Terms Used In West Virginia Code > Chapter 17C > Article 25 - Aviation Related Offenses

  • Aeronautics: means the art and science of flight including, but not limited to, transportation by aircraft. See West Virginia Code 17C-25-1
  • Aircraft: means any contrivance now known, or hereafter invented, used or designed for navigation of or flight in the air. See West Virginia Code 17C-25-1
  • Airport: means any area of land or water which is used, or intended for use, for the landing and takeoff of aircraft and any appurtenant areas which are used, or intended for use, for airport buildings or other airport facilities or rights-of-way, together with all airport buildings and facilities located thereon. See West Virginia Code 17C-25-1
  • Arrest: Taking physical custody of a person by lawful authority.
  • Controlled substance: has the meaning ascribed to it in chapter 60A of this code. See West Virginia Code 17C-25-1
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Law-enforcement officer: means : (1) Any member of the State Police. See West Virginia Code 17C-25-1
  • navigation: means the operation or navigation of aircraft in the air space over this state, or upon any airport within this state. See West Virginia Code 17C-25-1
  • Offense: includes every act or omission for which a fine, forfeiture, or punishment is imposed by law. See West Virginia Code 2-2-10
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means any individual, firm, partnership, corporation, company, association, joint stock association, or body politic, and includes any trustee, receiver, assignee, or other similar representative thereof. See West Virginia Code 17C-25-1
  • Political subdivision: means any county, city, town, village, or other political subdivision of this state. See West Virginia Code 17C-25-1
  • State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
  • Statute: A law passed by a legislature.
  • Testify: Answer questions in court.
  • Town: includes a city, village or town, and the word "council" any body or board, whether composed of one or more branches, which is authorized to make ordinances for the government of a city, town, or village. See West Virginia Code 2-2-10
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • Venue: The geographical location in which a case is tried.
