Terms Used In Vermont Statutes Title 18 Sec. 9316

  • Commissioner: means the Commissioner of Disabilities, Aging, and Independent Living. See
  • Guardianship: means the legal status of a person with developmental disabilities who is subject to the Commissioner's exercise of some or all of the powers listed in section 9310 of this title. See
  • Interested person: means a responsible adult who has a direct interest in a person with developmental disabilities and includes the person with developmental disabilities, a near relative, guardian, public official, social worker, or clergy. See
  • Person: means any individual, company, corporation, association, partnership, the U. See
  • Person with developmental disabilities: means :

  • Probate: Proving a will
  • Respondent: means a person who is the subject of a petition filed pursuant to section 9305 of this title. See

§ 9316. Modification or termination of guardianship services

(a) The Commissioner shall provide guardianship services in accordance with the order of the Probate Division or Family Division of the Superior Court until termination or modification thereof by the court.

(b) The Commissioner, the person with developmental disabilities, or any interested person may petition the appointing court, if it exists, or the Superior Court for the unit where the person resides to modify or terminate the judgment pursuant to which the Commissioner is providing guardianship. The petitioner, or the Commissioner as petitioner, and the respondent shall be the parties to an application to modify or terminate guardianship.
