Terms Used In Wisconsin Statutes > Chapter 101 > Subchapter VII

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Common motor carrier: means any person who holds himself or herself out to the public as willing to undertake for hire to transport passengers or property by motor vehicle upon the public highways. See Wisconsin Statutes 101.922
  • Contract: A legal written agreement that becomes binding when signed.
  • Contract motor carrier: means any person engaged in the transportation by motor vehicle over a regular or irregular route upon the public highways of property for hire, including the transportation of buildings, as defined in s. See Wisconsin Statutes 101.922
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the department of transportation. See Wisconsin Statutes 101.922
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Following: when used by way of reference to any statute section, means the section next following that in which the reference is made. See Wisconsin Statutes 403.504
  • Fraud: Intentional deception resulting in injury to another.
  • Gross weight: when applied to a motor vehicle used for the transportation of passengers, shall mean the actual weight of the motor vehicle unloaded plus 150 pounds for each person capable of being seated in the motor vehicle. See Wisconsin Statutes 101.922
  • in writing: includes any representation of words, letters, symbols or figures. See Wisconsin Statutes 403.504
  • Motor vehicle: means any automobile, truck, trailer, semitrailer, tractor, motor bus, or any self-propelled or motor driven vehicle, except a motorcycle, moped, motor bicycle, electric personal assistive mobility device, personal delivery device, or vehicle operated on rails. See Wisconsin Statutes 101.922
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means and includes any individual, firm, partnership, limited liability company, corporation, company, association, including express and forwarding companies or agencies and railroad companies, or their lessees, trustees or receivers. See Wisconsin Statutes 101.922
  • Person: includes all partnerships, associations and bodies politic or corporate. See Wisconsin Statutes 403.504
  • Preceding: when used by way of reference to any statute section, means the section next preceding that in which the reference is made. See Wisconsin Statutes 403.504
  • Private motor carrier: means any person who provides transportation of property or passengers by commercial motor vehicle, as defined in Wisconsin Statutes 101.922
  • Promulgate: when used in connection with a rule, as defined under s. See Wisconsin Statutes 403.504
  • Property: includes real and personal property. See Wisconsin Statutes 403.504
  • Qualified: when applied to any person elected or appointed to office, means that such person has done those things which the person was by law required to do before entering upon the duties of the person's office. See Wisconsin Statutes 403.504
  • Secretary: means the secretary of transportation. See Wisconsin Statutes 101.922
  • Service of process: The service of writs or summonses to the appropriate party.
  • State: when applied to states of the United States, includes the District of Columbia, the commonwealth of Puerto Rico and the several territories organized by Congress. See Wisconsin Statutes 403.504
  • Statute: A law passed by a legislature.
  • Village: means incorporated village. See Wisconsin Statutes 403.504
  • Year: means a calendar year, unless otherwise expressed; "year" alone means "year of our Lord". See Wisconsin Statutes 403.504
