  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Administratively linked community and technical college: means a state institution of higher education delivering community and technical college education and programs which has maintained a contractual agreement to receive essential services from another accredited state institution of higher education prior to July 1, 2008. See West Virginia Code 18B-1-2
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • approval: when used in reference to action by the commission or the council, means action in which the governance rationale of a governing board under its jurisdiction is given due consideration, and the action of the commission is to additionally establish whether the proposed institutional action is consistent with law and established policy and is an appropriate advancement of the public interest. See West Virginia Code 18B-1-2
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • boards: means the institutional boards of governors created by §. See West Virginia Code 18B-1-2
  • brokering: means serving as an agent on behalf of students, employers, communities, or responsibility areas to obtain education services not offered at that institution. See West Virginia Code 18B-1-2
  • Chancellor: means the Chancellor for Higher Education where the context refers to a function of the Higher Education Policy Commission. See West Virginia Code 18B-1-2
  • Chancellor for Community and Technical College Education: means the chief executive officer of the West Virginia Council for Community and Technical College Education employed pursuant to §. See West Virginia Code 18B-1-2
  • Collaboration: means entering into an agreement with one or more providers of education services in order to enhance the scope, quality, or efficiency of education services. See West Virginia Code 18B-1-2
  • commission: means the commission created by §. See West Virginia Code 18B-1-2
  • Community and technical college education: means the programs, faculty, administration, and funding associated with the delivery of community and technical college education programs. See West Virginia Code 18B-1-2
  • community and technical college network: means the state institutions of higher education under the jurisdiction of the West Virginia Council for Community and Technical College Education which are independently accredited, each governed by its own independent governing board, and each having a core mission of providing affordable access to and delivering high quality community and technical education in every region of the state. See West Virginia Code 18B-1-2
  • Council: means the West Virginia Council for Community and Technical College Education created by §. See West Virginia Code 18B-1-2
  • Essential conditions: means those conditions which shall be met by community and technical colleges as provided in §. See West Virginia Code 18B-1-2
  • Ex officio: Literally, by virtue of one's office.
  • faculty rank: means the position held by a faculty member as determined by the president, consistent with a rule promulgated and adopted by the governing board, and includes the positions of professor, associate professor, assistant professor and instructor. See West Virginia Code 18B-8-1
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Fiduciary: A trustee, executor, or administrator.
  • Forbearance: A means of handling a delinquent loan. A
  • Full-time faculty: means a faculty member so designated by the president, consistent with the duly promulgated and adopted rule of the appropriate governing board, and those persons with faculty rank who have research or administrative responsibilities. See West Virginia Code 18B-8-1
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Independent community and technical college: means a state institution of higher education under the jurisdiction of the council, which is independently accredited, is governed by its own independent governing board, and may not be operated as a branch or off-campus location of any other state institution of higher education. See West Virginia Code 18B-1-2
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • operating budget: means for any fiscal year an institution's total unrestricted education and general funding from all sources, including, but not limited to, tuition and fees and legislative appropriation, and any adjustments to that funding as approved by the commission or council based on comparisons with peer institutions or to reflect consistent components of peer operating budgets. See West Virginia Code 18B-1-2
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • real property: include lands, tenements and hereditaments, all rights thereto and interests therein, except chattel interests. See West Virginia Code 2-2-10
  • rules: means a regulation, standard, policy, or interpretation of general application and future effect. See West Virginia Code 18B-1-2
  • Salary: means the total nine-month or ten-month salary paid from state funds to a full-time faculty member, or if the employment period is other than nine or ten months, the total salary adjusted to a nine-month base salary. See West Virginia Code 18B-8-1
  • senior administrator: means vice chancellor for administration. See West Virginia Code 18B-1-2
  • Sponsoring institution: means a state institution of higher education that maintained an administrative link to a community and technical college providing essential services prior to July 1, 2008. See West Virginia Code 18B-1-2
  • State college and university: means Bluefield State College, Concord University, Fairmont State University, Glenville State College, Shepherd University, West Liberty University, or West Virginia State University. See West Virginia Code 18B-1-2
  • State institution of higher education: means any university, college, or community and technical college under the jurisdiction of a governing board as that term is defined in this section. See West Virginia Code 18B-1-2
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Vice chancellor for administration: means the person employed in accordance with §. See West Virginia Code 18B-1-2
