Terms Used In Virginia Code > Title 51.1 > Chapter 11.1 - Disability Program for Hybrid Retirement Program Participants

  • Act: means the Virginia Workers' Compensation Act (§ 65. See Virginia Code 51.1-1150
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Board of supervisors: means the governing body of a county. See Virginia Code 15.2-102
  • Company: means an insurance company issuing a long-term disability insurance policy purchased by the Board pursuant to this chapter. See Virginia Code 51.1-1150
  • Continuous service: means an uninterrupted period of service as a participating employee with the same employer. See Virginia Code 51.1-1150
  • Council: means the State Council of Higher Education for Virginia. See Virginia Code 23.1-100
  • County: means any existing county or such unit hereafter created. See Virginia Code 15.2-102
  • Disability: means a partial disability or total disability. See Virginia Code 51.1-1150
  • Disability benefit: means income replacement payments payable to a participating employee under a short-term or long-term disability benefit program pursuant to this chapter. See Virginia Code 51.1-1150
  • Docket: A log containing brief entries of court proceedings.
  • Eligible employee: means a person who is (i) not eligible for the disability program pursuant to Chapter 11 (§ 51. See Virginia Code 51.1-1150
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Governing body: means the board of supervisors of a county, council of a city, or council of a town, as the context may require. See Virginia Code 15.2-102
  • local government: shall be construed to mean a county, city, or town as the context may require. See Virginia Code 15.2-102
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partial disability: means a disability that exists during the first 24 months following the occurrence or commencement of an illness or injury when an employee is earning less than 80 percent of his predisability earnings and, as a result of an injury or illness, is (i) able to perform one or more, but not all, of the essential job functions of his own job on an active employment or a part-time basis; or (ii) able to perform all of the essential job functions of his own job only on a part-time basis. See Virginia Code 51.1-1150
  • Participating employee: means any eligible employee required to participate in the program. See Virginia Code 51.1-1150
  • Postsecondary school: includes programs of academic, vocational, and continuing professional education, except courses or programs of continuing professional education set forth in subdivision B 4 of § 23. See Virginia Code 23.1-213
  • Program: means a curriculum or course of study in a discipline or interdisciplinary area that leads to a degree or certificate. See Virginia Code 23.1-213
  • Program: means the program providing short-term disability and long-term disability benefits for participating employees established pursuant to this chapter. See Virginia Code 51.1-1150
  • Qualified education loan: means any qualified education loan obtained specifically to finance education or other school-related expenses. See Virginia Code 23.1-231
  • Qualified education loan borrower: means (i) any current resident of the Commonwealth who has received or agreed to pay a qualified education loan or (ii) any person who shares responsibility with such resident for repaying the qualified education loan. See Virginia Code 23.1-231
  • Service: means a period of service as a participating employee. See Virginia Code 51.1-1150
  • Servicing: means (i) receiving any scheduled periodic payments from a qualified education loan borrower pursuant to the terms of a qualified education loan; (ii) applying the payments of principal and interest and such other payments, with respect to the amounts received from a qualified education loan borrower, as may be required pursuant to the terms of a qualified education loan; and (iii) performing other administrative services with respect to a qualified education loan. See Virginia Code 23.1-231
  • Teachout plan: means a written agreement between or among postsecondary schools that provides for the equitable treatment of students if one party to the agreement ceases to offer an educational program before all students enrolled in that program complete the program. See Virginia Code 23.1-213
  • Total disability: means a disability that exists (i) during the first 24 months following the occurrence or commencement of an illness or injury if an employee is unable to perform all of his essential job functions or (ii) after 24 months following the occurrence or commencement of an illness or injury if an employee is unable to perform any job for which he is reasonably qualified based on his training or experience and earning less than 80 percent of his predisability earnings.   • Town: means any existing town or an incorporated community within one or more counties which became a town before noon, July one, nineteen hundred seventy-one, as provided by law or which has within defined boundaries a population of 1,000 or more and which has become a town as provided by law. See Virginia Code 15.2-102
  • Work-related injury: means an injury, as such term is defined in § 65. See Virginia Code 51.1-1150
