Terms Used In West Virginia Code > Chapter 21 > Article 5D - The Parental Leave Act

  • Commission: means the occupational safety and health review commission established under this article. See West Virginia Code 21-3A-2
  • Commissioner: means the commissioner of the department of labor. See West Virginia Code 21-5D-2
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • daughter: means an individual who is a biological, adopted or foster child, a stepchild or a legal ward, and is (1) under eighteen years of age. See West Virginia Code 21-5D-2
  • Dependent: means any person who is living with or dependent upon the income of any employee whether related by blood or not. See West Virginia Code 21-5D-2
  • Dependent: A person dependent for support upon another.
  • Employee: means any individual, hired for permanent employment, who has worked for at least twelve consecutive weeks performing services for remuneration within this state for any department, division, board, bureau, agency, commission or other unit of state government, or any county board of education in the state. See West Virginia Code 21-5D-2
  • Employer: includes any department, division, board, bureau, agency, commission or other unit of state government and any county board of education in the state. See West Virginia Code 21-5D-2
  • Employment benefits: means all benefits, other than salary or wages, provided or made available to employees by an employer, and includes group life insurance, health insurance, disability insurance, sick leave, annual leave, educational benefits and pensions, regardless of whether such benefits are provided by a policy or practice of an employer or by an employee benefit plan as defined in the federal Employee Retirement Income Security Act of 1974. See West Virginia Code 21-5D-2
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Health care provider: means a person, partnership, corporation, facility or institution licensed, certified or authorized by law to provide professional health care services in this state to an individual during this individual'. See West Virginia Code 21-5D-2
  • health care services: means clinically related preventive, diagnostic, treatment or rehabilitative services whether provided in the home, office, hospital, clinic or any other suitable place, provided or prescribed by any health care provider or providers. See West Virginia Code 21-5D-2
  • Parent: means a biological, foster or adoptive parent, a stepparent or a legal guardian. See West Virginia Code 21-5D-2
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means one or more individuals. See West Virginia Code 21-3A-2
  • Serious health condition: means a physical or mental illness, injury or impairment which involves:

    (1) Inpatient care in a hospital, hospice or residential health care facility. See West Virginia Code 21-5D-2

  • Spouse: means any person legally married to an "employee" covered under this article. See West Virginia Code 21-5D-2
  • State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
