a-102
  • Shareholder: means :
    (i) the person in whose name a share is registered in the records of a corporation; or
    (ii) the beneficial owner of a share to the extent recognized pursuant to Section 16-10a-723. See Utah Code 16-10a-102
  • Signature: means :
    (a) as it relates to a signature gathered for an initiative or referendum, the same as that term is defined in Section 20A-7-101; or
    (b) as it relates to a signature gathered for the candidate qualification process, the same as that term is defined in Section 20A-9-101. See Utah Code 20A-21-101
  • Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • State board: means the State Board of Education. See Utah Code 53E-1-102
  • State superintendent: means the state superintendent of public instruction appointed under Section 53E-3-301. See Utah Code 53E-1-102
  • Tribe: means a tribe, band, nation, pueblo, or other organized group or community of Indians, including an Alaska Native village, that is legally recognized as eligible for and is consistent with a special program, service, or entitlement provided by the United States to Indians because of their status as Indians. See Utah Code 16-10a-102
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Valid voter identification: means :
    (a) a form of identification that bears the name and photograph of the voter which may include:
    (i) a currently valid Utah driver license;
    (ii) a currently valid identification card that is issued by:
    (A) the state; or
    (B) a branch, department, or agency of the United States;
    (iii) a currently valid Utah permit to carry a concealed weapon;
    (iv) a currently valid United States passport; or
    (v) a currently valid United States military identification card;
    (b) one of the following identification cards, whether or not the card includes a photograph of the voter:
    (i) a valid tribal identification card;
    (ii) a Bureau of Indian Affairs card; or
    (iii) a tribal treaty card; or
    (c) two forms of identification not listed under Subsection (76)(a) or (b) but that bear the name of the voter and provide evidence that the voter resides in the voting precinct, which may include:
    (i) a current utility bill or a legible copy thereof, dated within the 90 days before the election;
    (ii) a bank or other financial account statement, or a legible copy thereof;
    (iii) a certified birth certificate;
    (iv) a valid social security card;
    (v) a check issued by the state or the federal government or a legible copy thereof;
    (vi) a paycheck from the voter's employer, or a legible copy thereof;
    (vii) a currently valid Utah hunting or fishing license;
    (viii) certified naturalization documentation;
    (ix) a currently valid license issued by an authorized agency of the United States;
    (x) a certified copy of court records showing the voter's adoption or name change;
    (xi) a valid Medicaid card, Medicare card, or Electronic Benefits Transfer Card;
    (xii) a currently valid identification card issued by:
    (A) a local government within the state;
    (B) an employer for an employee; or
    (C) a college, university, technical school, or professional school located within the state; or
    (xiii) a current Utah vehicle registration. See Utah Code 20A-1-102
  • Value of the weighted pupil unit: means the amount established each year in the enacted public education budget that is multiplied by the number of weighted pupil units to yield the funding level for the basic state-supported school program. See Utah Code 53E-10-301
  • Voter: means an individual who:
    (a) meets the requirements for voting in an election;
    (b) meets the requirements of election registration;
    (c) is registered to vote; and
    (d) is listed in the official register book. See Utah Code 20A-1-102
  • Voting group: means all shares of one or more classes or series that under the articles of incorporation or this chapter are entitled to vote and be counted together collectively on a matter at a meeting of shareholders. See Utah Code 16-10a-102
  • Website: means :
    (a) as it relates to the electronic initiative process or the electronic referendum process, the website designated by the lieutenant governor for collecting the signatures and other information relating to the electronic initiative process or the electronic referendum process; or
    (b) as it relates to the electronic candidate qualification process, a website designated by the lieutenant governor for collecting the signatures and other information relating to the electronic candidate qualification process. See Utah Code 20A-21-101
