Terms Used In Iowa Code > Chapter 357A - Rural Water Service Providers

  • Allegation: something that someone says happened.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • association: means a rural water association organized and incorporated as a cooperative association under chapter 499 or as a nonprofit corporation under chapter 504. See Iowa Code 357A.1
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Auditor: means the county auditor of a county in which a district has been incorporated and organized or is proposed to be incorporated and organized. See Iowa Code 357A.1
  • Board: means the board of directors of a district, and "director" means a member of such board of directors. See Iowa Code 357A.1
  • City utility: means all or part of a waterworks, gasworks, sanitary sewage system, storm water drainage system, electric light and power plant and system, heating plant, cable communication or television system, telephone or telecommunications systems or services offered separately or combined with any system or service specified in this subsection or authorized by other law, any of which are owned by a city, including all land, easements, rights-of-way, fixtures, equipment, accessories, improvements, appurtenances, and other property necessary or useful for the operation of the utility.   • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Council: means the governing body of a city. See Iowa Code 362.2
  • Department: means the department of natural resources. See Iowa Code 357A.1
  • District: means a rural water district incorporated and organized pursuant to the provisions of this chapter. See Iowa Code 357A.1
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Member: means an owner of real property which is located within a district, the tenant of the real property, or another person acting for the owner with the owner's written consent. See Iowa Code 357A.1
  • Officer: means a natural person elected or appointed to a fixed term and exercising some portion of the power of a city. See Iowa Code 362.2
  • Ordinance: means a city law of a general and permanent nature. See Iowa Code 362.2
  • Participating member: means a member who has subscribed to and paid the established fee for at least one benefit unit in a district, in the manner provided by this chapter. See Iowa Code 357A.1
  • Person: means an individual, firm, partnership, domestic or foreign corporation, company, association or joint stock association, trust, or other legal entity, and includes a trustee, receiver, assignee, or similar representative thereof, but does not include a governmental body. See Iowa Code 362.2
  • personal property: include money, goods, chattels, evidences of debt, and things in action. See Iowa Code 4.1
  • Personal property: All property that is not real property.
  • property: includes personal and real property. See Iowa Code 4.1
  • real property: include lands, tenements, hereditaments, and all rights thereto and interests therein, equitable as well as legal. See Iowa Code 4.1
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • Statute: A law passed by a legislature.
  • Supervisors: means the board of supervisors of a county, or the board of supervisors of an adjacent county, in which a district has been incorporated and organized or is proposed to be incorporated and organized. See Iowa Code 357A.1
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • year: means twelve consecutive months. See Iowa Code 4.1
