  • handler: is a person, firm, unincorporated association, or corporation engaged in the business of buying, selling, assembling, packaging, or processing milk or other dairy products for sale within the State of Vermont or outside the State. See
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Secretary: means Secretary of Agriculture, Food and Markets or his or her authorized agent. See

§ 2705. Revocation of licenses

(a) The Secretary may after due notice and hearing revoke a handler‘s license if after due investigation made by the Secretary the handler is deemed to be in violation of any provisions of this part or the rules adopted under this part. The Secretary is charged with the administration and enforcement of this part.

(b) If the Secretary is unable to secure compliance with the provisions of this part and the rules adopted under this part, the Secretary shall report the matter to the Attorney General, together with all relevant information. Except as provided in section 2881 of this title, the Attorney General shall take such action as the public interest requires, including injunctions or prosecution in any court of competent jurisdiction.
