- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
If the defendant shall refuse or neglect to deliver over such books or papers pursuant to the demand the defendant is guilty of a misdemeanor, and the same proceedings shall be had and with the same effect to compel the delivery of such books and papers as are provided by law.
